She is the youngest sister to Margaret Buckland and daughter to Myrtle Smith. Squeeze passed away in Reno, Nevada on April 22, 2018. We are following her ■washes and her service will be in B row nihg, M o n tan a, ■ where she grew up. She is survived by her sis te r D arle n e P ark er from Rockyboy, M ontana; N eva Runningwolf from Brown ing, Montana; and her only b r o th e r G en e B unny R u n n in g w o lf . from Lawrence, Kansas. Shewas surrounded by her family and her two nieces Sheryl Courtney and Carla B uckland, h er sons M yrt R u n n in g w o lf and Stan Runningwolf, and grapdson Guy Runningwolf, who was with his grandma for the nine' m o nths’ while She received her treatments; along with her at her gravesite in Browning. We will be taking Squeeze’s ashes over G lacier Park on Sunday, July 14 to spread them in the park she loved so much, and the family will be having a big picnic in h o n o r o f b o th Squeeze and Margaret. We would like to invite any and all to pay their, respects to these two wonderful women. Both are missed by our family, best friends who drove down to Reno to be with her, Eva ‘Tiny’ Cobell and Punkin Laplant. She called them the Golden Girls. She is also survived by her d au g h ter N eva L aw rence o f Browning. We both will be travel ing to-Browning on July ,12. Resolutions of Tribal Council Opioid lawsuit Whereas Tribal Council rec ognizes that the use and misuse o f opioids has increased dramati cally, and that such use and mis use has, caused a health, and soci etal crises across the United States and on Indian lands; and, ® Wher,eas rh,e. T ribe and its.;, members have suffered and con tinue to suffer serious impacts (t o their health, families, and commu nity as a result of the opioid cri sis;;;.,..,;. " ■ A ',.-"., Whereas Tribal Council finds that it is in the best interests of the Tribe and its members to pur sue litigation and seek damages from the co n trib u to rs o f the opioid crises for the harm suf fered by the Tribe and its mem bers and to further seek interven tion by a court o f appropriate ju risdiction to abate and remediate the practices that have contributed- to the opioid crisis; and, Whereas, to pursue such liti gation, the Tribe desires to retain the law firms of Skikos Crawford 'SkikoS & Jo se p h , LLP and J o h n s o n , J o h n s o n , L ucas & M iddleton, P.C. (together, the “Law Firms”); now, therefore, Be it resolved by the Twenty- Seventh Tribal C ouncil, o f the C o n fe d e ra te d T ribes o f th e W arm Springs R eservation o f O regon, pursuant to Article V, Sections (b), (1), and (u), o f the Tribal Constitution and By-Laws, that the Tribal Council hereby authorizes and approves tKe en gagement o f the Law Firms on the terms and conditions substan tially set forth in, the Legal Ser vices Agreement attached hereto as Exhibit A; and, Be it further resolved that Tribal Council hereby authorizes the Chairman, Vice Chairman and Secretary-Treasurer/CEO o f the C o n fe d e ra te d T ribes .o f the W arm Springs R eservation o f Oregon in consultation with the Tribal A ttorneys and the Law Firms to take all actions neces sary in the course o f any litiga tion contemplated in this Resolu tion, including but not limited to approving the filings o f any plead ings, th e issuances o f and re sponding to discovery requests, and em ploym ent o f third-party vendors, together with approval o f any publications or outside com m unications regarding , thé Tribe’s involvement in any such litigation; provided, however, that any 'offers of Settlement and any final settlement agreement must be approved by further resolution o f the Tribal Council, absolution no. 12,489. ' Timber LLC Whereas thé C onfederated Tribes of the Warm Springs Res ervation of Oregon is a federally recognized tribe, organized pur suant' to the Constitution o f the C o n fed e rate d T ribes o f the W arm Springs R eservation o f Oregon, approved by the Secre tary of the Interior on February 14,1938 (the “Constitution”); and, Whereas, pursuant to Title IV o f the Indian Self-Détermination and Education Assistance Act, Pub. L, 93-638, the T ribe and the United States Department o f the Interior (“Interior”) have entered into a com pact o f Self-G over nance (the “Compact”); and, , Whereas, p u rsu a n t to th e Compact, the Tribe has assumed responsibility fo r the implemen tation of, am ong oth er things, Intérior’s forestry program (the “Forestry Program”), which wàs previously adm inistered by the Bureau o f Indian Affairs (“ BI A”); and, Whereas in the Compact, the Ünitéd States expressly reaffirms its trust responsibility to protect and Conserve the trust resources o f the Tribe and its mem bers; and, Whereas the Tribe has del egated the implementation o f the Forestry Program to the Branch o f N atural Resources, Forestry Department (“BNR Forestry”)and Timber Committee; and, . Whereas BN R Forestry u n dertakes forest land management activities pursuant to the Compact and the National Indian Forest Resources Management Act, 25 U.S.C. • §§ 3101 et seq. (“N IF R M A ”) and its implementing regulations, 25 C.F.R. Part 163, and Tribal Ordinance 74', and, Whereas the Tribe has formed (and is the sole member of) the Warm Springs. Timber Company, LLC, a Confederated Tribes o f W arm Springs lim ited liability company (the “Timber Company”) for the purpose o f obtaining the highest overall value for the Tribe’s timber resources through prudent harvesting, merchandising, and re selling o f the Tribe’s timber; and, Whereas the Tribe has also des ignated the Tim ber Company .as the Tribe’s Indian enterprise for pur poses o f 25 C.ER. Part 163; and, . W hereas, p u rsu an t to Tribal R e s o l u t i o n s 12,278 and 12,354, Tribal Council authorized the Tim ber Company