On Resolution 9257, (dated August 27, 1996) 1 62 individuals were placed on ballot for a vote as to their adoption at an election held and called by the Secretary of the Interior on October 15, 1996; and. WHEREAS, Of the 1.877 eligible voters, 1,100 members voted at such election, with 30 mutilated and not counted, which is more than fifty per cent of those members entitled to vote in such election and 1 39 individuals of the 1 62 recc i ved a majori ty vote for adopt ion ; now, therefore BE IT RESOLVED, By the Tribal Council of the Confederated Tribes of the Warm Springs Reservation of Or egon, pursuant to Article III, Section 3 of the Constitution and By-Laws, that the following individuals be and arc hereby enrolled as members of the Con federated Tribes of the Warm Springs Reservation effective this date. The Tribal Council is the governing body of the Confederated Tribes of the Warm Springs Reservation of Oregon; and WHEREAS, The Tribal Council, pursuant to Article V, Section 1 (1) of the Constitution, is responsible to protect the health, security and general welfare of the members of the Confederated Tribes; and WHEREAS. The Tribal Council it concerned with the quality of services provided by the Indian Health Service at the Health and Wellness Center; and, WHEREAS, The Indian Health Ser vice it in the process of selecting nurses for the Wellness Center; and, WHEREAS, Indian Preference can didates who were most desirable for the positions have chosen to relocate to other Indian Health Service locations; and, WHEREAS, Qualified non-Indian candidates are available within the local communities who are familiar with the Warm Springs community and are inter ested in employment; now, therefore BE IT RESOLVED, By the Tribal Council, pursuant to Article V, Section (a), (d) and (r) of the Constitution, that the Indian Health Service is hereby re quested to waive Indian preference in the hiring of nursing candidates to fill currently available positions at the Warm Springs Health and Wellness Center in favor of more available and qualified local non-Indian applicants. This reso lution will expire when the positions arc filled and will not exceed 90 days from this date. Hyde for Gordon Cannon, Superintendent Resolution 9270 Purchasing Policies and Guidelines WHEREAS, The Tribal Council of the Confederated Tribes of the Warm Springs Reservation of Oregon deems it appropriate to adopt by Resolution the Purchasing General Policies and Guide lines for the purpose of identifying, de fining and clarifying the authorities, re sponsibilities, relationships and roles of the various officials and units within the Tribal Organization to procure goods and services for Tribal purposes. The plans purposes include the establishment of standards and policies which ensure fairness and professional action in ac quiring the goods and services needed by the Tribe to meet its goals; and, WHEREAS, The Tribal Council rec ognized its responsibility to meet the requirements of the Tribal Constitution to serve the Tribe well and the need to lead to reasonable conservation of re sources while maximizing their use, and to do so within Tribal Law, ordinances, customs and established management plans. These commitments include as surances that all resources entrusted to the Tribal Council are well managed, effectively conserved and carefully uti lized; now, therefore BE IT RESOLVED, The Constitu tion and By-Laws of the Confederated Tribes of the Warm Springs Reservation of Oregon at Article V, section 1 (0. (1). and (t) of the constitution authorizes and holds the Tribal Council responsible to manage the various resources held by the Tribe; therefore the (attached) Pur chasing General Policies and guidelines of the Confederated Tribes of the Warm Springs Reservation of Oregon be hereby approved and adopted. These authorities include the appro priation and expenditure of funds con trolled by the Tribes. The Tribe's Coun cil exercises these authorities through the parameters and uniform procedures authorized by "Warm Springs Tribal Appropriations Ordinance" Warm Springs Tribal Ordinance No. 67, as amended, dated May 20, 1986. The Tribal Council adopted, by Warm Springs Tribal Resolution No. 9070 on May 8, 1995 the "Management Plan of the Confederated Tribes of the Warm Springs Reservation of Oregon." This plan identifies the basic operational del egations adopted and implemented by the Council to manage Tribal govern ment affairs; and, BE IT FURTHER RESOLVED, That OMB Circular A-87, "Cost Principles for State, Local and Indian Tribal Gov ernment", OMB Circular A-102 "Uni form Administration of Grant and Coop erative