(Summaries continue on page 9) Resolution of Tribal Council Euchalon fishery W hereas the Treaty with the Tribes and Bands o f the Middle Oregon on June 25, 1855 reserved to the Confed erated Tribes o f the Warm Springs Reservation o f O r egon, o ff reservation fishing rights, and; Whereas the Tribal Coun cil regulates treaty fishing for conservation and other pur poses pursuant to the Tribal C onstitution and By-Laws and the Warm Springs Tribal Code; and, W hereas the C onfeder ated T ribes o f th e W arm Springs Reservation o f O r egon have historically fished for Pacific eulachon at the Cowlitz and Sandy rivers and other tributary and Columbia River locations in the Colum bia River basin; and, Whereas the Tribal Coun cil has been advised by the Fish and Wildlife Committee and the B ranch o f N atural Resources staff that the pre dicted return o f the Pacific eulachon will require a har vest restriction on the treaty fishery to ensure adequate spawning escapement; and, W hereas the Tribal Coun cil has been advised by the Fish and Wildlife Committee and the Branch o f N atural Resources that the National Marine Fisheries Service des ignated has listed the eulachon as a threatened species, and in N ovem ber 2011, the Co lumbia River and tributaries as critical habitat for Pacific eulachon; and, Whereas the Tribal Coun cil recognizes the hardship placed on trib al m em bers with harvest restrictions, as adopted by Resolutions in the past, but with concern for the future o f the fishery resource, understands the need for a conservative fishery; now, therefore, Be it re so lv e d by th e Twenty-Sixth Tribal Council o f the Confederated Tribes o f the Warm Springs Reser vation o f Oregon pursuant to Article V, section 1(1), (r) and (u) o f the Tribal Constitution an d By-Law s, and W arm Springs Tribal Code Section 340.310(2), th at beginning immediately the following re stric tiv e reg u latio n s are adopted for tribal subsistence fishing for Pacific eulachon at the Sandy and Cowlitz riv ers during 2014: 1. In re c o g n itio n o f the traditional methods, Pa cific eulachon may be har v ested w ith dipnets seven days per week from March 1, 2014 to March 30, 2014 unless the tribal allocation o f 7,500 pounds (approximately 107,100 fish) is reach ed so o n er. F ish in g may take place between 6 a.m. and 6 p.m. daily. The expectation o f the Branch o f N atural Re sources (BNR) is th a t the harvest will be divided ap proximately evenly between the Sandy and Cowlitz rivers, 2. Gear shall be limited to dipnets. 3. T h e p rovisions o f W arm springs Tribal Code 340.310 (8), requiring th at dipnets are attended continu ously, will be enforced. 4. The BNR is respon sible for' the biological moni toring o f the fishery. Pursu ant to Warm Springs Tribal C o d e 340.310(11), trib a l members fishing shall, upon request, allow authorized fed eral, stkte or tribal officers to produce official tribal identi ficatio n and in sp e c t th eir catch. BNR will collect and share h arvest in fo rm atio n and other relevant biological and scientific in fo rm atio n with WDFW-Washington D e partm ent o f Fish and Wild life, and O DFW -Oregon D e partm ent o f Fish and Wild life to contribute to their in form ation gathering objec tives. Periodic reports o f run status and abundance en countered by tribal fishers will be shared with W DFW and O D F W to aid in their monitoring and public infor m ation objectives. 5. ) T rib al m em b ers m ust carry enrollment cards on their person at all times fishing or transporting fish. M em bers m ust pro d u ce it upon request by state or tribal enforcem ent officers. Any person who produces a Warm Springs tribal enrollment card will not be required to pro duce a state fishing license. 6.
