The defense had been attempting to show that school teachers were not goon business people, and thus win a point In Todd's favor. . Humphreys returned tne com pliment when Judge Miller finish ed with the witness and asked Ausman If he had noticed that school teachers had any mors dif ficulty In telling the truth than other people. This question brought forth a storm of protest from the defense, but to no avail. The court instructed the witness to answer the question. Ausman said It was his opinion that school teachers told the truth. The prose cutor Intended this question to af fect the statements of the teach era who had testified against Todd, and not for the benefit of the defendant. Defense Objects. Ausman's testimony was the source of much objection on the part of the defense, as his con tract and check; make up one oi the Indictments. Todd lg said to have told Park he was very .foolish to want bis money back and to have convinced him to retain bis contract. Park also charged Todd with telling him that If the scheme looked "shaky" he would let him know In plenty of time to get bis money out. A month later Park said be met Todd In the Methodist cburcft and , asked him bow things were. "Alright," Todd is said to bare answered and to have turned on his heel and walked away before any further conversation could be had. Park said be borrowed the $500 be invested and lost. Byron's Eecord Told. O. H. March, clerk of the court, was called to officially inform the Jury of Byron's criminal record. He brought the official record of Byron's conviction into court. Charles McCarter and 5"rtd F. I Prince, both $500 rlctlmu, ta!d they were persuaded by Todd to Invest their savings In the fraud- -ulent scheme on December 20, -1919, and January 20, 1920, e spectlvely, or after Todd has ad mitted be knew Byron's criminal record and postlvely assured him them was no chance to loose In the deal. Prince said Todd told him that while Byron bad been indicted several times he bad al ways been freed of all charges. A. E. Cummlngs, wbo obtained a $500 contract December 2.!, had a similar story, and added that Todd told him that his brother, Ed Todd, had been In the timber busi ness with Byron many years ago. F. E. Evan8 said he lost $1500 in the scheme because he relied solely on the representations riade by Todd. Jury Is Serious- The Jury trying this case Is far different from the Jury selected for the first trial. The first Jury appeared to take the trial as some what of a Joke, and continued to smile as the witnesses one by one told how they had been lured Into purchasing nothing for something ' In their ambition to obtain some thing for nothing. The present Jury seems to view the case In a entirely different light. Hardly ever does any mem ber of the body crack a smile. They are listening to every word of the witnesses, and even when the remainder of the court room miles over the pert remark of a witness or attorney, tbelr faces re main as sombre as that ot the court. Mrs. Todd has also attended all the sessions of the present trial except the first bait day. She wears the cams forlorn look, and seldom miles.
