Hermann Trial Early in June \\ asbiugtoii, May 2. Kepi'eeelit ative Heriuauu, indicted for alleged destruction of 35 press copy books connected with the liilMiiess of the general land office, will probably be placed on trial early in June Jus ti'*e Gould today denied the requeat of United States Attorney Baker to have the case, which had been set for trial last Wednesday, postponed until fall Mr. Baker stated that his reason for asking for the appointment was that F. J. Heney. who had practically complete charge of the case, had been compelled tn leave for California, where lie had sidTered great financial loss in the recent disaster. A. 8. Worthington, counsel for Hermann, stated that defendant was anxious for trial. Counsel strenuously opposed the motion for postponement, stating that there were several witnesses in the city who live thousands of miles distant and whose testimony would be of the highest value to the de feudant. Mr. Worthington iuformed the court that unless the trial was al lowed at the present term these wit tiesses would not lie available on ac count of having returned to their homes. Justice (Iould stated that it would require a very strong preseutatiou to have it postponed until fall. He re marked that the case was not one which involved an intricate question of law. ami added that tlie govern meut was not without means of pro ceeding with the trial tiecause of the absence of any particular counsel. He further stated that he would not des ignate any date for the trial, but re marked that the first week in Juno was as late a time us would be ac ceptable to the court, ia the mean- time the <*oliit observed Mr. lleney might have an opportunity to get hie affairs in California in such shape as to return and participate in the trial. Mr. Baker will call on Secretary I Hitchcock and ask him to arrange to have Mr. Heney return to conduct the prosecution. If Mr. Heney can not return in Jum*, Mr Baker will conduct t he prosecution. 1 J 1.3 .3 3.3.3 3--3A.S M. <». Pohl of Myrtle Point was a i business visitor yesterday Mrs. Win.
