Spîlyay T ym oo, Wgi-m Springs, O regon September 17, 2014 Page 9 Resolutions of Tribal Council Ceded Lands hunting Whereas the Tribal H unt ing and Trapping Code Chap ter 350 requires the Tribal Council to review the status o f wildlife populations annu ally and set seasons and bag limits, and Whereas the Tribal Coun cil has reviewed the attached limits, seasons and other regu lations as recom mended by the Branch o f N atural Re sources and the F ish and Wildlife Committee, and Whereas, th ro u g h th e T reaty w ith the T ribes o f Middle Oregon signed June 25, 1855 the Confederated Tribes reserved the right to fish, hunt and gather roots and berries on ceded lands, and Be it resolved by th e Twenty-Sixth Tribal Council o f the Confederated Tribes o f the Warm Springs Reser vation o f Oregon pursuant to article V, section 1 (i) and (1) o f the Tribal Constitution and the H unting and Trapping Code Chapter 350.210, that th e “2014 CTW S C eded Lands H unting Regulations” are adopted as. provided in the re c o m m e n d a tio n (below ) from the Natural Resources Branch and the Fish and Wild life Committee, (Resolution no. 11,915.) 2014 CTWS Ceded Lands Subsistence Hunting Regulations Deer - Ceded Lands Deer H iint - T he deer h unt will take place on Warm Springs ceded lands. Tribal members must carry their Tribal ID and present to law enforcement officials when requested while hunting off-reservation. August 30 O ctober 31, 2014 Legal Weapons: Centerfire Rifle, Archery (40 lb. o r I g re a te r draw ), M uzzleloader and Shotgun with slugs only. Tag Limit: Two (2) buck deer tags in possession per subsistence hunter. Tag must be affixed to buck deer hav ing a visible antler. H unters may be issued additional tags only after previously issued tags are filled and reported to th e B ranch o f N atu ral Resources, . Ceremonial hunt tags for anderless deer will be issued separately by the Fish and Wildlife Committee and the B ran ch o f N a tu ra l R e sources. Ceremonial anderless deer tags will be limited and m onitored by the Tribes. (See separate C erem onial D eer H unting Regulations.) The ceded lands hunt area is on federally managed lands. Private land hunting is subject to all state hunting laws and requirements. Elk - Ceded Lands Elk H u n t' T h e elk h u n t w ill take place on Warm Springs ceded lands. Carbon sequestration W hereas the C o n fed er ated T ribes o f th e W arm Springs Reservation o f O r egon (“Tribe”) is a federally recognized Indian tribe; and, W hereas W arm Springs G eo V isio n s (“W S G ”),- a Tribal Business Enterprise, is advancing the com m ercial opportunities for carbon off set credit project(s) on the R eservation, in p articu lar under the State o f Califor nia Cap and Trade Program; and, Whereas WSG has, work ing in coordination with the Tribe’s natural resources, for estry and legal staff, evalu ated an initial feasibility re view o f the potential for car bon offset credit projects and d e te rm in e d th a t c a rb o n projects are feasible on the Reservation under the Cali fornia Cap and Trade p ro gram and may provide signifi cant revenues and other value to the Tribe; and, W h ereas, P u rs u a n t to T ribal C ouncil R esolution 11,840, the Tribal Council authorized funding from the Business Investm ent Revolv ing Fund (“BIRF”) for WSG to engage qualified profes sionals in a phased develop m ent o f the carbon project potential; and, Whereas WSG has, in co ordination with the Tribe’s natural resources, forestry and legal staff, and with the engaged professionals (“Car b o n P roject Team ”), com pleted Phase I development activ ities in c lu d in g basic project design, revenue pro jections, and commercial for est product evaluation; and, W h ereas th e C arb o n Project Team has developed a recom m endation that the » Tribal Council advance a pre ferred project alternative for Phase II development activi ties, com prised o f detailed carbon offset project devel opm ent, im plem entation o f project management activities consistent with the project, and preparation for project listing and registry with the State o f California and sale i o f credits; provided, how ever, th at certain Phase II activities, including project listing and registry, sovereign immunity waiver and credit sales, require additional Tribal Council approval; and, Whereas the recom m en dation for Phase II develop m ent includes the potential for the Tribe to receive sig nificant revenues and to en hance the Tribe’s forest and ecosystem health and man agement objectives and the Tribal Council believes it is in the b est in terest o f the Tribe to pursue Phase II de velopment activities; and, Whereas the BIRF Com mittee has previously m et on Jan u ary 10, 2014, and re viewed the WSG request for funding for carbon project developm ent purposes and determined that the funding req u est in