' "Considering the language and pur pose of the act it was never the intent of the legislature that the defendants) should be required to sell or lease sand or gravel belonging to the state at anything but a fair and reasonable price," the opinion reads, "If tha deefndants could now be compelled to 'execute a lease for five years at a stip ulated price of three cents per cubio yard they could be required to execute a lease for twenty-five or fifty years at a price of two cents or evea one cent per cubic yard."
