A dispatch from Roscburg ex plaining the attorney general's opin ion had the following to say: Nottltrd by the state attorney general that payment of high school tuition Is mandatory and that the item must be included within the 0 per cent constitutional limitation, the Douglas county court Is faced with the necessity or practically eliminating Us general road fund from the 19J0 budget to meet the deficiency and current needs in the high school tuition fund. Ktudents in non-high school tils trlcts, according to the stats law, may attend high school- in orrjan ued districts and their tuition can ha collected by the high schools from the county, which In turn Is authorized to collect the costs from the unorganized districts from which pupils coma. For the past few years tne conn y has not collected enough from he unorganized district to meet the costs, and is behind about $44, 000 In payments to the county high schools. Demand has been made for payment and suit has been threat ened unless the claims are allowed. The case vas referred to the attor ney general who ruled relative to the part of the county. The county court, acting upon the assumption that the tuition fund is a district measure, deckled to levy a tax sufficient to make up the deficit and pay this years costs making $93,000 included in the 1930 budget, outside of the 0 per cent limitation. As the road fund Is the only item that can be pared, this fund will be reduced to about $20,000, cording to present plans. The ar rangement will save about two mills in general taxes while unorganized high school districts will be re quired to bear about an eight mill increase. As a result of this ac tion Douglas county will have about $20,000 to spend for road mainten ance during the coming year.
