Paffe 51 Section b LEGAL OPINION PUZZLES TomMonaghaii May Face Choice Of Legislator or Schoolmaster By. GORMAN HOOAN Associated Press Writer The time may be coming when Tom Monaghan of Milwaukie will have to 'choose between being a member of the state House of Ho presenlatives and a schoolmaster. He's hoping the choice won't be necessary. Rut right now on the basis of an opinion by the attorney general it's unconstitutional for him to be a teacher and a state legislator at tho same time. Monaghan, a strapping black haired 6th grade teacher now on leave of absence, considers the ruling downright discrimination and says he's puzzled by it all. When the legislative session is ended and he gets ready to return to the school room he may have to pick between his profession and the Legislature. May Have to Pick "I'm hoping my school board will go along with me and ignore the attorney general's ruling until we can get a court decision, if that's necessary," he explains. But this will take time, requiring a vote of the people at tho next general election nearly two years from now. Killing Cited What puzzled Monaghan is jhe fact that Atty. Gen. Robert Y. Thornton issued a ruling in 1054 saying there was nothing in the constitution to forbid a teacher from being a candidate for the Legislature. But two years later, Monaghan says, Thornton handed down his ruling that it is uncon stitutional for a teacher to serve in the lawmaking body. "In other words," Monaghan points out, "It's all right for a teacher to run, but if he gets elected he can't take his seat and keep on being a teacher." The attorney general's latest ruling came after Monaghan asked his school board to pay him the difference between his salary and that paid to his substitute while he is on leave. Before agreeing to do this. though, the board decided to get a rilling from Thornton, The decision, according to the Milwaukie teacher, held that teacher couldn't hold positions in more than one branch of the state government at one time. Besides legislative, the branches of gov ernment are executive and judi ciary, and Monaghan can't figure out how, as a teacher, he quali fies under either of these. "I'm hired by school district No. 1 at Milwaukie under contract and don't consider myself a state em ploye," he says. "Under this de cision a school janitor couldn't legally sit in the Legislature and neither could a school bus driver." Quotes Decision What's more, Monaghan quotes from the Oregon Law review, cit ing a stale .Supreme Court deci sion which held specifically that a school teacher is not a public officer, whilo a fireman, for ex ample, is. "Yet a fireman is serving in the present Legislature without chal lenge," he says. (Hep. William A. Grenfcll, Jr. is a Portland fire man1. In fact, two teachers have served in the Legislature pre viously and their status wasn't questioned, cither. Monaghan says he understands one from Portland continued to receive his salary while he served in the Legisla ture and the other from Marion County was able to handle his school duties along with his legis lative service. As a representative of ' the slate's more than 20,000 teachers 1 Monaghan feels he's better quali fied to answer questions about educational matters than almost any other legislator. The father of four sons, Monag han has taught the sixth grade at Milwaukie for seven years. While getting his degree at the Univer sity of Portland he was a prac tice teacher at Milwaukie. He got along so well he was offered job. Active Dcmocrnl But his college studies interest ed him in politics too, and he be came a Clackamas County Dem ocratic committeeman and alter nate chairman of the Democratic Central Committee. He ran un successfully in 1952 for county clerk. A booklet put out by the Oregon Education Assn. culled "Belter Government Begins With You" partly influenced him lo run for the Legislature. The booklet urges touchers to take a more active part in government.
