Continuation of Skiff Property From Page One week or ten days for the proposed new structure. The plaintiff tendered $1600 Into court for payment to Pearl Skiff and Nettle A. McFadden, sisters, who are delendants and were left $800 each under terms of the will. Another $800 has been paid to Carrie L. Skiff, widow of Will S. Skiff who Mark Skiff stated did not enter into the contest. The defendants con tended that Mark S. Skiff had not carried out the provisions of the will. The property was purchased by Dr. L. S. Skiff, Salem's first den tist, in 1865 for $1000 from William Anderson. Around 85 or 00 years ago the north 20 feet was sold to Reed's Opera house for $1500. In Septem ber, 1865, the old Skiff house was constructed on the property. In 1885 Dr. L. S. Skiff built the little office which is now the north store room and he practiced dentistry there until his death In 1899. Dr. Mark S. Skiff lived on the property and practiced dentistry there for 48 years. Dr. Skiff states that under terms of the will he has paid $16,361.83 In taxes .since 1929 when taxes were $80.17 on the property and went as high as $915.70 In 1928. He states he paid his mother a total of $4270 in monthly payment, provided wood and insurance and In addition paid $1204.20 In street Improvements when the property was up for sale and he paid for these Improvements to save the property. He state he has paid a much a $1100 in one year on various payments and con tends that over $50,000 in rents have been collected from the property of which he stated he never received a cent. C, on a good will tour of the United States, it has now covered 31 states, Oregon being the 32nd. In fact, it has traversed over 350,000 miles. The huge collections which were loaned to the marines by the Smithsonian, national, and Lee museums of Gettysburg, Pa., have been insured for over $225,000. Its local visit here, which would be a short one, should prove of unusual interest to the student of history. The Won der car will be open from 9 a. m., to 10 p. m., each day. There is no lecture, no recruiting, nothing ad vertised, nothing sold, or given away. The U. Relative to algae formation, frorr which the committee claimed well water was comparatively free, the Olympla engineer wrote; "Water that originates In surface streams or in lakes fed by streamj does not contain as much algae. which results in troublesome growth after the water is placed In open storage, as water taken from welit or springs. ... We have two perlocu during the year when the algae growth Is troublesome, one during the spring . . . and another at the nd of the dry season." The well committee, Small satd AGREEMENT ON TRUCK LICENSES BY TWO STATES Word was received here today from Harry C. Huse, motor vehicle license director for the state of Washington at Olympia, of the conclusion of a reciprocal truck op erating agreement between the states of Oregon and Washington whereby trucks owned in one state nnri operated Into the other wtll not be required to carry license plates of both states. The agreement was negotiated between Huse and Earl W. Snell, secretary of state for Oregon. It docs not exempt trucks from the requirement of paying public utiK ity fees and taxes in Oregon. Only those trucks in interstate commerce between the two states will be excused from buying license tags in both. If a resident of Washington trucks to California points, he must take out an Oregon license also, under the agreement. Likewise,' a resi dent of Oregon trucking to Idaho or British Columbia through Washing ton would need a license in Wash ington. The same would apply to an Ore gon licensed truck which also bears California plates and indicates that the owner is hauling from Wash' ington to California. The agreement provided full re ciprocity for passenger cars, non- commercial trailers and cars with dealer's plates. It also recognizes operator's or chauffeur's licenses from the other state. REHEARING OF SMITH OPPOSED Resistance to a petition for re heating in the case of Don C. Smith against Verne L. Ostrandcr reveals that the wrand Juts hwesbttgattd al legations made in connection wan the case, or at least the attorneys affirm that they wore so informed and they state the grand Jury dis missed the matter and did not coun tenance the claim of defendants and found it without merits. The peti tion for rehearing was based on newly discovered evidence including charge that at the trial M. Clifford Moynlhan, Salem attorney, had tes tified he had secured opinions from Henry R. Crawford and Joseph H. Albert as to the value of property involved. Attached to the rehearlnit rjctltion was an affidavit from Hen ry R. Crawford he'd never given Movnihan such an opinion and nev er had talked to him about the property and in fact didn't have any knowledge as to the value of the nrooertv. Moynlhan In a counter affidavit today declares that regardless of the Crawford affidavit he'd again testify in court Just as he did and that he did talk to Crawford ami that Crawford laid him he had the matter very clearly in mind as he had recently been In contact with land close by the property In ques tion. He calls attention to the faci. that the affidavit was made on in formation and belief and Moynlhan declares In his affidavit that craw ford or Joseph Albert ennnot truth fully and