East Oregonian Page 7A PENDLETON Business owner to take plea in drug case he listened to phone calls Lybrand made from the Umatilla County Jail, An Oregon State Police Pendleton, to his mother in detective claimed he found Hermiston. Pendleton Police evidence Pendleton business Chief Stuart Roberts at the time said the owner Jason local inter-agency Lybrand tried to Blue Mountain have his mother Enforcement conduct a drug Narcotics Team deal while he was was investigating in jail. Lybrand, who Umatilla was in jail for County Circuit violating a Court records court order out also show of Multnomah Lybrand, 46, County. The plans to take a following is part plea deal in the of the transcript drug case against Lybrand from McCrae’s him. That hearing is April 4 at the Umatilla affidavit of Sept. 12, 2016: Lybrand: “I just want you County Courthouse, Pend- to go handle it. Everything’s leton. Lybrand’s attorney, in my truck.” Mom: “Everything’s in Michael Breiling of Pendleton, filed motions your truck? I don’t know ... “ Lybrand: “Yeah.” to suppress key evidence Mom: “I don’t know what relating to a search warrant. Trampas McCrae, drug to do.” Lybrand: “Well, it’s uh, detective with Oregon State Police, wrote the affidavit in garbage bag, and it’s a, there’s six ... in it.” support of that warrant. Mom: “Jason, Jason.” According to the Lybrand: “Yeah.” document, McCrae stated By PHIL WRIGHT East Oregonian Mom: “I am not gonna do this.” Lybrand: “Well, it needs to be done. I have already done it once and everything is cool.” The call ends soon after, according to the document, but Lybrand called his mother back and said, “meeting was supposed to be at noon today, there are six of them in a bag, in a white bag in the truck, and they are 16 each.” Lybrand then told her where his pickup was, and, McCrae wrote, pressed her to complete the deal. The detective surmised Lybrand stood to “lose a considerable amount of money and/or a client” if his mother did not carry out the deal. After listening to the calls, McCrae wrote he drove to Lybrand’s house at 3510 N.E. King Ave., Pendleton, and walked to the rear window of his Ford F-350 pickup. “I could see in plain view inside the truck on the back seat floor board in a full white garbage sack with smaller bags inside,” the affidavit states. “One of the smaller bags has the label, ‘bubba kush.’” Kush is a strain of mari- juana. McCrae stated all of this to him added up to Lybrand trying to sell six pounds of marijuana for $1,600 a pound to a drug pusher he previously did business with. The affidavit led to the warrant and police seizing around 10 pounds of pot from the pickup, according to court documents, along with 12 grams of methamphetamine, $7,590.05 cash, a variety of other substances and pills, and five guns. Lybrand owns and oper- ates Wicked Kitty Tattoo & Piercing on Main Street, Pendleton. He has pleaded not guilty to felony charges of possession and delivery of methamphetamine and delivery of a federal Schedule III substance (methandro- stenolone, a steroid), and misdemeanor charges of delivery of marijuana and possession of the Schedule IV opioid pain killer tramadol. He remains free on bail. Maryland high school thrust into immigration debate BETHESDA, Md. (AP) — Outside a Maryland high school dragged into the national immigration debate by an alleged rape, a make- shift sign reflects that strain: “Rockville Strong.” Rockville High School students and parents declined to comment Thursday about the case involving a 14-year-old girl and a suspect authorities say came to the U.S. illegally from Central America. One mother would only point to the sign made of red plastic cups in a ballpark fence. Protesters on both sides of the debate converged on a nearby elementary school earlier Thursday during a visit by U.S. Education Secretary Betsy DeVos. And the White House has weighed in, saying President Donald Trump has made a crackdown on illegal immi- gration a priority “because of tragedies like this.” The Montgomery County school system has been besieged by hundreds of racist and xenophobic calls. In response, schools beefed up police presence in an attempt to reassure the anxious community. “Now we’re starting to receive calls that are threat- ening, saying they’re going to shoot up the illegals in our school,” said Derek Turner, a school system spokesman. He noted that the calls marked “a whole new level of vitriol that we haven’t seen before.” The latest flashpoint in the immigration debate started out as a sexual assault case. Last Friday, 18-year-old Henry Sanchez and 17-year-old Jose Montano were charged with first-degree rape and two counts of first-degree sexual offense. Police said the girl was walking in a hallway when one of them asked her to have sex and she refused. Montano forced her into a boy’s bathroom stall and they raped her, police said. Sanchez, who is from Guatemala, came to the U.S. illegally in August and was encountered by a U.S. Border Patrol agent in Texas, federal immigration officials said. He was eventually released to live with his father. Immigration and Customs Enforcement officials wouldn’t comment on Montano, who is a minor but is charged criminally as an adult. Federal law requires public schools to admit students even if they are in the country illegally.
