JUDGE RULES ATHEIST CANBEWITNESS (Continued from psge 1) ltmlnary hearings held In the flog ging case. Appearing against fourteen men he had named as members of a mob which he said took him, with C. D. Saylors, and C. M. Lell, Gastonla members of the National Textile Workers union, from Gastonla to, a spot near here and flogger him, Wells told Judge Shaw he did not believe In God and was a commun ist, With these declarations Judge Shaw held Wells had disqualified mm sen as witness. Seven men of the fourteen named as mob members by Wells were held for grand Jury action by Judge Shaw. Thursday the grand Jury re turned true bills against four of the seven, releasing three. It Indicted A. Q. Morehead, Horace Lane. Dew ey Carver and Carl Holoway. The trial opened Immediately af ter ine indictments were returned. A jury was chosen speedily and C. D. Saylors was placed on the stand. He told of being pulled from his noaroing nouse in Gastonla by mob and taken vlth Lell and Wei Li to a point near here, where he said Wells was beaten. PROSECUTION OF BINGHAM LIKELY (Continued from pa 1) aiMon, whs th. "representative' wu. "I presum, myself, " he replied. Bingham haa testified Eyanson wu "loaned" to him by the imo- clatlon to assist him at th, time th, tariff measure was befor, the senata finance committee and that this poulbly had been a mistake. An Intention to return all money received from the government was given Friday by ."Jyanson before the committee as th. reason for not notifying his employer, the Con nectlcut Manufacturers association that he had been put on the gov ernment', pay roll by Senator Bingham, to assist the senator In tariff matters. Eyanson, one of the wltneases at Thursday's stormy session when Bingham said hta employment might have been a mistake, Insisted Friday under questioning by Chair man Caraway that "I did not in tend to keep the government pay." -were some ox your Ideas re flected In the tariff bin?- asked Senator Caraway. Perhaps, But all I did was to save Senator Bingham the trouble of collecting information, I hope I was of help," said Eyanson. Sen ator Walsh, democrat, Montana. asked for copies of correspondence exchanged between himself and of ficers of the association during his work in Washington for Bingham. mey are of a more personal nature than I realized." Eyanson said as he turned over the corres pondence. A letter from K. Kent Hubbard president, to Eyanson, dated July 12 wag read by Senator WaUh. You have done a great deal more than we bargained for In the beginning," Walsh read asking: "To what does Mr. Hubbard refer in regard to your one month's work in Washington?" HHls Idea, I think, was that three or four weeks ought to be sufficient time to prepare data for Senator Bingham," explained Eyanson. Quoting farther, Walsh read: "Undoubtedly the results which you have accomplished axe far reaching and will bear fruits from some time to come.' What did he mean?" asked the senator. "He knew nothing," the witness said. "You will have to ask him about that." "Isn't the plain meaning of this that Mr. Hubbard had information about rates the Connecticut manu facturers were going to get and those were the results he was talk lng about?" persisted Senator Walsh. "I don't suppose Mr. Hubbard knew anything at that time about the tariff rates, replied Eyanson, EXPERTS ADMIT THEY ARE FOR PANTAGES (Continued from page 1) were to set fees for their testimony, Each pointed out, nowever wav such a fee was customary. The physicians both said they were brought into the case by Dr. E. O. . Pishbaugh, who has had charge of Mrs. Lois Pantages, wife of Alexander Pantages, during her critical illness which followed her conviction recently on a man slaughter count. Mrs. Floy Blffle, wife of Garland Blffle, who was Indicted for per jury as the result of his recent testi mony In the assault trial, created a sensation In court at the close of her testimony Thursday when she broke down and Implored court of ficials not to take her "to jail." "They arrested my husband; are they going to arrest me?" she plead ed. "I don't want to go to Jail." Mrs. Blffle, who corroborated her husband's previous testimony, was subjected to a bitter cross examina tion and prosecution attorneys ob tained several admissions of Incon sistencies tn her story. District At torney Buron Pitts said that no ac tion would be taken against her at present, but Indicated that her case might be placed before the grand Jury. Both Mrs. Blffle and her hus band had testified that they saw Nicholas Duneav. Russian author of Miss Prlngle's vaudeville skit, enter the theater and accompany the girl to Pantages' office on the day of the alleged attack, and Blffle testified he overheard a conversation between Duneav and Miss Prlngle which In dicated a "frame up" on the theater man. The district attorney said he would present witnesses at Biffle's trial on a perjury charge, set for Ocvober 25, who would testify that Duneav was not at the theater with the girl Three physicians were also de fense witnesses Thursday. The first of these was Dr. Peter O. Sunden who testified he had given the Prin gle girl a physical examination at the request of District Attorney Fitts on August 13, and that time he could find no evidence of an attack. Dr. Sterling Pierce, who also was present and made a similar exam. lnation at the same tune as Sunden gave similar testimony. Dr. E. H. Oibbs was the last medical man called and atlU occupied the witness stand on direct examination when oourt adjourned for the day. Small town gossip found Its way into the records of th. trial when grand Jury testimony of Leo Zlaket, who said Wednesday that he lived next door to the Prlngle home in Oarden Orove, was read to the jury. In this statement Zlaket said his wife had told him that a 19 year old neighbor girl had told her that she had heard a rumor that Eunice Prlngle had once "broken up a fam ily." Zlaket admitted that he, of his own knowledge. knew of nothing that could detract from th. girl's reputation. Pitts, on cross examination of the Oarden Grove man, drew an admis sion that on August 21 he went to see Alexander Pantages at the let ter's home, and a few days later went to ate one of Pantages' attor neys. In direct testimony, Zlaket had said he saw Duneav visit the Oarden Orove home of the Prlngtes "fifty or seventy-fire time)," when questioned by Pitta he aald he did not know Duneav', name until he was told It by Pantages. The re mains were shipped to Portland Fri day morning by the Terwllllger Fun eral horn, for funeral service, and Interment. . excepting from April. 192, to No vember of that year when the col lege extension service paid a part of the expenses. Last year the clerical work of the boys' and girls' clubs was increased under a new system and Mrs. Fui kerson and Mr. Fox asked for a $500 a year appropriation from the fed eral funds furnished lor ice pur pose. This amount would have paid for a part time clerical assistant and a part of the heavy traveling expenses to ail parts of the county. Until Thursday afternoon Mrs. Ful kerson and Mr. Fox were still hope ful that the extension service would grant their request. A flat refusal was received however. Other counties In the state re ceive some aid for club work from the extension service says Mrs. Ful kerson and It seems only fair that the same consideration should be given Marion county. Mrs. Fulker son says she does not feel that she can ask for an additional appropri ation of funds from the county court for club work. It has not yet been decided how the club work will be handled In Marlon county when the school superintendent's office withdraws.
