Johnson against William E. and Eva John son, involving adoption of Willard Xnnd Vivian F. Johnson, minora nccording to announcement made today by Wallace Carson, one of the attorneys for the defendants. The proceedings have been a par tlcular interest because of lav points involved. In his decree of Judge McMahan overturned adop tion proceedings of the county court, declaring that the children are legally stilt tho children of their parents. ; It was charged by Edna Z. John son, plaintiff, and mother of the children, that adoption proceedings were had on representation that she was Insane, when, she declar- -ed as a matter of fact she was not insane. While she had been an In mate of the state hospital, at the time of the adoption proceedings. she charged she had been discharg ed as curod and the court holds that sho was not Insane at the tl..i i the adoption proceedings wero started. . Judgo McMahan holds that the - adoption proceedings are null and void, and decrees tho children to tho parents. A peculiar angle of the proceed ings is that the father not only consented to the adoption but urg ed It, tho chlldron being adopted by his paronts, Tho suit was brought by the mother alone, but tho court decrees that both the father and mother are their guar dians.