th e am o u n t o f $175,000 meets the objectives o f this fund; and, Whereas, while Phase II developm ent activities were contem plated in the BIRF funding request, the BIRF funding is currently limited to Phase I development activi ties because that was the ex ten t o f the Tribal Council authorized development ac tivities; and, W hereas th ere rem ains available BIRF funding au thorized for Phase I for a portion o f Phase II develop m ent activities, and the Tribal Council believes it is in the best interests o f the Tribe to authorize the use o f BIRF fu n d in g ’ fo r P h ase I and Phase II developm ent ser vices in an am ount n o t to exceed $175,000; now, there fore, Be it re so lv e d by th e Twenty-Sixth Tribal Council o f the Confederated Tribes o f the Warm Springs Reser vation o f Oregon, pursuant to Article V, Section 1, (f) and (1) o f the Tribal Constitution and By-Laws, that the Tribal C ouncil hereby authorizes WSG in conjunction with the Carbon Project Team to en gage in Phase II development activities, com prised o f de tailed carbon offset project developm ent, im plem enta tion o f project management activities consistent with the project, and preparation for pro ject listing and registry with the State o f California and for the sale o f credits; p ro v id e d , h o w ev er, th e p roject listing and registry, waiver o f sovereign im m u nity, and credit sales, are not hereby authorized but require additional Tribal Council ap proval; and, Be it further resolved, the Tribal Council hereby autho rizes the use o f previously authorized BIRF funding in the total am ount o f $175,000 for Phase I and Phase II de velopm ent activities in accor dance with terms and condi tions agreed to by the BIRF Committee and directs that as provided in the funding terms and conditions any interest and earnings on such fund ing shall be reinvested in the B IR F Fund. (Resolution no. 11,907.) £3 Warrior Society Whereas the Tribal Coun cil is the duly appointed and elected body for the Confed erated Tribes o f the Warm Springs Reservation o f O r egon th at is established to carry out leadership respon sibilities and delegated pow ers as set forth in the Consti tution and By-laws; and, ■Whereas the Tribal Coun cil, on behalf o f the m em bership, wants to express its sincerest T hanks, gratitude and respect to m em bers o f the Tribe, m em bers o f the community and their families for their dedication, willing n ess an d c o m m itm e n t to place their lives, health, safety and family welfare in harm ’s way to faithfully serve and m ake u n to ld sacrifices for our nation by their military service, living or past, state side or abroad, peacetime or war; and, Whereas the veterans o f World Wars I and II did rightly receive' honorable recognition from o u r nation fo r those eras, how ever, K orea, V iet Nam, Iraq, Afghanistan and other recent armed conflicts have Since created several generations o f wounded, lost and forgotten warriors that continue to battle for respect from our nation, more im por tantly, fight for eligibility and access to essential resources, and to secure benefits and services from the established federal, state and other local veteran services agencies and organizations; and, Whereas Veterans within the community engaged in a self-help initiative to restore the VFW, Elliot Palmer Post #4217; establishing the new American Legion, Eugene A. “C ougar” G reene Sr. P ost #48; and are hereby propos ing to estab lish a “W arm Springs W arrior Society” as trib u te to all veterans and honor their respective tours o f duty, irrespective o f their participation in any arm ed conflict or organized veteran service organizations, such organizations tend to be highly regimented and subscribe to very prescriptive and burden some protocols; and, Whereas the Tribal Coun cil enacted Tribal Ordinance 84, (WSTC 702) to facilitate and support the formation o f n o n p ro fit organizations to carry o ut various charitable efforts, on the Reservation, which qualify for treatm ent as a non-profit organization un d er th e In te rn a l R evenue Code and which may accept tax deductible contributions and conduct other charitable, civic and community support functions a n d /o r activities; and, Whereas volunteer veter ans are actively w orked to create a non-profit organiza tion to offer a greater sense o f trad itio n al values, self- help, camaraderie, direct ser vices and carryout charitable efforts and activities for and on b eh alf th e com m unity, families o f veterans, and now seek the benevolent support o f the Tribal Council to be come a legitimate N onprofit C orporation as provided in Tribal Ordinance 84, (WSTC 702), now; therefore, Be it resolved by th e Twenty-Sixth Tribal Council for the Confederated Tribes o f the Warm Springs Reser vation o f O regon in accor dance with Article V Section 1 (d ), (1), (o) and (s), Tribal Ordinance #84 (WSTC 702) and WSTC 105 Article VII do hereby approve the A r ticles o f Incorporation for the Warm Springs Warrior So ciety and grant said organiza tion (corporation) authority for any lawful business or purpose(s) as set forth in the articles o f incorporation, pro vided, said businesses, pur poses and practices are in con cert with the Tribal Ordinance 84 and the Internal Revenue Code. Be it further resolved, the Tribal Council respects the “self-help” initiative be ing asserted by the involved veterans and herby offers its support for seeking public, p riv a te re so u rc e s a n d /o r fund raising activities, as well, to support traditional veteran agencies efforts to integrate their services and resources with this self-help initiative; as an ap p ro v ed T ribal O rd i nance 84 entity representing veteran interests, the Tribal Council supports a belief that all veteran resource and ser vice organizations, including active military organizations and activities be coordinated with and through the Warm Springs Warrior Society. Be it further resolved, the Tribal Council directs and authorizes the Secretary-Trea surer/C E O , tribal staff and others to work cooperatively with the Warm Springs War riors Society to carry out the Tribal Council’s intent in this resolution, including their rea sonable pursuit o f funding, and encourages the Bureau o f Indian Affairs, Indian Health Services, State and Federal Veteran’s Administration and any private/public organiza tions to join in this partner ship o f cooperation and col laboration to serve our vet erans. (Resolution no. 11,914.) Business relationship Whereas tribal staff has re c o m m e n d e d to T rib al Council that the Tribe enter into a business relationship w ith O d le M an ag em en t G ro u p , LLC in o rd e r to jointly prepare and submit a proposal to the U S. D epart m en t o f L abor to operate and manage the Springdale Job Corps Center located at Troutdale, Oregon; arid, Whereas the formal busi ness relationship betw een O dle M anagem ent and the Tribe for purposes o f pre paring and subm itting the proposal to operate and man age the Springdale Job Corps Center is set out in the Team ing Agreement, attached to this Resolution as Exhibit “A”; and, Whereas th e T eam ing Agreement provides for Odle Management and the Tribe to work together to prepare the proposal to U.S. D epartm ent o f Labor with Odle Manage m ent as the “Team Leader” and the T ribe as a “Team Member” with the Tribe sub contracting with Odle Man agem ent to provide safety, security. & transportation, fa cility maintenance and food services if Odle Management is awarded the contract to op e rate th e S p rin g d ale Jo b Corps Center; and, Whereas the Tribal Coun cil-has been advised by Tribal staff that in order to enter into the Teaming Agreement it is necessary for the Tribe to provide a limited waiver o f sovereign im m unity for the limited purpose o f en forcing the Team Agreement, as set out in Section XX of the Teaming Agreement at tached as Exhibit “A” to this resolution; and, Whereas the Tribal Coun cil believes that it is in the best interests o f the Tribe and its members to approve and en ter into the Teaming Agree m ent with Odle Management and to g ra n t th e lim ited waiver of sovereign immunity set out in the Teaming Agree ment; now, therefore, Be it resolved by the Twenty-Sixth Tribal Council o f the Confederated Tribes o f the Warm Springs Reser vation o f O regon, pursuant to Article V, Section 1(f), (1) and (u) o f the Tribal Consti tu tio n an d B y-L aw s, an d W arm Springs Tribal Code S ectio n 30.004, th a t th e T ribal C ouncil hereby ap proves the Teaming Agree m ent attached to this Reso lution as Exhibit “A”; and, Be it further resolved that the Tribal Council hereby ap proves o f the form o f lim ited waiver o f sovereign im munity contained in Section XX o f the Teaming Agree ment attached to this Reso lution as Exhibit “A”; and Be it further resolved that the Secretary-Treasurer/ C E O , o r his d esignee, is hereby authorized to execute and sign the Teaming Agree m ent on behalf o f the Tribe; and, Be it further resolved that upon execution o f the Team ing Agreement containing the limited waiver o f sovereign immunity set out in Section XX, the waiver shall be filed in accordance with the pro visio n s o f W arm S prings Tribal code Section 30.005. (Resolution no. 11,902.) Last chance to see museum exhibit There are still a few days left to see the Celebrating N ative American Youth: Today’s Youth, Tomorrow’s Readers exhibit on display in the Museum at Warm Springs Changing Exhibits Gallery. The exhibit will close after this coming weekend. The museum is proud to announce its next exhibit, Creative Natives, the Twenty-First Annual Warm Springs Tribal Member A rt Exhibit, opening in October.
