The Cats to be Decided on the 23d Instant- The News says : The celebrated suit of the Oreonian Railway Co. (limited) vs. the 0. R. & Co. wiil come up in the United States supreme court on the l'3d instant. If the plaintiff wins the suit, the U. il. N. (Jo. wili be compelled to take c harge of the lease and carry out its provisions for the ninety nine years, as provided for by the lease. If the defendants win, the road wili be sold to the Southern Pai-ifie. It is thought that the (. K. ci N. Co. will win on tiiis point. It is necessary that a lease of this kind have the sanction of the state eislature. This was not done, and it is claimed that in this point alone a decision will be given in favor of the U. II. N. it Co. Jn this case it w ill lie remem bered that the U. K. cS; N. Co. leaded the (Jn-jzonian Railway lines for ninety-nine yeais, and after a short time ceased to operate the road. Since then the Oregonian Railway Co. lias neriodicallv sued the U. Ii. & N. Co. in the United States court, and as regularly secured a verdict for rent. Killed in saloon Kiih. The Burns, Grant county, Her ald, contains the following account of the murder of W. H. Brown, a former resident of this city, ami a brother of Gen. Mart V. Brown, deceased, former editor of the Democrat: ''About ti o'clock, Sat urday evening, Sept. 8th, in the course of an altercation between two residents of Harney Valley, Win. Page and Win. 11. Brown, in C. M. Caldwell's saloon in Burns, the latter was shot dead in the presexce of witnesses. Page was arrested on a charge of murder by W. W. Johnson, deputy sheriff", though he had acknowledged him self the doer of the deed a few minutes before by giving himself into custody of a bystander, Joe Wooley. J. C. Woolev, a witness to the crime, testified as follows, which shows how the murder hap pened : 1 was present at Mr. Cald well's saloon when the shooting commenced. Heard there was a fuss between Brown and Page. Brown came to me by Byrd's stable and said that Bill Page was going to lick him. I told him I guess not, that he (Brown), was too old a man to fight. I asked him what the trouble was. He said, 'nothing much, but Bill Page thinks he can run a olutt on me. He (Brown) pulled out a knife and and said, 'I'll stick that into Page before sun-up in the morning.' I went into Caldwell's saloon to play billiards with Mr. Armor, l'age says to Brown, 'come and take a drink.' Clark says to Page, "I'm waiting for you to go home.' Brown says to Page, 1 can lick yon from Dan to Beersheha.' Page says there is no use for us to fuss, tor there is nothing btween us,' or something to that etfec.-t. Brown says 'by G I will lick you,' and struck Page. Page fell, and while on his back, with his left hand under him, he shot. Brown was going toward him and in about five feet of him, and I ran across to the southeast part of the build ing and didn't see any more. Went out the first time I had a chance." Walked Out. A couple of hilarious indviduals, who were calaboosed on Sunday for having loo much tangle foot, re lieved themselves from durance vile by prying open the calaboose dcor and struck out for the Oregon Pacific railroad at a two-forty gait. They had passes to the tront, but did not stop to use them until they were clear of the city limits. Two-and-a-half for repairs to the cooler was all the damages. Board or Trade. I think 1 would rather be excused irom drinking that kind of water. You boast of the town being out of debt, but I, as a stranger, do not see anything that could put you in debt, as you have nothing in the shape of improvement to show. Now. gentlemen, wake up out of this ' Rip Van Winkle sleep oi twenty vears, and let a stranger suggest" to you how to improve vour town and bring people among vou to settle and make permanent homes. In the first place let some oi vour leading men get together and pick out some young and enterprising men, regardless of all nnhtirs tint, all uolitics aside and let them agree to mi prove the town then elect them as councilmen or supervisors, and have them appoint an engineer to see the amount of sewerage neces sary to be done and the total cost of the same, then issue bonds for the work. Notify the property owners inside of the city limits to connect their priveis w ith the sew ers. This may save vou from an epidemic, as that will be sure to c ome sooner or later, if things are allowed to go as they are at pres ent. Then again have them pass a cow ordinance and establish a pound and pound laws. Then there would be some encourage ment, for people to leautify their homes with flower gardens without having them destroyed by cows and your sidewalks broken. By doing so you would encourage others to come and settle among you, as you have a nice location for a town, but people who have families, and who would like to come and settle among you, would now after examining the position you stand in, would remain silent and walk away. I have heard that a gas company wants to invest capital and build gas works in vour town. How have you treated them? By what I have heard the matter stands thus: The enter prise was discouraged from the fact that the gas company wanted a franchise for a term ot years, and that might offer some opposition to the recently constructed electric light plant. Is this the way a live town treats propositions of this kind? Do you expect any gas company would invest their cap ital without a liberal franchise? And as a stranger I would suggest to let all your old settlers stand aside and take a rest and let the voting and enterprising men take hold of this matter, as by your experience of late years they have made a failure of the whole busi ness. The trial trip was made yesterday to Van couver on the newly constructed railroad. The trip was a success. The regular schedule of ai rivals and departures will be established for the different points within the city. The line will locate for the present at L street in East Port land. It is the intention to take passengers to Vancouver witiiin I'O minutes from starting. A street car system is to be built in Van couver which will connect with the Portland line. It is confidently expected that the business im pulses oi East Portland and the country through which the new line passes will be wonderfully stimulated when the road is in active operation. Loss Paid. Yesterday the loss on the fire which destroyed Mr. Mark Hul burt's house, which was covered by a policy in the Hartford Insur ance Co., H. F. Merrill, agent, was paid in full. The only delay being time to reach the head office on this coast and get the returns. Will Fay. Preparation were in progress yesterday by Mr. Searles. of Searles & Deane, contractors on the Oregon Pacific construction, to pay off the workmen.
