Tillamook county, was recently
appointed by Governor Pierce ao
a member of the twh commission
and the question has arisen wheth
er he can legally serve on the com
mission since he ia a member of
the state senate. Kozer's letter
eltea section 10, article 11, of the
ita'e consttlutlon. which eays:
"No person holding a lucrative
office or appointment under the
United States cr under this stat
will be eligible to a seat in the
legislative Asuehiuiy; nor shall
any person hold more than one
lucrative office at the same timo,
except as in this constitution ex
pre33ly permitted; provided, that
off ice re in the militia, to which
there is attached no annual salary,
and the office of postmaster,
where the compensation does not
exceed $100 per annum, shall not
bo deemed lucrative.
Another excerpt from the con
stitution quoted la section 1, ar
ticle 3, which saye:
"The powers of the government
shall be divided Into three sep
arato departments, the legislative.
the executivs, including the ad
ministrative, and the judilcal: and
do person charged with official
duties under cue of these depart
merits shall exercise any of the
functions of another, except as In
this constitution expressly provid
ed."
Under the law members of the
fish commission receive $5 a day
white on ofitcial duty, and
though they are Hinted to $200 a
Tear, they could seemingly come
under the constitutional inhibi
tion against holders of lucrative
office occupying scats In the legis
lature. The reference to the three de
partments of state government,
and the provision that "no person
charged with official duties under
one of these departments shall ex
ercise any of the functions of the
other," has reference to Beals
holding a legislative and an ad
ministrative office at the sain;;
time.
Deals' appointment is already
effective. At the time he was ap
pointed the governor also appoint

DAYLIGHT TO BE SEEN
THRU TUNNEL FRIDAY
Bend, Or., June 17. Daylight
Is expected to be seen through the
tunnel under (be Cascades on the
Natron cutoff sometime Friday
according to telephone reports
from Stewart Welch, contrac
tors in charge, this morning.
Celebrations by and for the work
men will be held at each end of
the tunnel Sunday.
The tunnel when daylight is
cut through, will be little more
than high enough for workmen to
get through below the timbers, ac
cording to W. J. Perry, lumber
forester for the Deschutes national
forest, who returned this morning
from several days at Odell lake
lie has been in charge of the tim
ber being cut from the national
forests for the tunnel timbers and
tunnel "packing."
A Muccaboe Btate picnic will be
held on the state fair grounds at
Salem on Saturday, June 20,
which will conclude with the Ini
tiation of a class of fifty candi
dates. Maccabees, both Ladies and
Sir Knights, will be in attendance
from Portland, Albany, Corvallls,
Jefferson, Mill City, Llnnton, Sa-
010 and many other points and the
class of candidates will be fur
nished from these localities. Tent
No. 90 at Mill City already has 20
young active men examined and
eady for the ceremony.
Lunch free to all In attendance
will be served at 6 p. m. under
the supervision of Willamette Tent
No. CG of Salem and will be ob-
ainablc by those who are unable
to get there until a Inter hour. A
street parade headed by the state
training school band and the do-
re teams of the Ladies and Sir
Knights f r m Portland and fol
lowed by the attendant autos will
move at 7 p. 111. through the prin-
ipal streets returning to the fair
rounds. At 8:30 p. in. the Lady
uards of Port. and, known as the
Ito.se City Guards, will give an ex-
htion drill In the stadium and
this will he followed by an exem
plification of the degree work by
the degree tennis of Touts No. J
nd 17 of Pnrliaiia.

out with renewed vigor Tuesday
despite the presence of more than
500 dominion troops and special
miners' police.
The Bankhead screen of the un
used colliery of the British Em
pire Steel corporation at New
Aberdeen, woe destroyed by fire.
Barbed wire entanglements had
been thrown about property, search
lights were playing and troopers
were on guard throughout the
night.
Retail stores owned by private
Individuals at Bras d'Or and Flor
enco were looted by mobs of several
hundred men. The mines give the
appearance of armed camps. More
troops were reported on the way
from Ottawa and Toronto, Includ
ing detachments of the famous
royal dragoons.
The walkout In the Cape Breton ;
area was called by United Mine
Workers officials last March as
the result of a wage dispute with
the company during which the
miners' credit at the stores bad
been cut off.
James Murdock, Canadian rain
later of labor, arrived here today
to offer his services as mediator In
what he hoe called the "too long
dran out" struggle between the
steel corporation and the miners.
He will study the situation from
both sides
