LEGAL Notice for final EIS Objection Filing
Ten Cent Community Wildfire Protection Project
North Fork John Day Ranger District, Umatilla National
Forest
Whitman Ranger District, Wallowa-Whitman National Forest
The draft record of decision (ROD) and final environmental
impact statement (final EIS) for the Ten Cent Community Wildfire
Protection Project are now available for public review. The
project is intended to reduce surface and canopy hazardous
fuels using mechanical treatments (logging and mastication) and
prescribed burning to modify potential wildfire behavior within
portions of the Granite Creek Watershed. This project planning
area is approximately 37,800 acres in size: 23,990 acres within
the North Fork John Day Ranger District on the Umatilla National
Forest (63 percent); and 13,810 acres within the Whitman
Ranger District on the Wallowa-Whitman National Forest (37
percent). The planning area also includes approximately 9,500
acres of the North Fork John Day Wilderness. Ian Reid, North
Fork John Day District Ranger, and Jeff Tomac, Whitman District
Ranger, are the Responsible Officials for this project.
The draft ROD and final EIS and supporting documents are
available on the Umatilla National Forestʼs project webpage at:
http://www.fs.fed.us/nepa/fs-usda-pop.php/?project=45203
This proposed decision is subject to objection pursuant to 36
CFR 218, Subparts A and B. Objections will only be accepted
from those who submitted project-specific written comments
during scoping or other designated comment period. Issues
raised in objections must be based on previously submitted
comments unless based on new information arising after the
designated comment period(s).
Objections must be submitted within 45 days following the
publication of this legal notice in the East Oregonian. The date of
this legal notice is the exclusive means for calculating the time to
file an objection. Those wishing to object should not rely upon
dates or timeframes provided by any other source. It is the
objectorʼs responsibility to ensure evidence of timely receipt (36
CFR 218.9).
The objection must be filed by way of regular mail, fax 541-278-
3730 (Umatilla) or 541-523-6392 (Wallowa-Whitman), e-mail,
hand-delivery, or express delivery with either Objection Review
Officer: Forest Supervisor Genevieve Masters, Umatilla National
Forest, 72510 Coyote Road, Pendleton, Oregon 97801; or
Forest Supervisor Tom Montoya, Wallowa-Whitman National
Forest, Attn: 1570 Appeals and Objections, 1550 Dewey Avenue,
Suite A, Baker City, OR 97814.
The office business hours for those submitting hand-delivered
objections are: 8:00 a.m. to 4:30 p.m. Monday through Friday,
excluding holidays. Electronic objections must be submitted in a
format such as an e-mail message, plain text (.txt), rich text
format (.rtf), or Word (.doc) to objections-pnw-umatilla@fs.fed.us
or objections-pnw-wallowa-whitman@fs.fed.us with Subject: Ten
Cent Community Wildfire Protection Project. In cases where no
identifiable name is attached to an electronic message, a
verification of identity will be required. A scanned signature is
one way to provide verification.
Objections, including attachments, must be filed within 45 days
from the publication date of the legal notice in the East
Oregonian and the Baker City Herald, the newspapers of record
for the Umatilla and Wallowa-Whitman National Forests.
Attachments received after the 45-day objection period will not
be considered. The publication date of this legal notice in the
newspapers of record is the exclusive means for calculating the
time to file an objection. Those wishing to object this project
should not rely upon dates or timeframe information provided by
any other source. Objections delivered by mail must be received
before the close of the fifth business day after the objection filing
period closes.
Minimum requirements of an objection are described at 36 CFR
218.8(d). An objection must include a description of those
aspects of the proposed project addressed by the objection,
including specific issues related to the proposed project; if
applicable, how the objector believes the environmental analysis
or draft decision specifically violates law, regulation, or policy;
suggested remedies that would resolve the objection; supporting
reasons for the reviewing officer to consider; and a statement
that demonstrates the connection between prior specific written
comments on the particular proposed project or activity and the
content of the objection, unless the objection concerns an issue
that arose after the designated opportunities for comment. For
additional information about how to object, contact Leslie Taylor
at ldtaylor@fs.fed.us or 541-427-5324.
