4 JANUARY 15, 2006 Smoke Signals Friday, December 9, 2005 Special Meeting 3:33 p.m. Meeting was called to order by Tribal Council Vice-Chairperson, Angie Blackwell. A quorum was present. Present was Angie Blackwell, Chris Mercier, Reyn Leno, Jan D. Reibach, Wink Soderberg and Kathleen Tom. Excused was Cheryle Kennedy (personal leave), Jack Giffen, Jr. (travel), and Wesley "Buddy" West (personal leave). Invocation was done by Jan D. Reibach. NEW BUSINESS LEGISLATIVE ACTION COMMITTEE 2005 Contingency Budget Fund Transfer to Member BenefitGaming Budget. Reyn Leno moved, Wink Soderberg seconded to adopt Resolution 193 05 authorizing the Finance Officer to transfer up to $1,500,000 from the CY2005 Contingency Budget to the Member BenefitGaming Budget cost center to be used for the 2005 Gaming Per Capita payment. 3:35 p.m. Reyn Leno moved, Wink Soderberg seconded to adjourn meeting. Present was Angie Blackwell, Jack Giffen, Jr., Cheryle Kennedy, Reyn Leno, Chris Mercier, Jan D. Reibach, Kathleen Tom, Wink Soderberg and Wesley "Buddy" West. Invocation was done by Jan D. Reibach. PREVIOUS MINUTES APPROVEAMEND Reyn Leno moved, Wink Soderberg seconded to approve the December 7, 2005, Tribal Council regular meeting minutes as presented. Motion carried 6-0-2. Angie Blackwell and Chris Mercier abstained. Chris Mercier moved, Angie Blackwell seconded to approve the December 9, 2005, Tribal Council special meeting minutes as presented. Motion carried 6-0-2. Jack Giffen, Jr. and Wesley "Buddy" West abstained. NEW BUSINESS LEGISLATIVE ACTION COMMITTEE H 2006 Compensation Plan Approval. Angie Blackwell moved, Reyn Leno seconded to adopt Resolution No. 194-05 approving the 2006 compensation plan for Tribal Government. Discussion followed. Motion carried 6-1-1. Kathleen Tom voted no. Chris Mercier abstained from voting, fl Authorization to Pay Attorney's Fees & Costs to Jan D. Reibach. Jack Giffen, Jr. moved, Reynold L. Leno seconded to adopt Resolution No. 195-05 authorizing the Tribe's Finance Officer to pay the attorney's fees in the amount of $4,361.88, which were incurred by Jan D. Reibach in defending himself against lawsuits filed by Ed Pearsall in Tribal Court. Discussion followed. Valorie Sheker Robertson 2236 asked for a roll call vote. By full consensus of council a roll call vote was taken by the Recording Secretary, Lauri A. Smith. Wesley "Buddy" West, Jack Giffen, Jr., Chris Mercier, Angie Blackwell, Reyn Leno and Wink Soderberg voted yes. Kathleen Tom and Jan D. Reibach ab stained. Motion carried 6-0-2. Authorization to Pay Attorney's Fees & Costs to Bob Haller. Jack Giffen, Jr. moved, Reyn Leno seconded to adopt Resolution No. 196-05 autho rizing the Tribe's Finance Officer to pay the attorney's fees in the amount of $4,361.88, which were incurred by Bob Haller in defending himself against law suits filed by Ed Pearsall in Tribal Court. Discussion followed: June Sell-Sherer 735 asked that the council members who abstained, please state their reasoning. Council member Kathleen Tom stated that the discus sion begun prior to her elections to council and therefore, chose to abstain. Council member Jan D. Reibach advised that since Bob and he had hired the same attor ney to handle their respective cases, he therefore elected to abstain from voting. Valorie Sheker Robertson 2236 asked the council as to why the Finance Of ficer and not the Risk Manager is directed to pay the attorney fees. Council Chairwoman Kennedy responded that the Risk Manager's position falls under the oversight of the Finance Officer. The keynote address is to be deliv ered by Mr. Ray Naff, Governor Kulongoski's Director of Intergovernmental Relations. RSVP requested before January 18, 2006. Angie Blackwell, Jack Giffen Jr., Cheryle Kennedy, Reyn Leno OTHER BUSINESS June Sell-Sherer 735 asked for clarification of council's action regarding a Tribal Council Record of Instructions on CY2005 per capita percentage alloca tion distribution directions. Council member Chris Mercier read for the record: The Tribal Council shall make an allocation percentage allocation under the Gaming Revenue Allocation Plan each year. For 2005, this percentage is rec ommended to be set at 31.32 of net revenues from Spirit Mountain Gaming, Inc. (2005 allocation percentage of 31.32 is a change and needs Tribal Council approval) Recommendation of council present at the meeting is as follows: 1. Angie Blackwell, Jack Giffen Jr., Reynold L. Leno, Jan D. Reibach, and Wink Soderberg recommended 31.32. 2. Kathleen Tom and Wesley "Buddy" West recommended 33. Discussion followed. Valorie Sheker Robertson 2236 stated the following: 1. Offered any assis tance in meal preparationserving for the family of Mario George. 2. Was the reasoning behind the lowered per capita distribution this year due to loan pay ments on the Spirit Mountain Lodge expansion? Council Chairwoman Kennedy advised that the loan payment on the Lodge was involved. The loan is antici pated for repayment by CY2007. Discussion followed. Prominent Tribal Loader Rudy Clements Passes ilvray Story Courtesy of the Associated Press . Bend-- Warren Rudy Clements, the leader of economic development and the longtime pub lic face for the Confederated Tribes of Warm Springs, passed away at St. Charles Medical Center in Bend. He was 69. . ' The cause of death was complications from diabetes, according to a statement from the Tribes. During three decades working for the Tribes, Clements served as the municipal manager, the manager of Employee Develop ment Department and the first director of the Warm Springs community center. Most recently, Clements served as Director of Tribal Relations and was one of the leaders of the Tribes' effort to build a new casino at Cascade Locks. " "He's going to be missed in a lot of different ways," said JodyCalica, Secretary-Treasure for theTribes. "We're going to have to look awfully hard to find some of the leadership Rudy provided." Clements was born on the Reservation on June 10, 1936, the oldest son of Bart and Helen McCorkle Clements. He was among the first in his Tribe to graduate from college, earning a Bachelor's Degree in Elementary Education from Eastern Oregon University. Clements served on numerous state and local boards and helped then state Sen. Vic Atiyeh create the Legislative Commission on Indian Af fairs in 1975. . Atiyeh, who later became governor, said Thursday that Clements al ways was there when something important needed to be done. He said Clements wa s a jovial man, and the pair kept in touch regularly. Clements is survived by his wife of 47 years, Anna Queahpama Clements; brothers George, Mike and Grant Clements; one granddaugh ter Shayla Frank and one great grandson, Jake Frank.
