Mott Nine members of the house of representatives in Washington from various states in addition to the Oregon and Montana dele gations paid tribute to their late colleague, James W. Mott, at the atternoon session of the assem-f bly on Tuesday, November 13, according to the Congressional Record. Brief excerpts are: Martin, (Mass.) "He was a man of strong convictions and with courage to fight for those convictions. His fine mind and keen intellect helped materially to build the mighty American navy of today. He personified the high type of public servant required to successfully combat difficult problems in our path Vinson, (Ga.) "He was more than a close colleague to me he was my partner in what was once a most unpopular crusade. the fight for a strong and powerful navy. We . always knew that his penetrating mind would detect any flaws in our proposals. He demanded facts and logic. The void created by his untimely passing will long pervade the meetings of the Naval Affairs committee." Cole, (N.Y.) His attitude Snell to Hear Dennis' Plea Andrew W. Dennis, 45, Port .. land mother-in-law slayer who had been scheduled to die last Friday, was returned to Port land Tuesday after the state supreme court found that no death warrant for his execution had been prepared by the cir cuit court. Circuit Judge Martin W. Hawkins will have to prepare a new death warrant, so that Dennis' execution will be de layed at least 30 days. During that time, Dennis will make ap peals for cummutation to Gov ernor Earl Snell, and possibly take further court action. The opposing attorneys, de fense attorney Edwin D. Hicks, Portland, and Assistant Attorn ey General Fred A. Miller, agreed that no death warrant existed, and that Dennis should go back to Portland for resen tencing and a death warrant. Dennis sat expressionless through the half-hour hearing. Acting Gov. Howard C. Bel ton has denied the appeal for commutation of the sentence to life imprisonment. Governor Snell will return to the state next Friday. Limitations Statute Held Unconstitutional The atate supreme court to day handed down a decision branding the state statutes of limitations as unconstitutional. In an appeal of J. P. Fuller ton versus W. E. Lamm and the Deschutes Lumber company, .the high court reversed a de cision by Lane county circuit Judge G. F. Skipworth and ruled the statute of limitations as an "attempt on the part of the state legislature to control and limit substantive rights granted by an act of congress (fair labor standards act of 1038) and clearly is unconstitu tional as such." Fullerton, as plaintiff, was seeking $6,115 back pay for overtime. The defendant had contended that any employe with claim must bring it within six months as is provided in the statute of limitations. The opinion was written by Justice Hall Lusk with Chief Justice Harry Belt the only one of the seven Justices dissenting. Polk Association To Forestry Board The state forestry board an nounced today that on Decem ber 1 It would take over the assets of the Polk county fire patrol association, including the responsibility for fire protection In the area. The board said that the asso ciation, which had to fight the expensive Black Rock fire last summer, felt it no longer was financially able to continue. The area protected by the as- sociation will become a state fire protection district, the fifth to be organized in the state. The others are the northwest Ore gon, which the state took over this fall after the Tillamook blaze; the southwest Oregon, the northwest Oregon, and the cen tral Oregon districts. Grant (Indiana) "We knew him as an outstanding lawyer, a steadfast American, standing firm for the principles in which he believed." White (Idaho) Jim Mott did yeoman service to his own state of Oregon and to the en tire country. He was a good parliamentarian." Thomason, (Texas) "He was an agreeable companion and a man of fine integrity and ideals. He loved his country and his family with a rare de votion. We traveled together in Europe visiting prison camps." "Whittington, (Miss.) "We served for many years as mem bers of the committee on roads. He was among the leading spokesmen for highway con struction In the United States. He served with me on the com mittee on flood control for some time.
