Present was Jack Giffen, Jr., Val Grout, Bob Haller, Cheryle Kennedy, Ed Larsen, Reyn Leno, Jan D. Reibach, June Sell-Sherer and Valorie Sheker-Robertson. Invocation was done by Val Grout. PREVIOUS MINUTES APPROVEAMEND: TABLED n Reyn Leno moved, Ed Larsen seconded to table the Tribal Council meeting minutes dated August 11, 2004, until the next regularly scheduled meet ing. NEW BUSINESS LEGISLATIVE ACTION COMMITTEE B BIA Transportation Administrative Capacity Building Proposal. Val Grout moved, Jack Giffen, Jr. seconded to adopt Resolution No. 121-04: 1) concurring with Affiliated Tribes of Northwest Indians Reso lution 04-61 requesting that the Bureau of Indian Affairs make $35,000 available from construction funds annually to each Northwest Indian Tribe for administrative capacity building or any other Title 23 eligible activity; 2) requesting a 638 contract for $35,000 in administrative capacity build ing funds to perform the scope of work and budget presented; and 3) au thorizing the Tribal Council Chairwoman or, in her absence, the Tribal Council Vice Chairman to execute all documents required for these funds. Motion carried 8-0-0. D Coussens Property Purchase. Val Grout moved, Ed Larsen sec onded to adopt Resolution No. 122-04: 1) approving an agreement for the purchase of real property known as Washington County Parcel Num ber R0732422, as presented by Tribal Lands Department staff; 2) autho rizing the use of funds from the 2004 land acquisition contingency budget for such purchase; 3) authorizing the Lands Manager or General Man ager, with the assistance of the Tribal Attorney, to finalize and execute said agreement; and 4) authorizing the Tribal Council Chairwoman to execute any documents necessary to complete transfer of the property. Discussion followed. Motion carried 8-0-0. D Trust Conversion of Real Property. Reyn Leno moved, June Sell Sherer seconded to adopt Resolution No. 123-04: 1) requesting that the Department of the Interior, Bureau of Indian Affairs, hold title to real property located in Yamhill County, Oregon, known as the "Eastman Meyer Property," identified as Parcel 1 on Yamhill County Partition Map 2003 28 located in Section 1 of Township 6 South, Range 8 West of the Willamette Meridian, in trust for the benefit of the Confederated Tribes of the Grand Ronde Community of Oregon, and 2) authorizing the Tribal Council Chairwoman to execute any documents necessary for said trans fer of the EastmanMeyer Property to the Department of the Interior. Dis cussion followed. Motion carried 8-0-0. B Annual Low Income Home Energy Assistance Program. Reyn Leno moved, Valorie Sheker-Robertson seconded to adopt Resolution No. 124-04 authorizing the Tribe's application to the Department of Health and Human Services for Low Income Home Energy Assistance Program grant funding, and authorizing the Tribal Council Chairwoman or, in her absence, the Tribal Council Vice Chairman to execute all documents re quired for this application. Discussion followed. Motion carried 8-0-0. B CommitteeSpecial Event Board Travel Policy Amendment. Jack Giffen, Jr. moved, Reyn Leno seconded to adopt a motion approving the amendment to the CommitteeSpecial Event Board Travel Policy, section (e) Out of State Travel to read "Out of State travel must be supported by Committee or Special Event Board minutes and approved at a Tribal Coun cil meeting, or by the signature of a majority of Tribal Council members in an emergency situation provided the request has been presented to at least five (5) council members. Motion carried 8-0-0. B Systems of Care Grant AgreementApplication. Val Grout moved, Jan D. Reibach seconded to adopt Resolution No. 125-04: 1) authoriz ing the submission of the Systems of Care Grant Agreement 108551 for the grant award in the amount of $47,344; 2) authorizing the Tribal Council Chairwoman or, in her absence, the Tribal Vice Chairman, with the assis tance of the Tribal Attorney's office, to execute all the forms required for this application and funding; and 3) that this resolution shall remain in effect until the program is completed or until termination of the program. Motion carried 8-0-0. B Compensation of Spirit Mountain Gaming, Inc.'s Director of Sur veillance. Reyn Leno moved, June Sell-Sherer seconded to adopt Reso lution No. 126-04 approving the compensation recommended by Spirit Mountain Gaming Inc.'s Board of Directors for Steve Bobb, Jr. as the Di rector of Surveillance. Discussion followed. Motion carried 8-0-0. B Compensation of Spirit Mountain Gaming, Inc.'s Director of Gaming. Jan D. Reibach moved, Valorie Sheker-Robertson seconded to adopt Resolution No. 127-04 approving the compensation recommended by Spirit Mountain Gaming Inc.'s Board of Directors for Mitchell Goldstein as the Director of Gaming.-; Motion carried 8-0-0. 4:49 p.m. Val Grout moved, Ed Larsen seconded to adjourn the meet ing. PREVIOUS MINUTES APPROVEAMEND September 15, 2004 Tribal Council meeting minutes were tabled by consen sus of council. NEW BUSINESS LEGISLATIVE ACTION COMMITTEE Portland Harbor Tribal Funding Agreement Amendment No. 1. Angie Blackwell moved, Wesley "Buddy" West seconded to adopt Resolution No. 134-04: 1) approving the Amendment No. 1 to the Portland Harbor Tribal Funding Agreement adding the Yakama Nation to the list of Tribal govern ments participating in the Agreement; and 2) authorizing the Tribal Council Chairwoman to execute said Amendment. Motion carried 4-0-0. Establish Tribal Events Imprest Bank Account. Wesley "Buddy" West moved, Chris Mercier seconded to adopt Resolution No. 135-04 authorizing the establishment of a bank account with Bank of America to be used for Tribal events (e.g. pow-wows & rodeos) and designating Trevor Aaron, Bryan K. Lan gley, Deborah R. Larsen and Jeffrey S. Valentine as authorized signers on the duel signature account. Motion carried 3-0-1. Angie Blackwell abstained. Establish CTGR Tribal Member Health Plan Bank Accounts. Angie Blackwell moved, Jan D. Reibach seconded to adopt Resolution No. 136-04: 1) authorizing the establishment of two bank accounts and one sweep account with Bank of America to be used for the CTGR Tribal Member Health Plan, and 2) designating Tribal Council Chairwoman Cheryle A Kennedy and Tribal Coun cil Vice Chairman Reyn Leno as authorized signers on the accounts. Discus sion followed. Motion carried 4-0-0. Spirit Mountain Community Fund Board of Trustees. Jan D. Reibach moved, Angie Blackwell seconded to adopt Resolution No. 137-04 reappoint ing Kristine Olson , Kate Brown and Sho Dozono to the Spirit Mountain Com munity Fund Board of Trustees to serve two year terms expiring in September of 2006. Discussion followed. Motion carried 4-0-0. II Education Committee Out of State Travel. Wesley "Buddy" West moved, Chris Mercier seconded to approve a motion authorizing members of the Educa tion Committee Patsy Pullin, Shelby Olson Rogers and Bob Tom to attend the National Indian Education Association conference in Phoenix, Arizona. Mo tion carried 4-0-0. B Enrollment Infant Determinations. Wesley "Buddy" West moved, Jan D. Reibach seconded to adopt Resolution No. 138-04 approving (2) minors numbered 5420 and 5421 for Tribal membership, because, based on the in vestigation and recommendation of the Enrollment staff, the minors have been found to meet the eligibility requirements for enrollment defined in the Enrol ment Ordinance and Tribal Constitution.
