Spiíygy Tymoo, Warm Springs, Oregon April 23, 2 0 0 9 Page 9 Tribal Council Resolutions Budget items Resolution no. 11,053 Whereas the Tribal Council for the Confederated Tribes o f the Warm Springs Reservation o f O regon has reviewed the fi nal revenue and expenditure lev els and financial results o f the Tribes’ 2008 Fiscal Year and has determ ined that a num ber o f capital projects and reserve ac counts were n o t fully expended an d th e rem ain in g balances should be made available for ex penditure in Fiscal Year 2009; and, Whereas the Tribal Council has further determined that sev eral initiatives must have contin ued funding during the 2009 Fis cal Year for which funds have n o t been appropriated in the Tribes’ 2009 approved budget; and, Whereas the Tribal Council has determ ined that the m ost appropriate m ethod by which to make prior year savings available for expenditure in a subsequent fiscal year is by resolution; now, therefore, • Be it resolved by th e Twenty-Fourth Tribal Council o f the Confederated Tribes o f the Warm Springs Reservation o f O regon, pursuant to Article V, Section 1 (f)and(t) o f the T ribal C o n stitu tio n and By- Laws, as amended, that the fol lowing 2008 budget savings be authorized for im m ediate ex p e n d itu re in C alen d ar Year 2009: C arry o v er o f M ulti-Y ear Projects Previously A pproved by Tribal Council Phase II L itigation—A d d t’l E x p e r t & A tto rn e y Fees: $100,000. Total: $9,273,275. now, therefore, Be it resolved, these funds shall be available for expenditure until they are fully expended and until the capital projects, special revenue and program initiatives are co m p leted an d until th e funds in the capital reserve ac counts are expended; and, Be it further resolved the S ecretary -T reasu rer and th e C hief O perations O fficer shall make every reasonable effort to complete the capital projects au thorized and fully funded in as expeditious a manner as possible and shall advise the Tribal Coun cil o f any major problems that may prevent such completion; and, Be it further resolved that the Secretary-Treasurer o f the C o n fed erated T rib es of th e W arm Springs Reservation o f O regon ishereby authorized to proceed with the expenditure o f fu n d s fo r th e p u rp o ses and amounts indicated in this reso lu tio n , p o ss ib ly su b je c t to change for audit adjustments. Grant for families Resolution no. 11,056 Whereas the Tribal Council is the duly elected governing b o d y fo r th e C o n fe d e ra te d T ribes o f th e W arm Springs R e se rv a tio n of O re g o n (CTWSRO) and operates under the authority o f the Constitu tion and By-laws o f CTWSRO, approved February 14,1938, to protect and prom ote the general welfare o f its members; and, Whereas Tribal Council and the Elders have recognized that the m ost valuable resource o f the CTWSRO is its children, our children’s grandchildren, and our families; and, Whereas Tribal Council un derstands that there are many factors that contribute to fam ily and domestic violence, the neglect, abuse, and endanger m ent o f tribal children, includ ing, but n ot limited to, gang vio lence, the use and abuse o f al cohol, m etham phetam ine and other illegal drugs by the parents and guardians o f the children; and, Whereas Tribal Council con siders that quick response to the needs o f the victims o f family violence cases on the reserva tion, providing services to vic tims o f family violence and the prevention o f family violence on the reservation to be o f high importance; and, Whereas our tribal families will benefit from maintaining, continuing, and improving the efficiency o f the tribal Victims o f Crimes Services (VOCS) de partm ent and o ther tribal de partm ents working "with family violence prevention, crime vic tim services,' investigation and prosecution; and, ’ Whereas, as per the Federal Register, Vol. 74, No. 53, po tential g ran t fu n d s over two years are available from the U. S. D epartm ent o f H ealth and H um an Services (HHS), A d m inistration for Children and Fam ilies th ro u g h the Family Violence Prevention and Ser vices A ct(FV PSA) to N ative A m erican T rib es (including A laska N ative V illages) and Tribal Organizations G rant Pro gram (FVPSA) for the m ainte nance and expansion o f the ex isting tribal VOCS departm ent to assist the needs o f family vio lence victims on the reservation, provide related services, and work toward the prevention o f such family violence; now, there fore, Be it resolved by th e Twenty-Fourth Tribal Council o f the Confederated Tribes o f the Warm Springs Reservation o f O regon, pursuant to Article V, Section 1 (d), (1) and (p) o f the Tribal C onstitution and By- Laws, that the Secretary-Trea surer is authorized to apply for the FY09 FVPSA G rant to N a tive American Tribes from the HHS, Administration for Chil d re n , Y o u th a n d F am ilies (ACYF), Family and Youth Ser vice Bureau (FYSB) and to ad minister the grant programs and activities fu n d ed u n d e r th e FVPSA grant; and, Be it further resolved that the Secretary-Treasurer is autho rized to negotiate and execute any application or award docu m ents in connection herewith the FVPSA grant, including any m odifications th e re to as r e quired. Settlement Resolution no. 10,997 ■ Whereas the- Confederated T rib e s 'o f th e Warm Springs R eservation o f O reg o n (the “T rib e ”) has e n te re d in to a Setdem ent Agreement with the U n ite d S tates G o v e rn m e n t (“United States”) to settle a law suit against the U nited States in the United States C ourt o f Fed eral Claims, Case No. 02-126L, for money damages for breach o f trust duty in managing the Tribe’s m onetary and non-m on- etary trust assets; and, Whereas Tribal Council has been advised that paym ent o f funds from the U nited States Judgm ent F und to satisfy the Settlement Agreem ent between the Tribe and the United States must be distributed pursuant to th e In d ia n T rib al Ju d g m e n t Funds Use or D istribution A ct (25 U.S.C. §1401 et. seq.).(the “A ct”); and, Whereas Section 1403(a)(1) o f the A ct requires th a t the Tribal Council develop and sub m it to the Secretary o f Interior a “Use and D istribution Plan” providing fo r the disposition o f the settlem ent funds; and, Whereas the Tribal Council has reviewed and approves o f the Tribal Use and D istribution Plan attached to this Resolution and marked Exhibit “A”; which provides th a t the settlem ent funds shall be available for ex penditure by the tribal govern ing body in accord with and pur suant to the Settlement Agree m ent approved by Tribal C oun cil; now, therefore, Be it resolved by th e (Twenty-Fourth) Tribal Council o f the Confederated Tribes o f the Warm Springs Reservation o f O regon, pursuant to Article V, Section 1(a), (f), (1), and (u) o f the C o n stitu tio n and By- Laws, that the Tribal D istribu tion Plan (attached to this Reso lution as Exhibit “A”) is hereby adopted and subm itted to the Secretary o f Interior for pur poses o f satisfying the require m ents o f 25 U.S.'C. § 1403(a)(1) and distributing to the Tribe the setdement funds pursuant to the Settlem ent A greem ent in the above-entided matters.
