State counsel expressed the hope that today would mark the completion of tlae state's direct testimony at the trial of the five men charged with mur der in connection with the Herrln riots of last June. " Four survivors of the riots yes terday testified for the state, tell in (j of the attack on the mine and the shootings that followed their surrender. Cross-examination of the four survivors was brief and mainly dl rected toward bringing out that the four were employed to guard the mine by a Chicugo private de tective agency which received $2 a day for each of the 31 men sup plied to guard the non-union niin ers. Judge D. T. Hartwcll said there would be no court sessions Satur day and that adjournment would be taken Friday afternoon until January 2 over the holidays. . When court re-convenes after the holiday recess, the defense is expected to start the Introduction of testimony designed to prove alibis for all of the accused. TAYLOR MURDER STORY GIVEN LITTLE CREDENCE Los Angeles, Cal., Dec. 21, Los Angeles police placed little credence they Baid, in the story told the authorities of Toledo, Ohio, bv John Marazlno that he knew who killed William Desmond Taylor, motion picture director hre last February 1 and because of that knowledge bis life was in danger. Records showed Marazino was unknown to the Los Angeles police department. Officers Baid they had 'considered his theory that a "drug ring" was back of the Tay lor murder, but had abandoned it many months ago for lack of cor roboration. Mer Rogue, La., Dec. 21. Search of the bottom of Lake La Fourche for the bodies of Watt Daniels and Thomas Richards, missing members of a party of five Mer Rogue citizens who were kid naped by masked men on the night of August 24 while returning from a good roads meeting at Bastrop, was begun today by divers, pro tected and asKistated by a detach ment of company G, Louisiana na tional guard, which arrived here yesterday from Monroe. Two iron wheels of a farm wagon which were lying on the banks of the lake are said to have disappeared the night of the. kid naping and authorities believe that these may have been used as weights to hold the bodies beneath the surface of the water. An expert diver employed by the state authorities arrived here last night with his diving equipment Official information received by Governor John Parker that threats had been made against representa tives of the state investigating the kidnaping of Daniels and Richards was -one of the many unconfirmed reports circulated here as the rea son lor the sending of troons to this place. The threats, it was said, came Yr6m persons in More house pariah. AMES A AUSTIN WOODBURN. DEAD Woodburn, Or., Dec. 21. James A. Austin, a prominent citizen and pioneer merchant of this city, died at his home in Woodburn last evening, in the 81st year of his age. He was born at Monroe, Wis., June G, 1842. In November, 1852, he moved with his parents to Minnesota and in May, 1889, came with his family to Oregon. He farmed on Howell Prairie until 1891, when he came to Woodburn and started a grocery business. He was a pillar of the Methodist Epis copal church, a member of the A. O. U. W., and his demise is the cause of much sorrow to all. Sur viving him are his widow and five children: A. E. and Harold Austin, Woodburn merchants; Lloyd Aus tin, Pasadena, Cal.; Miss Laura Austin, a missionary In India, and Mrs. W. B. Cornutt, Portland. Mr. AuHtin was the grandfather of Miss Ruth Austin, society edi tor of The Capital Journal. U Z ., " - ' ; JZ "w ---js- PAKOJil IS SOUGHT FOR SELF DEFENDED CONVICT Seattle. Wash.. Dec. 21. Resi dents of this ctiy have signed i petition that has been sent to Gov ernor Hart asking him to pardon Peter Miller, sent to the state penitentiary seven years ago to serve 28 to 70 years. Miller, who was his own lawyer, was tried on 13 charges, including murder. He was convicted twice for burglary and once of perjury, fighting the cases in the courts five years. Miller,, whose name is Charles Elliott, lias won the respect and friendship of penitentiary offi cials. He is secretary to the prison chaplain, prison librarian and custodian of the paroled prison ers' fund, which he founded..
