Her parents said deportation of five-ycar;old Mary Arcc at this lime would he practically the same as signing her death warrant. They blame the U. S. immigra tion and Naturalization Service, but the local agent in charge says his hands are tied by the law and regulations laid down by Congress and there's nothing he can do about it. When Mary was admitted to the United States with her alien mo ther for medical treatment in 1953, her illness was diagnosed as polio. Since then, she has been certified to be suffering from a form of epilepsy,- an illness that the law says automatically excludes her from. U. S. entry. Naturalized Citizen Mary's father, Mauricio Arce, Is naturalized American citizen, and so arc two younger children who were born in Hawaii after the mother came here. Under the aw Mrs. Arcc can apply for per manent residency on the strength of her husband's citizenship. However, immigration authori ties have told her that they will not approve her application for permanent residence until Mary leaves the country. Instead, they gave the two a final three month extension on March 8. The harassed parents have en gager' the services of attorney Elmer E. Poslon, who s)ccialtzes in immigration law and until re cently was director of the Honolulu office of the Immigration and Naturalization Service. Poston said he hopes to con vince local immigration authorities that they do have the right to extend indefinitely Mary's residence in the United States as long as she is under medical treatment, lie said that, failing that, it would take a special act of congress to savc the girl from deportation. Suffers Mild Convulsions Arce, a carpenter, said that if Mary is deported the entire family would have to go back to an un certain future in the Philippines. "They don't have facilities for Mary's treatment in the Philip pines, nor the medicines," Arce told the United Press. "She has improved a lot since she came to Hawaii and her convulsions now come only once in a great while and they arc very mild. Without medical treatment and the medi cines, though, we are very much afraid she will suffer a t elapse. It could be her death warrant." Meanwhile, Mary is active as the poster girl for this year's Easier drive for funds for crippled children. She was selected for the role before her immigration troubles developed.
