WHmvtaa i • It if* - ; »(’• ni in«z thn Several Eastern newspapers, and prominent lawyers and tber citizens as well, using the Nau Patterson case as the latest object lessou, are urging a reform in tbe jury system, so that iu the case of tbe death or illness of one or pven more jurors tbe trial can ami must still proceed, instead of drop ping the trial an J having a new one at great cost to taxpayer« and much vexation to wit^rsses end even tbe lawyers themselves. M .ny New York lawyers, aided by llie in lorsement of several justices of the supreme «’unit, county judges, and some of the jus tice« of tbe Supreme Cotill of the United Stales, are Io make efforts this winter at Albany to have a con stitutional amendment proposed that will effect this reform. One plan is to provide for verdicts by three-foni tbs of a jury, nine of tbe twelve. This is one method of doing away with bung juries that is often proposed, agd almost everybody except some lawyers, seema Io agree that it would be a sensible move, and yet legisla tures neglect to net npoii it. Many, however, would object to its applica tion to first-degree murder cases, nixl ns to them it is not likely soon to be adopted, if at all. Another proposed amendment will provide that whenever a jury has been selected to try a crimiual case, the judge ¡a bin discretion may have from one to six additional jurors drawn, as a supplemental jury, who shall listen to the testimony, and be prepared to take the place of one or more jurors who may become iucapaciated. This wo think faulty in leaving the matter to tbe discretion or caprice of a judge, and also because jt is unnecessory to have twelve men decide |,;iy case.
