THURSDAY The attorney for rape defendant Shaun Allen Dick of Pendleton asserted the accuser in this case set up his client to steal guns worth $50,000. But whether Robert Klahn will be able to make that argument when Dick’s two-day trial starts Monday in Pendleton will be up to Circuit Judge Christopher Brauer. Klahn claimed in court Friday the woman in early 2015 cried rape after a night of consensual sex so she could get Dick, 38, out of his house in Coombs Canyon a few miles southwest of Pendleton. The woman then arranged for others to break into the house and steal around 40 guns, some of them collector’s items. Dick reported the burglary and gun thefts on the evening of Jan. 22, 2015, while he still was a free man, according to court documents. And Klahn’s story comes from second- and even third-hand sources, including one man at Two Rivers Correctional Institution, Umatilla, who Klahn said has “a little bit of a reputation as a snitch.” Umatilla County chief deputy district attorney Jaclyn Jenkins called Klahn’s spiel nothing more than hearsay and as such Dick told the court it should not be admissible as evidence. Jenkins sought Friday’s hearing to exclude the story before trial began, but after Klahn called for a sidebar, Jenkins asked Brauer not to rule on her request. Rather, she said, when Klahn brings it up at trial, she will object. Dick and the woman met through an online dating site, according to court documents, and on the evening of Jan. 17, 2015, they engaged in consensual sex. But the state claims that changed in the morning, when Dick became violent and subjected the woman to “forceful, nonconsensual sexual acts.” The woman reported the crimes the same morning, which led to Dick’s arrest Feb. 25, 2015, making him the current longest-serving inmate in the Umatilla County Jail, Pendleton. He faces eight counts, including irst-degree rape, irst-degree sodomy and unlawful sexual penetration. Brauer at the end of the hearing Friday said this case has dragged on long enough due to delays the defense wanted. He told both attor- neys they needed to be ready for trial come Monday. PENDLETON PUBLIC SAFETY LOG 5:19 a.m. - An Irrigon woman told the Morrow County Sheriff’s Ofice she thinks her ex-boyfriend sent his friends to harass her. Two pickups using their high beams followed her earlier that morning, she said, and a dark-colored four- door sedan drove by her home on Northeast Eight Street four times. She also said someone vandalized her car. 08:25 a.m. - Pendleton police received a report that security cameras at the Sinclair station and mart at 701 Southgate, Pendleton, revealed an employee there stole $100 from a safe. 9:06 a.m. - A 77-year-old man reported a large beige horse was in his pasture on Kuhn Lane, Hermiston, and he had no way to corral the animal, which was being aggressive. 9:49 a.m. - Pendleton police received the irst of several reports of auto break-ins. The crimes took place on the North Hill. Callers on Northwest Fifth and 10th streets and on Bailey, Despain, and Furnish avenues reported the crimes. 10:18 a.m. - A woman at Riverside Mobile Estates, 2712 N.E. Riverside Ave., Pendleton, called 9-1-1 to report the city shut off her water and that was affecting her swamp cooler. A Umatilla County Sheriff’s Ofice dispatcher told her this was not the proper use of 9-1-1. The woman hung up. 11:28 a.m. - A woman asked the Umatilla Police Department to have an oficer tell the man who owes her $300 to pay up. A man said someone claiming to be with the Hermiston Police Department called his father and threatened to blow up his father’s house if he did not pay money. ARRESTS, CITATIONS •The Morrow County Sheriff’s Ofice cited Elizabeth McKinney of Irrigon for maintaining a dog as a public nuisance at large after a resident on Pheasant Lane, Irrigon, reported a Labrador trapped her in her yard. The caller said this seemed to amuse the neighbor who owned the dog rather than prompting the owner to do something about the situation. •Umatilla tribal police arrested Douglas Edward Springer, 58, of 4103 N.E. Riverside Ave., Pendleton, for second-degree attempted assault and menacing. •Hermiston police arrested Rachel Elizabeth Collyer, 32, of Hermiston, on a misdemeanor warrant for fail to appear and on charges of possession of meth- amphetamine, felon in possession weapon, and carrying concealed weapons. Recantation rumor puts kidnapping plea deal on hold By PHIL WRIGHT East Oregonian One of four co-defendants involved in an April kidnapping in Pendleton planned to change her plea to guilty until the rumor of recantation reared up. The Umatilla County District Attorney’s Ofice charged Steph- anie Carr, 22, of Pendleton, with second-degree kidnapping for her role in the April 24 plot against Saul Christopher Jacquez. Court docu- ments show the state would dismiss the class B felony if Carr pleaded guilty to attempted coercion, a class A misdemeanor, for threatening to harm Jacquez during the kidnapping scenario. But defense attorney Dan Stephens of Hermiston told the court his client heard Jacquez may have recanted his statement. Pendleton police reported Jacquez claimed Sarah Carr, the older sister of Stephanie Carr, arranged to pay him money she owed. But Sarah Carr and her cohorts on April 24 took Jacquez against his will to a ield outside Pendleton, where she stung him with an electronic stun gun, then left him. Chief deputy district attorney Jaclyn Jenkins told the court that was the irst she heard of any recan- tation, and she would check with Jacquez. Stephens asked Circuit Judge Christopher Brauer to delay the change of plea until there is conirmation on whether Jacquez changed his statements. Brauer re-set the hearing for Aug. 12 at 10 a.m. Two other defendants already changed their pleas. Brad McDonald, 35, of Pend- leton, also faced a charge of second-degree kidnapping until he pleaded no contest on July 14 to attempted coercion, the same charge Stephanie Carr now faces. McDonald is out of jail and has a sentence hearing Sept. 14. The plea petition shows he agreed to three years of court probation, must write a letter of apology to the victim, among other punishments, and agreed to testify at the state’s request. And Daniel Joseph Avila, 28, pleaded guilty on July 19 to second-degree kidnapping and received 46 months — almost four years — in state prison. Sarah Carr, 25, remains in the Umatilla County Jail, Pendleton, and faces charges of second-degree kidnapping, second- and third-de- gree attempted assault, menacing, and second-degree use of a stun gun. She has a trial readiness hearing Thursday, and if there are no delays her three-day trial starts Aug. 29. HERMISTON Flatbed pickup catches on ire at Sherrell Chevrolet East Oregonian The Umatilla County Sheriff’s ofice and the Umatilla County Fire District responded to a report of a car on ire late Thursday night. A passerby called emergency personnel at 11:12 p.m. to report a blaze at Sherrell Chevrolet, 2258 N. First St., Hermiston. A latbed pickup parked near the service garage caught ire from an apparent electrical issue. Deputies from the sheriff’s ofice had to cut locks off a chain link fence at the dealership to access the ire. The ire was out shortly after crews responded. “Everyone did a great job,” Kari Christiansen, owner of Sherrell Chevrolet said. Christiansen did not want to comment further, nor would she allow photos to be taken of the damage due to the ongoing insurance investigation and the process of noti- fying owners of the effected vehicles. There were no injuries and no damage to the building itself. At least one vehicle parked near the latbed appeared to have sustained some damage from the ire. Fire Chief Scott Stanton said the business was lucky the building or more vehicles were not affected. Sherrell Chevrolet was open for normal business hours Friday morning.