Agreements with State and Local Governments", the related "Common Rule" insofar as it relates to Procure ment and the Tribal Administrative Rules will be adopted by Reference as a part of the General Policies and Guidelines. Can-,' non, Superintendent Resolution 9267 Disaster Response Services and Funding WHEREAS, The Confederated Tribes of the Warm Springs Reservation of Oregon and its membership acknowl edge the ongoing contribution that ag ricultural endeavors have made to en hance tribal traditions, stable family values, community interdependency and economic self sufficiency; and, WHEREAS.The Tribal Council with and through the US Government have enacted laws, rules, management sys tems and agreements for the protection and wise multiple use of the Tribe's natural assets secured by the Treaty of 1855 administered under the principles of sovereignty and trust accountability, and integrated management; and, WHEREAS, The Reservation has experienced a series of traumatic wild fires that now require restoration of the ecological and economic viability of Tribal lands that support grazing dis tricts' important watersheds; Wildlife management units, sensitive cultural plan areas and many other important tribal vslucs find WHEREAS, The Tribal Council en dorses the need to provide temporary disaster relief and the liberal interpreta tion of applicable policies under emer gency circumstances to implement criti cal remedies necessary to address emergent needs to the membership; now, therefore BE IT RESOLVED, By the Confed erated Tribes of the Warm Springs Res ervation of Oregon pursuant to the Constitution and By-Laws Article V, Section 1 (a), (d), (f). (k) and (1) hereby authorizes the Chairman to execute such transactions necessary to secure and implementdisastcr response services and funding necessary for immediate, in terim and longer term disaster remediation actions to protect and restore impacted tribal natural resource values that include those referenced in Resolu- . tion No. 9258; and, BE IT FURTHER RESOLVED, That the Tribal Council, pursuant to the Con stitution and By-Laws Article V Section (t) hereby authorizes and directs the fol lowing: The establishment of a $25,000 emergency range resource restoration account for immediate use and continue for a period to expire December 1997; an initial appropriation to be made from the Forest Land Assistance Account, and that the range restoration account may be replenished from available funds that may exist within Natural Resources Branch. Cannon, Superintendent Resolution 9260 Road Repair and Reconstruction WHEREAS, The Bureau of Indian Affairs and the Tribal Council of the ConfedcratedTribcsof the Warm Springs Reservation of Oregon recognize the need for maintenance and repair of the Tribal roads system and that the damage caused by the 1996 Floods will also require extensive road repair and bridge rehabilitation construction; and, WHEREAS.These roads and bridges have been designated as part of the Bu reau of Indian Affairs roads inventory and the Bureau has identified three fed eral funding sources for construction, maintenance and repair through: 1) Inlermodcl Surface Transportation Act; 2) BIA Maintenance funds; and 3) Emergency Relief for Federally Owned Roads under the Federal Highways Ad ministration; and. WHEREAS. The Bureau and the Tribal Construction Department estimate thaY the cost to' design, construct and produce material for these projects is approximately $1,200,000 with actual cost proposals to be negotiated for the purpose of entering into contracts be tween the BIA and the Tribal Construc tion Department and Tribal Crushing; and, WHEREAS, The Tribal Construc tion Department and Tribal Crushing the Confederated Tribes of Warm Springs Reservation of Oregon with increased economic benefits from construction projects on and near the Reservation; and, WHEREAS, The projects can best be expedited and accomplished by the Con federated Tribes of Warm Springs Res ervation of Oregon, by and through its Construction Department and Tribal Crushing Enterprise, acting under Pub-1 lie Law 93-638 contract with the BIA and by utilizing materials located on the Reservation and in close proximity to the projects; now, therefore BE IT RESOLVED, By the 20th Tribal Council of the Confederated Tribes of the Warm Springs Reservation of Oregon, pursuant to Article V, Sec tion (a) and (d) of the Tribal Constitution and By-Laws, that the Confederated Tribes of Warm Springs Reservation of Oregon request a contract under authority of PL 93-638, to accomplish construc tion of the following projects at Warm Springs: Repair and reconstruct roads and stream