It was contended that the offense was committed against the laws of the territory and he should have been tried under those laws by the terri torial court. The same order was made n the case of Captain Jack, an Indian, whose case is substantially the same as that just decided, and who was sentenced to thirty years imprison meat in the Ohio penitentiary.
