A sensational action for damages
was instituted in the circuit Court at

being another outcropping of the long
waged and norelaxed community war
over the liquor traffic. The plaintiff
to the action is Chas. E. Baxter, and

there are named as co-defendants and
co-conspirators J. J. Lamb, M. H.
Heraey, W. A. Goodman and A. E.
Simpson. The amount sued for is
$5000 and costs. A. S. Hammond is
attorney for the plaintiff.
Iu bis complaint Mr. Baxter al
leges that iu June, 1905, tbe defend
ants conspired to injure him io rep
utation aud business by causing bis
arrest and tbe continued closing of
his establishment, be being, as be
further alleges, eugaged in lawful re
tail liquor selling in the city of Co
quille. By reason of such arrest aud
tbe deprivation of business earnings,
contrary to the law and bis rights as
a citizen be contends, be bas been in
jured in character and business to an
extent valued at $5000. Costs ancl
counsel fees are also demanded.
The action will come up for tnil at
tbe September term of court, but as

The “sympathetic boycott’’ is un-
A uteri can, un just aud a two edged
weapou. It uever bas beeu considered
legal, aud the only reason it bas uever
beeu attacked is because of tbe finan
cial responsibility of tbe unions.
Several weeks ago, however, tbe
Pennsylvania court assessed a car-
(leuters uuion some $2,800 because it
bad boycotted a planing mill owner
Tbe latter brought suit, and tbe court
assessed damages for tbe amount
sluted and issued attachment against
tbe personal property of individual
members of tbe union. If a merchant
should parade in front of another
man’s place of business with banners
to tbe effect that bis goods were “un
fair,” v suit would be brought iu a
burry, because the rival ' merchant
would be financially responsible.
Hence, if a law is good for oue class
of men it stands to reason that it
should also be just to auotber class.
Labor unions should incorporate for
their own protection. The iuuocent
man whose property is attached
suffers from the misdoings of the
walking delegate who lias no assets
aud is nut financially responsible and
earns bis daily bread by tbe power
of bis jaw. Moreover a legal body
will not do anything that may be sub
ject to legal attack, and tbe old
fashioned way of talking tbeir griev
ances over with tbeir employer should
prevail. The average employer is in
clined to be fair, and au unfair em
ployer cannot stand against public
opinion. Tbe boycott must go!—
