The snerur areata Into Marions cabin dawn. Chapter 34 TAKEN PRISONER The sheriff's eye travelled swift ly over Marlon. Convinced of the truth of her statement that she hadn't a gun, he motioned her to one side. "You keep out of this now," ordered. "I'll be wanting you answer some questions later." Striding past her, Zcke Parley crossed .over to Ted's bunk, Just as one or nis posse was making rope fast about Ted's wrist and ankles. Thought you'd given us the slip, didn't you?" he gloated. "Well It ain't so easy In these parts get past the law." to Ted, who had been so rudely awakened from a sound sleep, took rapid measure of the situation. He struggled to a sitting position and faced the sheriff with steady eyes. "I don't know what this la aoouv ne declared. "If you're looking for murderers, the man to find is Scrap Johnson. He did his best to murder me, and darn near succeeded." "We've found him." the sheriff answered grimly, "with a bullet through his temple." Prom what Ted had overheard from the first searching party that had passed the shack, he was pre pared for this answer, but his ex presslon of intense surprise couldn1 have been more natural, If It had been real. It was up to him, he ML to tell a straight and con vincing story of what had haDDened. and not complicate It by anything ne nad overheard. "Never from any shot of mine, Ted explained. "I was taking drink of water, and turned around to see him stealing up on me and pulling his gun. I got the drop, and my shot went wild. It might have nipped him, but It never hit a bull's eye like a shot in the tern, pie. But even If It hsd. It was I plain case of self defense. He' "You can tell that at the trial.' zeke Parley broke In gruffly. "8am Cutter'll be here any time now. and he'll take you In charge. Scrap Johnson was murdered Just over ine Idaho state line, so that means you'll be tried In Clear Water Ba sin. "You may as well know, though. he added, "that your story's full of holes. The bullet that killed Scrap jonnson came from your gun. We 've got both the gun and the bul let, and the report Just came In yesterday." Teds surprise at this statement was genuine and mixed with In credulous dismay. "Must be some mistake there!" He caught Marlon's eyes on him. with a mut warning In their brown depths, and the angry retort he was about to make died on his lips. 8he was right about going alow! Anything he said now might be twisted to count against him. The only thing to do was to go peace ably, and trust Justice and fairness to acquit him at the trial. A shout from the woods broke In on them. A minute later 8am Cutter and his posse came stamp ing up the steps and crowded Into the shack. In the confusion, while Zeke Par ley was explaining the situation to the new arrivals, Marlon slip ped around beside Ted. "Try to get them to leave you here a few days longer," she whis pered, "and don't mention Dad whatever you dot" 8h shrank back, as Bam Cutter came over toward them. He was a powerful buvd with t bull dog Jaw By and a shrewd glint In his squinted gray eyes. He took both Ted and Marlon in for a minute without speaking. Then he said, with heavy sarcasm, "I'm sorry to break up your little outing, but your boy friend will have to come along with me." Marion flushed at his tone, and an angry oath escaped Ted In spite or his resolve to keep cool. "But for this young lady. I'd be dead now," he declared. "She has nursed me through this crisis, and anyone who Insults her will have me to reckon with later." He glared at the men crowded around him. He Isn't strong enough to be moved yet," Marlon broke In, but Sam Cutter Interrupted with a hoarse laugh. "I reckon he'll stand the trip." he Jeered. "And If he doesn't, that'll save us Just so much trou ble." He motioned to his men to get Ted outside. I can ride, all right, If you'll untie my ankles," Ted protested. "You needn t worry about mv try. ing to make a break. I'm as anxious as you are to get this thing cleared up." Sam Cutter gave him a long look and curtly ordered his men to cut the ropes that bound his feet to gether. "I ain't worrying about his mnk lng a break," he remarked, "and It'll be a whole lot easier going. He turned to Zeke Farley. "Thanks for the tip about this bird. I'll try to do is much for you some day. reckon the girl friend comes In your territory." He gave Marlon boldly admiring look, and added facetiously, "Some guys have all the luck!" Without giving Ted a chance to have a word with Marlon, they hustled him out. Zeke Farley mo tioned for his men to follow and wait for him outside. Left alone with Marlon, he stud- led her carefully. 8he waited, resolved to have him break the silence. With every nerve tense, she was determined not to say anything that could be used against Ted, or that would Involve her father. She was thank ful that she hsd Zeke Parley to deal with Instead of Bam Cutter. whom she put down as a bully and brute. "Lets hear your story now." Zeke Parley said finally. His voice was more gentle, but none the less firm. There's not much to tell." Ma rlon answered. "I came out early one morning to find Ted Oaynor crawling across the clearing dellrl ous and apparently dying from loss of blood. How he ever got as far as this. I don't know. I got him In Just before the storm broke, and naturally did what I could for him. He pulled through, but It was a narrow squeak." Had you known Oaynor be fore?" the sheriff asked. I never saw him In my life be fore," Marlon answered, looking straight Into Zeke Parley's eyes. "Humph!" was his only com ment, but his eyes held an un willing admiration for Marions straightforward manner. (To Be Continued) orrland Family Visits Friends Independence Mr. and Mrs. lee Bequealth of Portland accompanied by Jimmy and Jack Martin, their sons, spent the week-end at the nome or Mr. and Mrs. J. o. Mcin tosh, and visited other relatives while here. They were on their way to Corvallls where their son Jimmy will enter OSC. They went to Corvallls on 8tinday where he will register, and the rest of Ihe fsmllv will return to Portland Sunday evening. Mrs. Bequealth will be remem bered here as Mrs. Prances Patter son-Martin, daughter of Henrv R Patterson, and a former resident of: Independence, 1 Carl Anderson l THINK I'LL 00 A LITTLE HEAVY READING THIS 'WEEK, HENRY Mrs. Tumbleson Seeking Divorce Dallas Suit for divorce was filet In circuit court Saturday by Kath ern Thelma Tumbleson against James Monroe Tum&leson. The complaint states that the marriage took place at Salem on November 26. 1936, and that ever since that time the defendant has been guilty of cruel and Inhuman treatment toward the plaintiff. There are no children and no property right' are Involved. The plaintiff ask; that her maiden name of Kathern Thelma Hartman be restored to her. Attend Funeral Sllverton Rev. D. Lester Fields and Mrs. Fields attended funeral services In Oregon City, Friday, for Mrs. James Meyers. 44. with Rev. Mr. Fields assisting in offi ciating. Mrs. Meyers was well known In church and musical cir cles of the valley. Her survivors Include the widower, James Meyers, son, Don Polle, and an Infant son. three days old, James Jr. Mrs. Meyers was a member of the congregation when the Fleldses serv ed the Oregon City pastorate.
