LEGISLATIVE INTENT Discussing the question of the re mission of penalty and interest on aertain unpaid taxes and our recent editorial on the subject tho Press Bays: "The supreme court In consid ering this case will undoubtedly lake nto consideration the intent of the legislature when they passed this measure." , That sounds eminently reasonable How will this intent be discovered? By an Inspection of the statute and a study of its words, of course. What does the statute say? ' It says in part: "The county courts llAY and are hereby AUTHORIZED to remit all Interest, penalties and dosts which have been or may be In curred on all taxes levied (n their respective counties on the tax rolls for the vears 1921. 1P22 and IMS," a What is your guess as to the In tent of the legislature that used these words? When the legislature said "may" did it mean "shall"? When the leg islature said "authoriied" did 1 mean "directed"? The Intent of the legislature sticks out all over the section quoted and It is not the intent given the law by tbe forced construction of the attor ney general. The Press says that the county eourt is bound by the opinion of the j attorney general. This is absolutely! not so. Consider this. The other j day a circuit Judge said that a Port-1 land zoning ordinance was unconstl-1 ttitional. Is '.be Portland city coun- j ell accepting the decision? It Is not It is proceeding to act under the pro- visions of the zoning law and will continue, so It is stated, until the sti-j premc court says the circuit judge is: right. The county court is even lesr bound by what ihe attorney genera! has said than the Portland council . by what the circuit Judge decided. We take issue with the Press also in respect td whether the recent ac tion of the Deschutes court should i be allowed to stand now that the matter is to be tried out in the su preme court. Since an answer Is to be given by the court, the proper course, we believe, is for the county court to hold matters unaltered until (he decision Is given. If the Press Is returning to this i discussion will it not set forth rpe cifically what it conceives to be th' 'erroneous premises" upon which our argument of June 8 was based. Yesterday we spoke of the condi tion of the Century drive between the city limits and a point beyond Big spring. Another Important sum pier road that needs attention is the one leading from the hill above the fish hatchery out to Broken Top. The accumulated dead fall of several years now lies across this road antl In places It Is badly rutted. The road is an important one. Over it one may drive to the plateau of Broken Top, one of thu most attractive spots in the country, i'rom it a branch rond will take olio to Three Creeks lake or it forms part of a circle trip by way of I hit lake. Sisters and the jfcKenile-Bend high way. A connect ing roatl over to the Century drive is filunned by tbe foresl service and now partly built. A smile is much more helpful than any style of frown, than any pro test yelpful that Bends our spirits down. But now and then a fellow who BpringSi throughout the .war, a smile serene and mellow, getja notions rather queer. He smiles, in prince ly splendor, and then the idea trots it should be legal ten der, and liquidate his debts. We toil, when he is running for justice of the peace, for votes we all go gunning, our efforts do not cease. He smiles upon us grandly, he smiles on every pent, he smiles so sweetly, blandly, he fills us with content. But if we ask a favor his course is often rude, his observations savor of rank ingratitude. Antl if we're haled before him for speeding with our trucks, our explana tions bore him. he fines us twenty bucks. A smile is quick ly faded, its splendor one forgets, if it is hawked or traded in payment of old debts. The man who thinks his smiling will settle all he owes is foolish, he is piling up cords of future woes. We have to buy our raiment, our rainsticks and our tiles, and we need better payment than bright sun shinv smiles.
