Hart and Owens, his confederates, are in jail at La Grande. A party of Gibbon men encountered Rathie and ordered him .to put up his hands, about 9 o'clock this morning. In the party were Hugh Ruby, Dave Bonner and two Indians. When the five prisoners left the county jail they had no time to take food, razors or other articles such os they were found to have. There wore no prison guard ..belts about the jail or sheriff's office. The canteen has: been added since they left. The newspaper accounts are not thought to have been found by chance. PROMPT TRIALS FOR FIRST DEGREE MURDER WILL BE GIVEN CAPTURED OUT LA WS "First degree murder charges will be filed against every man who took part in the jail break of last Sunday, regardless of his part in the murder of Sheriff Til Tay lor," District Attorney R. I. Keator said in a statement issued today. "As district attorney I pledge my best ef efforts to get these men a speedy trial for the crime of first degree murder and to see that justice is done." NO LYNCHING WANTED Sheriff W. R. Taylor, brother of the murdered Sheriff T. D. Taylor, asked that the law be allowed to , take its course when Hart and Owens are brought to the jail here Sunday morning. Sheriff Taylor is anxious that justice be done and the prisoners be delivered to the courts of justice in regular form. "It would be a blot upon both the district! attorney's office and sheriff's office should mob violence rule," Mr. Keator said. "These men have valuable information that we desire. We need them far more badly alive than dead. "We moved ahead the graiw jury term one week, to August 23, in anticipation of having some or all of these men in custody. They will come up for trial at the Sep tember term of the circuit court. The capital punish ment law has been in effect in Oregon since June 26. AH five men are liable to face the gallows." j i- . i i , ' , - i 1 i 7. : : 1 i V V "'A I A- - : UNION COUNTY-HEN CAPTURE HART AND OWENS IN CAMP ' SIX MILES FROM- TOLL GATE LA GRANDE, July 31, (Associated Press, Special to the East Oregonian.) Neil Hart and Jim Owens who escaped from the Umatilla county jail, were arrested at 12 :40 this morning by a La Grande posse at Johnson's sheep camp at Spout springs, six miles this side of Tollgate, and north of Summerville. The first correct information of the whereabouts of the fugitives was on Thursday afternoon when they were reported seen in the vicin ity of the Green mountain on the main divide trail leading in a northwesterly direction toward Tollgate. LOOKOUT PHONED CLUE. Federal Patrolman Courtney of the Mount Emily Lookout station phoned this message in after being informed that a camp tender had seen two men across the trail. Two Posses Out Posses were organized and immedi ately sent from here. Also one from Meacham while Courtney and Ranger Nlbbe started out to verify the report. Later they found the trail and follow ed until dusk. This trait was picked ed if any strangers had been seen. . Jennings and his wife, Ela Jonninps, in an auto mobile near Bancroft, Idaho, on the night of May 27. Two men committed t he murder and headed west. Hart and Owens are reported by Mr. Keator to have come nere from Idaho. A reward of $1000 was offered by the sheriff of Iiunnoek county, Poca tcllo, and the Revelare Detective Agency, for the capture of the mur derers. Hart told prisoners in the county jail that a price of Jiono hangs over him in Idaho, Mr. Keator said. In addition to checking this suspi cion, the district attorney and sheriff want to learn who has been aiding in the escape of the half breeds. Committee Makes Ploa. Both he and Jim Owens looked to be in excellent condition in spite of their trip through the mountains." Such is the report brought here by Claude Miles, who left La Grande at 5 o'clock this morning by auto and arrived at 8 o'clock. Miles talked to Hart a short time in the jail but there were so'many other questioners there that he got little opportu nity to learn his story. . ASLEEP IN TENT. The half breed captives were sleeping in a tent at the John son corrals, Miles said. A sheep herder was sleping in the same tent. One slept beside the herder and theother was at the door way of the tent. The herder, Miles said, knew the identity of th pair but could not capture them himself. It is north of J?ommerviUe, towards which place two fugitives were belnsr traced yesterday. Miles said. He, with James . Kstes, drove 20 miles to Oreen moun tain, early Friday following- a report that there were two men in that vicinity. The .41 caliber pistol carried by them had. about 17 catrtdKox.