to be the primary purchaser o f the Tribe’s titiiber in 2017 and also directed BNR For estry and the Timber Company to enter into a written memorandum o f understanding, setting forth the parties’ roles and responsibilities with respect to the Tribe’s 2017 Timber Sale Program; and, , Whereas Tribal C o u n c il'b e lieves that it is in the best interests o f the Tribe that the Timber Com pany continue to operate as a go ing concern and as the primary pur chaser o f the Tribe’s timber; apd, Whereas Tribal Council b e lieves that it is in the best interests o f the Tribe that BN R Forestry and the Tim ber Com pany enter in to an am ended and restated memorandum o f understanding in substantially the form attached hereto as Exhibit A (“M OU”); now, therefore, Be it resolved by the Twenty- Seventh Tribal Council o f the Con federated T ribes o f the W arm Springs Reservation o f Oregon, pursuant to Article V, Sections 1 (a), (c), (f), (t), and (u) o f the Tribal Constitution and By-Laws, that the Tribal Council hereby: (a) A ffirm s th a t each “Whereas” in this Resolution is true and correct in all material respects; and (b) Approves the MOU and directs BNR Forestry and the Tim ber Company to execute the MOU and im plem ent it in good faith: absolution no. 12,495. United States, and Willamette Falls o f the Willamette River at Oregon City is one such treaty-reserved “usual and accustomed” fishing sta tion; and, Whereas for not less than time immemorial Warm Springs tribal members have harvested eels, also known as lamprey, at Willamette F alls, Bull R un, Sandy R iver, Clackarhas River, N orth Santiam River, 15-Mile Creek, and at other ‘‘usual and accustomed” fishing sta tions to use for ceremonial, sub- sis.tence, and other purposes; and, ■ ' Whereas it is important as an exercise o f sovereignty and to meet the conservation needs for the re source that the Tribe actively man age the eel fishery at Willamette Falls; and, Whereas Section II J. o f the 2008-2017 United States v. Oregon Management Agreement, executed on May 9, 2008 by the W arm Springs Tribal Council Chairman, and on May 20, 2008 by the Di rector o f the Oregon Department o f Fish and Wildlife, which is an O rd e r o f th e Federal D istric t Court o f Oregon in case Civil No. 68-513-KI requires a process that includes discussions between the State o f Oregon and Warm Springs and other party Tribes each year to establish lamprey take (harvest) levels at Willamette Falls each year; and, Whereas those take or harvest levels o f lamprey at W illam ette, Falls are managed by and through regulations establishing the time, place, and manner o f lamprey har vest; and, Whereas the State o f Oregon did not enter into the process as required by the 2008-2017 United States v. Oregon Management Agree ment to work with Warm Springs and other party Tribes to set the annual take regulations, and uni laterally declared w hat the 2014 Willamette Falls take regulations* would be in a letter dated May 27, 2014, and moreover said letter is represented as a “perm it” issued by Oregon for lamprey hairiest at Willamette Falls; and, W hereas the Tribe’s lam prey harvest at Willamette Falls is pur suant to its June 25, 1855 Treaty with the United States, and no li cense, permit, or authorization o f any type by the State o f Oregon is necessary for the Tribes’ har vest o f lamprey at W illamette Falls, and therefore, the Tribe does n o t acknow ledge or accept the purported perm it offered by The State o f Oregon; and, State of Oregon Depart ment of Human Services, 678 N E Highway 97 # C , Ma dras. 541-475-3438. Whereas, notwithstanding the State o f Oregon’s failure to abide the process required by the Man ag em en t A g reem en t, and th e Tribes’ rejection o f the offered State o f O regon “p erm it”, the Tribe desires to maintain a status quo with respect to Willamette Falls lamprey take regulations to pro vide for a conservative harvest, and also to facilitate the resolution o f lam prey h a rv e st issues at Willamette Falls at a manager-to- manager level in the appropriate United States v. Oregon process tatixCL than through litigation; the Tribe will regulate its Treaty lamprey har vest as it has in prior years; now, therefore, Be it resolved by the Twenty- Seventh Tribal Council o f the Con federated Tribes o f Warm Springs Reservation o f Oregon; pursuant to Article V, Section 1(1) and (u), o f the Tribal Constitution and By- Laws and p u rsu a n t to W arm S prings T rib al C ode S ection 340.300 that the 2018 EEL Fish ery regulations hereby approved, adopted and enacted by the Tribal C o u n cil o f th e C o n fe d e ra te d Tribes o f the Warm Springs Res ervation o f Oregon: 1. Tribal members wishing to take eels for ceremonial and sub sistence purposes must carry tribal enrollm ent cards to fish under claim o f treaty rights. Enrollment cards must be in possession while fishing. 2. Harvest is allowed through August 15. 3. H a rv e st is allow ed at Willamette Falls by hand or with hand powered tools. T he open area is noted on the map (attached to resolution as an exhibit, avail able at BNR). 4. Harvest is open 7 days per week o f each m onth unless lim ited for conservation measures. 5. Fishing hours are sunrise to sunset. 1 6. This is a subsistence fishery as defined by Tribal Code 340.100. 7. BNR personnel shall moni tor and enforce the fishery with regard to Warm Springs members participating in the 2018 fishing season at Willamette Falls; 8. Harvesters will allow Warm Springs BN R personnel to creel lamprey catch. 9. BNR will offer creel data col lected to O D FW at the end o f the harvest season. 10. In c id e n ta l h a rv e st o f salmon, steelhead or trout may be kept for ceremonial or subsistence use. absolution no. 12,496.
