For the purpose o f this tax, "person" means any individual, receiver, assignee. Trustee in bankruptcy, trust, estate, firm , co* partnership, joint venture, d u b , company, joint stock company, business trust, corporation, association, society or any group o f individuals acting as a unit, whether mutual, cooperative, fraternal, non-profit or otherwise. The term applies only to non-members o f the Confederated Tribes o f the Warm Springs Reservation of Oregon. The term does not indude the Confederated Tribes, the United States, and their employees and agents while engaged in their official duties." A hearing w ill be conducted at the Warm Springs Community Center, W arm Springs, Oregon, on October 5 ,1 9 8 3 a t 1 0 :0 0 a.m. at which interested persons shall be entitled to present testimony. Persons intending t o submit oral testimony a t th e hearing should provide to th e Tribal T ax Commission not later than September 1 9 ,1 9 8 3 the following information: 1. SM ITH V IS IT S CHOCTAW A N D CHEROKEE RESERVATIONS; PRAISES TRIBAL GOVERNMENTS: After a day-long tour of the Mississippi Choctaw reservation, Interior Assistant Secretary Ken Smith told the tribal council that he was impressed with the tribe’s economic development achievements. “Y6u have few natural resources,” Smith said, “but you have taken your greatest resource—your people—and built a thriving land that provides jobs for your people.” Smith, accompanied by the BIA’s eastern area director, Harry Rainbolt, visited the Chata Development Company, a tribal construction firm; a wire harness manufacturing plant which has contracts with General Motors and just recently doubled its capacity; and an American Greetings Card plant, the latest private sector, joint-venture involvement of the tribe. Together, the three firms employ more than 500 people, most of them Choctaw Indians. Smith also spent a day on the Eastern Cherokee reservation in North Carolina. There he examined the school, visited the Cherokee Boys Club which operates a variety of business ventures and saw the many tourism developments on the reservation. Smith told the tribal council there that their reservation illustrated what can be done when a strong, stable tribal government works together for the good of the people. The guy called, “John, what’s the big hand on?” After a short pause, John answered, “Please dad, do you really have to know.” YIKES PRESIDENT SIGNS SUPPLEMENTAL APPROPRIATION BILL; INCLUDES $53 MILLION FOR BIA: The 1983 supplemental appropriation bill signed by President Reagan recently this week includes $53,150,000 for the Bureau of Indian Affairs. The act provides $14 million for fire suppression; $6 million for contract support indirect costs; $1,650,000 for litigation support and $150,000 for attorney fees in water rights cases; $9,350,000 to upgrade BIA village schools transferred to the Alaska state school system; and $22 million to upgrade or replace the Mount Edgecumbe School, Sitka, Alaska. The Mount Edgecumbe $22 million will be provided to the state only if it agrees to assume operation of the school facility. The BIA closed up the schbol on June 30, 1983. The money to be provided to Alaska for the village schools is to be used only for rehabilitation or reconstruction of the schools— not for basic operation and maintenance. The act also provided that the BIA could transfer other funds to contract support during the fourth quarter of the year, if those funds to contract support during the fourth quarter of the year, if those funds are not required for the purpose for which the original appropriation was made. econom ic im pact of the proposed tax to the Tribal Tax Commission. Any changes must ultimately be approved August, 1983 by the majority vote of the Indian tribes and Alaska Native villages. Zane Jackson The committee appointed, consists of William Demmert, a C h a irm a n , T rib al Tax former director of the BIA’s education programs now with the Commission Confederated University of Alaska; Jon Wade, president of the Institute of Tribes of the Warm Springs American Indian Arts; Terry Walters, education specialist at the Reservation of Oregon BIA’s Winnebago agency in Nebraska; William Leap, an education specialist with the National Congress of American Indians; and Myron Jones, a consultant from Albuquerque. New Mexico. The committee will review the present formula, develop alternate options and publish them in the Federal Register for review and comment. After considering the comments received, the committee will publish a selection of formulas for vote by the tribes and villages. If one formula would not receive a majority of the votes, a runoff election would be held. Each tribe and each Alaska Native village has one vote, regardless of population, under the existing law No change m formula would take effect prior to the 1984-85 school year.
