Page 8 Section 2 THE CAPITAL JOURNAL Salem, Oregon, Wednesday, April 10, 1957 Court Ruling Likely to Block All Oil Drilling by Railroads WASHINGTON W In a rul Ing that may have wide-ranging implications, the U.S. Supreme Court Monday ruled 5-3 that the Union Pacific Railroad cannot drill for oil and gas on a 1,083 milc right-of-way granted it by Congress on July 1, 1862. While the decision specifically applies to the Union Pacific, gov ernment legal experts informally interpret it as broad enough to apply to similar right-of-way grants to other Western railroads between 1862 and 1871. The grant to the Union Pacific extended "200 feet in width on each side of the railroad where it may pass over public lands." It also included "necessary grounds for stations, buildings, workshops and depots, machine Japan Halls Plan For Protest Ships TOKYO The Japan Coun cil Against Atomic and Hydrogen Bombs Tuesday postponed plans to send two ships .to the Central Pacific to protest Britain's H bomb tests at Christmas Island. AWOL for seven years, will be transferred Thursday to Ft. Benjamin Harri son, near Indianapolis, for further action on his case. Hunt, who said he had lived at Roscburg, Ore., the last four years, surrendered to the FBI in Charlotte, Mich., last Friday "to get this mess straightened out. Hunt, who said he had been in the Army 18 years, including serv ice in both World Wars, left his post at Ft. Lewis on Nov. 15, 1950. He had re-enlisted as a private in 1948. He said he went AWOL because tho Army had not done anything about' his ulcers and a stomach condition. Hunt said he worked as a bar ber,, in a sawmill "and anything I could get" at Itoseburg. Ho went to Charlotte three weeks ago, he said, because his father-in-law was ill. Mitchell Damage Suits Go to Trial FOSSIL, Ore. I Mitchell resi dents are making their second at tempt to collect $290,000 damages from the state because of a cloud burst and flash flood last July. An earlier court hearing ended in a mistrial. A jury was selected Monday to hear the first of nine suits. It was brought by Mrs. Lena Sigfrit. The Mitchell residents contend the cloudburst was channeled inlo Mitchell stores and houses by con struction of a state highway. grants for right-of-way and which might be affected by the decision include the Atchison, Topeka and Santa Fe, the Northern Pacific, the Milwaukee, the Burlington and the Southern Pacific. In addition to grants for rieht- of-way, the Union Pacific and some other Western railroads also received other land grants, but these were not involved in the de cision. The Union Pacific, for instance, received every alternate section of public land on each side of the road. All mineral lands . were except ed. Machinery was provided, how ever, 'for the Interior Department to determine whether the alter nate sections were "mineral lands." Many years ago the de partment, in releasing the lands outright to the railroads, held they were not "mineral lands." Ex perls on the subject say this re linquished any government claim to mineral rights.
