M, Devero, attorney for the state high way corumifiHlon. The question lfl whether the county can be forced to pay overtime wages to laborers who requested the privilege of working over eight hours. Tho suit is brought by Allan Joy, Portland attorney, In the name of Gregor, who ho taken Ihe aa signmeutfi of all the other labor ers Involved. The case dates back as far us 1918 and the overtime wages alleged to be due total about $5000. The county employed a large number of men on road work and they were required to furnish their own board. Since they were In the country a long distance from their homes they had to pay board, and expressed a preference to work 10 instead of eight hours, so that they might pay board by the additional two hours labor. There Is a law that eays eight hours shall constitute a day's work more than that to be required only Jn cases of emergency, when dou ble pay shall bo allowed for the overtime. The suit Is brought un der that law, but the county claims tho law should not apply for the reason that the men wanted to work 10 hours. About a year ago some of the aame men complained to State La bor. Commissioner Gram, demand ing overtime pay, and at the re quest of Governor Pierce Attor ney Devers placed the matter be fore the Lane county grand jury, which did not indict the county offlcinls, and now the laborers have Instituted civil action. PIERCE PROTESTS T Hundreds of protests received by Governor Pierce against the proposed construction of the Priest rapids dam In the Columbia river have caused the governor to send a letter to the secretary of the interior declaring that unless assurance is given that the fish ing industry will not be injured by the project the state of Oregon will try to prevent the Improve ment or demand that facilities to protect salmon propagation be In stalled by the builders. The federal power commission has Issued a license for construc tion of the dam to the Washington Irrigation & Development com pany, which 1b organized under the laws of the state of Wash ington. In his letter to the secre tary of the interior Governor Pierce says the dam will Interfere with the passage of salmon up the river to their spawning grounds. P.)- Eight persons were killed by lightning last night and damage estimated to amount to millions of francs was caused by storms In this section.
