ERr5 FIRECRACKERS IS DECLARED VOID Ths young patriots of Oregon may yet experience the thrill that goes with fireworks aud fire crackers on the grand and glor ious Fourth. The order Issued by State Fire Marshal 'A. C. Barber recently tabooing the gale at retail or the . use of these noise producing ex plosives on the Fourth of July, was all wrong according to Attor ney General Van Winkle who ao point out In an opinion to Barber "Tha sale of fireworks at re tall Is prohibited," Barber decreed In his recent order. All other forms of explosives, Including fire crackers, torpedoes, caps, blank cartridges and the various and sundry other accessories generally associated with a proper observ ance of the day were also covered in the prohibitory order which was based upon an act of the legis lature of 1921. Now comes the attorney general with an opinion to the effect that "the legislature has not pro hibited the use of combustibles and explosives ". and that "th use ot same was not Intended to be pro- -hlblted." "It li my opinion that th general prohibition of th dig. charge, etc., of fire crackers, fir works and other combustibles con tained In section 1 of your order. Is not authorized by the provtsloni of the statute referred to and that said statute does not confer upon 'the state fir marshal authority to prohibit generally the sale of fire works at retail," the oplnton of Van Winkle declares. The attorney general's opinion on the matter was requested fol lowing receipt of complaints by the fire marshal to the effect that he had exceeded his authority la Issuing bis sweeping prohibitory order. EMPLOYERS REQUIRED TO FURNISH ALL DATA Employers of labor In Oregon re required by law to furnish to th state labor commissioner suck statistic and data as h may re quire In th compilation of his report on th industrial situa tion In this state. Such Is th gist of an opinion given to C. H. Oram, state labor commissioner, by Attorney General Van Winkle. The stats law, according to th oplnton of th th attorney gen eral, "require every owner, oper ator or manager of every factory, works, (bop, mill or other estab lishment, excepting mine, where labor I employed, to make to th bureau, upon blank furnished by said bureau, fuch report and re turn a th said bureau may re quire for th purpose of compil ing such labor statistics a ar authorlied by the act." Penal tie for failure to pro vide th Information sought by th labor commissioner ar also provided under th terms ot th act. cr "t"'