honestly unqualifiedly state that Moynlhan did not call them on the phone or converse with them about the property Involved il! the suit. The petition opposing the rehear Inn savs that Moynlhan was not f key witness at the trial and further .avs the entire matter was fully gone into, brlcls suDrmtiea anu written arguments filed and that the real property was well worth much In execs of the sum for which the defendants purchased it. An affidavit also was filed by 13 vcar old Elvon Holman, a witness a the trial, denying any untruthlul testimony at the trial and the wit ness declared truthful testimony wa: given to every question interposed The witness admitted to being scar ed before the trial. CLASS GETS PARTY Seotts Mills The "Kum Join Us' clnss of the Christian Bible school will be entertained Thursday evening at the home of Mr. and Mrs. Lewis Shepherd. Devotional" will be led by O. H. Broughcr. MRS. I.AHSAS 11,1, Mt. Angel Mrs. Paul Kcber of Salem Is staying In Mt. Angel for a few weeks to take care of Mrs, Oeorgc Lassas, who wa seriously HI, but la now on the road to recovery, from page 1) had reported that the water at Olympia "is of good quality, clear and cold, free of any contamination and they do not require filtration or chlorlnatlon." small quoted tne Olympla engineer a saying it was necessary to treat the well water wfth chlorine and ammonia "and occasionally with doses of copper sulphate to control the algae growth." The committee reported that Olympla found It necessary to store only 1,500,000 gallons. The Olympia engineer said the city had storage capacity for 5.000,000 In two open reservoirs and 700,000 gallon in three standpipes. The committee had given the Olympia peak demand as 6,000,000 or 7,000,000 gallons a day and the Olympia engineer put It at 2,300,000 gallons. Small also challenged the com mittee statement that Olympia's population was 18,000. It actually was 11,733, he declared. To Small's remarks Alderman Williams replied by stating that he and O'Hara had gotten their fig ures from ex-Mayor steel of Olyrr pia. "We did not talk to Engineer Wil liams," he flung back at Small, "hut he is an engineer, and I suppose be longs to the engineers' society." En gineers, Williams intimated, would not favor wells. Alderman O'Hara deended tlu committee report, declaring the committee had tried to get a thor ough and accurate picture of the situation. 1 haye at various times expressed myself in favor of the Little North ' Fork," said O'Hara, "since it Is the only source for which the people ever made a choice by referendum. But I was voted down on that 13 to 1, As I appraise the present sit uation it is Just this: Whether we are going, at great expense, to get well water from an Island 25 mucJ away or get the same kind of water from a distance of only three or four miles. I was especially Impressed by one well we saw at Shelton. It con stantly flows 7,500,000 gallon a day and requires only a very small piece of machinery. That amount of water Is the maximum demand of the city of Salem in the peak sea son. The well cost In construction only $17,500 and is operated for only $2.60 per million gallons. If Salem Is to build the proposed gravity line It will cost enough to mortgage the whole system for 40 years. It seems to me there Is just one answer a further Investigation of wells for Salem." 1 Small took the Door again and said Salem wa divided into three groups In choice of water source, the Willamette river group, the Little North Fork group and the well group. As tor the LiWe North Fork he said the charter amendment for municipal water never mentioned -that stream. "It mentioned the North Santlam or one of its tributaries." Vie said. "The only place the Little North Fork was ever mentioned wa as one of the three alternatives on which the people voted." Small reviewed the well Investiga tion by N. C. Janssen, contending that the Investigation, together with the operations of Knowles, the . geologist, established that well water ennnot be had here. . "The whole Idea of all this well propaganda," said Small, "Is to hold up progress indefinitely, perhaps with the Idea ultimately that tne well crowd can get Its plan across." Alderman Williams rebutted by declaring the Janssen Investigation was stopped, Intimating that there was an ulterior motive In the stop ping of the investigation. Williams scored the Infiltration gallery plan now under investigation on the North Santlam island, declaring it would drain all the contamination from the mountain sides." The chairman of the water com mission himself," said Williams, says If this gravity line Is built It will be necessary to raise water rates 25 per cent." The committee's report was re ceived and placed on file. The letter from Sloper. Albany well driller, made two proposals: iTo provide a supply of 10,000,- 000 gallons daily from wells located within two miles or the city reser voir for $55,000. including equip ment; maximum of 10 wells: city not to be obligated If wells fail to produce. 2 To produce the same gallon age at a cost of $3000 per million gal lons per day If the city would agree to accept each well testing a mini mum flow of 1,000.000 gallons a day. Sloper said the wells would be about 60 feet deep and about a quar ter of a mile from the Wlllamctlo river. He offered a one-year guar antee.
