Dallas, Jan. 6. The body of
Aba Decan, 70 year old laborer.
was found on the R. P. Boise
farm Dear Ellendale by searchers
last evening.
Mr. Decan had been workine
on the Boise farm slashing brush
and when he failed to return to
bis borne at the usual time last
night neighbors started a search.
The body was found near a pile
of brush slashings, and Indica
tions are that Decan simply drop
ped over dead while work'rg.
No inquest will be held. It wat
announced by the coroner.
On the body was found an I.
O. O. F. card showing mnihcr-
cuip in a Hood River lode, and
there were also old letters In ti e
pockets from a brother In Idaho.

In a reply filed by Jennie B.
Thteleen and others to the answer
of Carl Llnde and Warren Arming-
ton Involving the defunct Capitol
Apartments project, the plaintiffs
assert that all of the. uctions and
representations of the defendants
were faJe and fraudulent and
known to bo false and fraudulent
by the defendants to made and
done for tho purpose of cheating
and defrauding the plaintiffs.
The reply states that the agree
ment was to buy a lot In Salem
for $19,000, to erect thereon nt a
cost nut to exceed $150,000, a 72-
apartment building which was to
be furnished for $30,000, The re
ply further chargos that the de
fondants entered into a secret
agreement to have plans drawn for
an apartment to cost $220, bOO. The
Judgment for $4500 secured in
Portland against the plaintiffs wan
wrongfully secured, the reply a!
