U. S. District Judge Edward W'einleld made the ruling Monday in denying a motion by Martin Solnw, assistant to the publisher of "The Nation" magazine, to dis miss an indictment charging ob struction of justice by destroying correspondence sought by a fed eral grand jury. The judge noted that there was no direct federal precedent for his ruling. 1;. S. Ally. Paul W. Williams said the denial was a "precedent making ruling of far-reaching sig nificance." The grand jury was investigating turnabout witness Harvey M. Mat usow, who had recanted much of the testimony he gave as a gov ernment witness against Commu nists. The indictment against So low, filed ..'illy 1.1. 1055. charged he had destroyed four letters be tween employes of "The Nation" and the International Union of Mine, Mill and Smeller Workers (1ml i which discussed Matusow. Neither Solow nor the corres pondence was under grand jury subpoena at the time the letters were destroyed. Solow's attorney, 0. John Itogge, argued that -Solow had a right to destroy the correspondence be cause it had not been subpoenaed. Otherwise, he contended, "an in tolerable burden" would be placed on an individual lo preserve in definitely documents a grand jury might or might not eventually re quest. The judge ruled that to uphold Solow's position "would devitalize the sl.-ilule i making obstruction of justice a crime) and destroy the effectiveness of grand jury inquiry."