crossings located on Forestry roads within the BIA inventory and other flood related bridge and roads projects, produce graded aggregate materials for construction and maintenance, WSIR 933 Chip Seal, M-936 pavement mark ings; and, BE IT FURTHER RESOLVED, That the Tribal Council of the Confederated Tribes of Warm Springs requests that the Bureau of Indian Affairs waive the provisionsof25CFR271.2(d)and 271.2 (a) (5) for the purpose of this contract; and, BE IT FURTHER RESOLVED, That the Secretary-Treasurer of the Confed erated Tribes of Warm Springs Reserva tion of Oregon or his authorized desig nee is hereby authorized to make appli cation for, negotiate and execute said contract and any amendments thereto, on behalf of the Tribe; and, BEITFURTHER RESOLVED, That this authorization shall remain in full force and effect until otherwise amended or rescinded by Tribal Council action. Raymond Calica, Sr., Secretary Treasurer Approved September 17, 1996 by Gordon E. Cannon, Superintendent Resolution 9259 Kah-Nec-Ti Village Budget Modifi cation WHEREAS. The February 1996 Warm Springs flood resulted in the need to rebuild Kah-Nce-Ta Village includ ing enlargement of the dike to improve protection of the village; and, WHEREAS. The US Department of Agriculture's Natural Resources Con servation Services (NRCS) has offered grant to pay i portion of the cost for rebuilding the dike and restoring the north river bank; and, WHEREAS, The total estimate cost which NRCS will participate in restor ing is $475,750; and, WHEREAS, TheTribes' share of the restoration costs totals $118,938; now, therefore BE IT RESOLVED. By The Tribal Council of the Confederated Tribes of the Warm Springs Reservation of Or egon, pursuant to Article V, Section 1 (d) and (t) of the Constitution, and to Article IV, Section (6) of Budget Ordi nance No. 67, that the 1996 Tribal Bud get is hereby modified to provide $118,938 for the Tribes' share of the Kah-Nce-Ta Village dike and bank res toration, and that the Secretary-Treasurer is authorized to sign and administer the cooperative agreement with the Natural Resources Conservation Service for the project. CERTIFICATION The undersigned as Secretary -Treasurer of the Confederated Tribes of the Warm Springs Reservation of Oregon, hereby certifies that the Tribal Council is composed of 1 1 members, of whom 8 constituting a quorum were present at a meeting thereof, duly and regularly called, noticed, and convened and held this 6th day of September, 1996, and that the foregoing resolution was passed by the affirmative vote of 7 members, the chairman not voting, and that the said resolution has not be rescinded or amended in any way. Cannon, Superintendent Resolution 9258 Emergency Assistance for Livestock Owners WHEREAS, Evans Spino, Sr., the Chairman of the Range, Irrigation and Agriculture Committee has met with the Tribal Council on August 21, 1996 to seek their direction for providing emer gency assistance to the livestock owners of the Mutton Mountain, Dry Creek Miller Flat, and the Simnasho grazing districts due to the destruction of a por tion of their range lands by the Simnasho Fire; and, WHEREAS, It has been determined that the livelihood and welfare of the owners and livestock is at risk and that this project be given the highest priority for emergency response to provide as sistance; and, WHEREAS, There exists certain grazing lands in the McQuinn Strip that can be utilized for the livestock owners benefit if it were fenced. That the Big Meadows, Mangum, Mt. Fir, Abbot, Griffith properties, OSU 4-H Pasture, and selected property fence-lines in the Foreman Point area could be constructed or rebuilt to respond to these needs; and, WHEREAS, There has been consid erable work already completed for the areas as far as the fence-line placement, forage availability, and road access by the BIA forestry, Timber Committee, grazing district ride bosses, and the Range, Irrigation and Agriculture Com mittee; and now, therefore, BE IT RESOLVED, That the COO and the Natural Resources General Manager be directed to be responsible for and implementation of these fencing projects. That they locate the necessary funding and personnel to accomplish these projects. The fencing projects need is immediate and should be started by September 9, 1996; and, now therefore, BE IT FURTHER R ESOLVED, That the Chairman or Vice-Chairman and Secretary-Treasurer are hereby autho rized to execute the necessary documents for and on behalf of the Confederated Tribes. CERTIFICATION The undersigned, as Secretary-Treasurer of the Confederated Tribes of the Warm Springs Reservation of Oregon, hereby certifies that the 