A friendly suit In court to de termine whether the property owners on north Summer street should pay for repaying or the city should be obliged to shoulder the cost may be the result of a special committee meeting of aldermen and property holders last night in the city council chambers. Pacement put on that section of Summer street In 1911 bas failed to stand up, and is in such a state now that travel Is Impossible over the street, according to a number of property owners on that street who attended the meeting last night. That the section of pavement on the street was never approved by the office of the city engineer was attested by City Engineer Rogers, who was then an assistant in the department. Inspectors hired by the city who approved the pave ment and .that on D street from Winter to the city limits, east, and that on many of the streets in Oaks addition did not know their business, according to the opinion voiced by many property holders. Most of those wbo attended the meeting believe that the city is morally bound to replace this pavement, although the city at torney has voiced the opinion to Hal D. Patton, chairman of the committee in the absence of Mayor J. B. Giesy, that the city Is not legally bound to replace the pavement. A suggestion was made by Aid erman G. J. Wenderoth that the city go ahead and lay a block of the said pavement, and see it any legal action Is taken to stop the work. Then a proposal can be referred to the people as to the correct way of financing the pro ject of repairing and repavlng worn out sections of the city streets.
