I w ould have participated in the recent .election regarding T rib al C ouncil’s wage increase, how ever, I was unaw are o f a voter’s registration deadline and I registered to late. N othing was said ab o u t a voter registration list. A nd, it w asn’t noted in the le tte r , m ailed to us w ith , the V oter R egistration F o rm o r the Spilyay Tym oo. In th e A pril 26 issue o f the Spilyay T ym oo there was little said a b o u t the T ribal Council P ay Increase R eferendum . The only issue m entioned was the hardships felt by T ribal Council M em bers to ^ ljy dejjende^t^pn T ribal Council pay. I would like to see some guide lines, and goals and objectives set by T rib al Council to better justify this proposed pay in crease. I w ould like to know if T ribal Council intends to im- p rp v e ‘c o m m u n ic a tio n s w ith T ribal M em bers such as m ore G eneral Council Meetings. T h at right of the Indians was spelled out by Federal Judge George B oldt in 1974 in a landm ark decision upheld in 1979 by the Suprem e C ourt. G o rto n , introducing the bill, stated th a t it “carries out the m andate of the citizens of W ashington as expressed in their approval of W ashington Initiative 456” on election day in 1984. The B oldt decision said th a t treaty tribes had a right to harvest for com m ercial or personal use half of the salm on and steelhead resoúrces in the W ashington fisheries. The bill S. 954 w ould put “all,fisherm en in the state on an equal footing, m aking state law s and regulations governing the harvest, tran sp o rtatio n and sale of steelhead apply to treaty Indian fisherm en, ju st as they do to everyone else.” Swift, in his in troduction of the H o u se bill, said he did not believe it constituted any abrogation of Indian treaties since, “it specifically provides a means for the U.S. Claims C ourt to cori- sider w hether the legislation results in a taking o f Indian treaty rights, and authorizes com pensation if there is a taking,” Swift adm itted th a t the bill “has dim prospects in this C ongress.” He co-sponsored sim ilar legislation th at did not pass iri the 97th Congress. SUPREM E COURT H EA RS ARGUM ENTS ABOUT AUTHO RITY OF TRIBAL COURTS: The U nited States Suprem e C ourt heard argum ents A pril 16 in a case th a t could determ ine the authority of irid ian tribal courts over non-Indians in certain kinds of civil cases. A M ontana school district is contesting the tribal c o u rt’s au th o rity in a case involving a-Crow Indian student who was injured on the school grounds on the reservation. The stu d en t’s guardian sued the school district in the Crow tribal court. School district officials did not respond to the suit and eventually were ordered to pay a $ 153,000 default judgem ent to the injured student. The school district' then sued iri federal court to have the tribal court judgement voided. Their attorneys contend the tribal court the school grounds Qn the reservation. ThS) stu dents guardian sued the school district in the C row trib al court. S chool district officials did not respond to the suit and eventually were order to pay a $153,000 default judgem ent to the injured student. The school district then sued in federal court to have the tribal court judgem ent voided. The tribal court lack the au thority to preside over such a spit against a non-Indian. Nine other states with large Indian populations have joined with M ontana in the suit. They are A rizona, M innesota, N orth C arol4 ina, N orth D akota, O klahom a, S outh D akota, W ashington, Wis consin and W yoming. The possible rulings of the Suprem e C ourt in this case would have varying im pact on the tribal courts. It could ruló 1) th at the tribal court has jurisdiction in such crises— w ith no right of review in the federal courts; 2) th a t the tribal courts does have jurisdiction, subject, however, to review in the federal courts after tribal court processes have been exhausted; or 3) th at the tribal court does not have any jurisdiction over non-Indians in such civil to rt cases. S U P R E M E C O U R T R U L E S O N IN H E R IT A N C E OF RESERVATION LANDS: The U .S. Suprem e C o u rt upheld a 9th U.S. C ircuit C ourt o f A ppeals ruling which perm its a Q uileute Indian to inherit land on the Q uinault Indian R eservation. The decision perm its Leo Willi-» am s, a Q uileute Indian, to inherit land from his cousin, Joseph Wilesi, who owned land on the Q uinault R eservation. P rio r to this rulirig the B ureau o f Indian A ffairs and the In terio r Board of Indian A ppeals had ruled th a t the Indian R eorganization Act precluded Leo W illiams from ow ning land on the reservation, which is controlled by the Q uinault Tribe.