20th Tribal Council is composed of 1 1 members, of whom 7, constituting a quorum, were present at a meeting thereof, duly and regularly called, noticed, convened and held this 28th day of August, 1996; and that the foregoing resolution was passed by the affirmative vote of 6 members, the Chairman not voting; and that said resolution has not been rescinded or amended in any way. Raymond Calica, Sr., Secretary Treasurer Gordon Cannon, Superintendent Resolution 9283 Kah-Nee-Ta Supplemental Budget WHEREAS, The Flood of the winter of 1996 caused severe damage to Kah-Nec-Ta Resort with estimated restora tion costs of approximately $4,500,000 beyond insurance proceeds and other non-tribal sources; and, WHEREAS, In addition to the eco nomic loss due to physical damage, the village area of Kah-Nee-Ta has been totally closed from the time of the flood and cannot be restored until approxi mately January 1998 resulting insignifi cant loss of business to the Resort and to Indian Head Gaming Center, which threatens the economic stability of these tribal enterprises; and, WHEREAS, Kah-Nee-Ta Resort is in need of maintenance and capital im provements due to wear and tear in order to maintain the stature and competitive position of the Resort; and, VHEREAS, The Tribal Council has the authority pursuant to Article V. Sec tion 1 (t) of the Constitution and By Laws, as amended, and Warm Springs Tribal Appropriation Ordinance No. 67, Article V. to propose supplemental bud gets; and, WHEREAS, The Tribal Council considers this situation to be an eco nomic emergency which threatens the long-term financial stability of tribal enterprises and the Tribes and that it is appropriate to propose a Supplemental Budget of funds from available tribal funds for Kah-Nee-Ta Village Restora tion not to exceed $3,017,6 1 4, Kah-Nee-Ta Capital Improvements not to exceed $1,543,500 and Kah-Nee-Ta Working Capital not to exceed $315,255 in the total amount of $4,876,390; now, there fore BE IT RESOLVED, By the 20th Tribal Council of the Confederated Tribes of the Warm Springs Reservation of Oregon pursuant to Article V. Section ! (t) of the Constitution and By-Laws, as amended and Ordinance 67, Article V. that there is hereby appropriated from available tribal funds the sum of $4,876,369 for purpose of Kah-Nce-Ta Village restoration, Kah-Nee-Ta capital improvements and Kah-Nce-Ta work ing capital; and, BEITFURTHER RESOLVED, That a copy of this proposed supplemental budget shall be immediately posted in public places on the Reservation, and public hearing shall be 90 days after the date of the initial posting of the copy of the Supplemental Budget; and, BEITFURTHER RESOLVED, Kah-Nee-Ta Resort shall submit monthly a written report to the Tribal Council and the Finance Department of the Expendi ture of such funds, together with budget estimates of future expenditures and that expenditures of funds pursuant to this Supplemental Budget shall be subject to the approval of Secretary-Treasurer and money will be transferred to Kah-Nee-Ta monthly; and, BEJTFURTHERR ESOLVED, That the fund appropriated by the Supple mental Budget shall remain available for expenditures until expended. Raymond Calica, Sr., Secretary Treasurer Karmen Blake for Gordon Cannon, Superintendent Resolution 9284 EDA Grant for Kah-Nee-Ta Redevelopment WHEREAS.The February 1996 flood of the Warm Springs River devastated most of Kah-Nee-Ta Village which is a critical part of the Tribes' tourism indus try; and, WHEREAS, Flood damages resulted in the need to rebuild the village, includ ing most infrastructure and the reloca tion of guest rooms and the restaurant; and, WHEREAS, The Economic Devel opment Administration (EDA), a agency within the federal Department of Com merce, has invited the Confederated Tribes of Warm Springs to apply for a Title IX Sudden and Severe Economic Dislocation (SSED) Implementation Grant to assist with the redevelopment of Kah-Nee-Ta Village; and, WHEREAS, The EDA grant, if ap proved would provide $514,500 in sup port of needed infrastructure and site improvements such as irrigation, storm drainage, paving, landscaping, fill, lighting, electrical and decking; with an additional $171,500 local matching share required for a total project cost or $686,000; now, therefore, BE IT RESOLVED, By the Tribal Council of the Confederated Tribes of Warm Springs Reservation of Oregon, pursuant to Article V. Section 1 (a), (d), (f). and (1) of the Constitution and By Laws, that the Secretary-Treasurer is authorized to apply for, and administer, an EDA Title IX SSED grant in the amount of $514,500 for Kah-Nee-Ta Village infrastructure and site improve ments.
