T h e tribe has to w ait even longer to o p en a casino b e cause the reco rd o f decision by the B ureau o f In d ian A f fairs is b e in g challenged in court. A t issue is w h e th er the Cowlitz w ere “u n d er federal ju ris d ic tio n ” in 1934 ev en th o u g h the tribe d id n 't gain federal status until 2000. T h e plaintiffs include lo cal g o v e rn m e n ts a n d lo cal groups. B ut the C onfederated T rib es o f G ra n d R o n d e in O regon, w hose federal recog n ition w as re sto red to C o n gress in 1983, are also fight ing the Cowlitz Casino Resort. “A s th e S u p re m e C o u rt m a d e c le a r in C a r c ie r i v, Salazar, the te rm ‘now under federal jurisdiction’ refers to tribes th a t w eie ‘u n d e r fed eral jurisdiction’ w hen the stat ute was enacted in 1934,” the G ra n d R onde Tribes w rote in a brief, quoting fro m the U.S. S u p rem e C o u rt d e cisio n in Carcieri v. Salazar. “B ut the (Interior) D ep art m e n t has consistendy taken the p osition th at the Cowlitz did n o t even exist as a tribal entity in 1934, and the Sec retary co n ce d ed b elo w th a t the Cowlitz w ere term inated throughout the tw entieth cen tury,” the b rief continued.
