ALBANY Wito all necessary participants in their places, the defendant, jury and cSurt, the case H the State ot Oregon vs. Ernest L. Gibson was abruptly halted in circufl court Monday morning. Gibson, ont of tht two men accus of complicity in the Slug ging and rottbiag ot County Treasurer Raymond Toralinson January 17, 1956, had had a dis agreement with, his attorney and discharged him, the attorney, Sylvan J. Fritts, Lebanon, told Judge Victor Oltiver, presiding. Accordingly Judge Olliver dis missed the jury and told Gibson he would appoint another attor ney for him before re-scheduling the case. 'I expect you to follow the advice of your attorney," Judge Olliver told Gibson. Fritts did not indicate to the court Monday the nature of the disagreement between himself and his client. Gibson and his co-defendant, ! Harvey Roberts, also known as Roberta Lee Roberts, are both under indictments charging as sault and robbery while armed. They are accused of jointly loot ing the treasurer's office of a total of $8001 of which less than $2000 has been recovered. Rob erts case remains to be docketed. Gibson was brought to Albany Sunday from the Lane county jail in Eugene, where he has been in custody on a local charge since his arrest soon after the court house robbery. KLEENEX Salem Students Get Assignments To ROTC Units Lt. Col. R. D. Evens, Army ROTC professor of military science and tactics at University of Ore gon has announced assignments for graduating military science seniors. Those assigned from Salem in clude Gary D. Peterson, Robert P. Robinson, and Jerry D. Hamilton. Peterson has been assigned to the armor and will be commissioned six months as will Robinson who as a second lieutenant, serving lot lias been assigned to the infantry. Hamilton has been assigned to the artillery and will serve for two years of active duty. Jury Dismissed as Albany Defendant Fires His Counsel ALBANY. Ore. tfl The defend ant fired his attorney just befort the trial was to get started Mon day and as a result Judge Victor Olliver dismissed the jury that was to have heard the state's case against Ernest L. Gibson. Gibson is one of two men charsed with assaulting and rob bing County Treasurer Raymond Tomlinson Jan. 17. Judge Olliver told Gibson he would appoint another attorney for him, then reschedule the case. Charged with Gibson in thej $8,001 robbery is Harvey Roberts whose trial still is to oc set.
