Hence not all work done in or about a mining claim as assess ment work may be sufficient to hold the claim The views of the land uflice upon this subject may be said to be these: A ll improvements made open a mining claim having a direct relation to the development thereof may be taken into consider tion. Necessarily, however, improvements indicated must be associated with actual excavations, such as cuts, tunnels, shafts, etc., so as to clearly show that they are in tended for use in connection with the claims. Prospecting work is within the spirit of the law but picking rock from the walls of a shaft or from outcropiugs iu small quantities from day to day for the mere purpose of ascertaining the value is not sufficient. Good faith has much to do with the mutter, and it is said by our Supreme Court thnt a court will not be per mitted to substitute its own judg ment as to the wisdom or expedi ency of the method employed for developing the claim iu place of that of the owner. There is nothing which excuses the non-performauce of annual labor except the action ol an adverse claimant, or possibly in exceptional eases for some uuusiial natural condition It is immaterial whether the work don is paid for or not, or by whom it is paid, i. e. the work can be done by either the legnl or equitable owner of the properly with like effect. A co- uwner in a mining claim who does not pay ins pi opoitiouate sh ire of the. expense of representing the claim mav be deprived of his inter est by being given notice of claim for contribution. This notice may be by personal service or by pub lication in a niwspaper. The right to give this is limited t>> a co owner who has performed the labor. The claim for contribution must also be limited to the delinquent’s share of the yearly expenditure as fixed by stutute or local law. I f payment is not made within tbe required time the delinquent co-owner’s interest vesta by operation of law in the contributing co owner. Therefore, I. T. T.
