A filing known ns a lieu section' of tlie Northern Pneific Railroad com pany, with headquarters In St. Paul, Minn., wax made In the noise land office yeHterday, says the Capital News. It Included 160 acres of des ert land under the Carey act In the vicinity of Mountain Home and un der the Mountain Home Beet Sugar company Irrigation project. The land selected was In lieu of certain describ ed land located In the state of Oregon and owned by the Northern Pacific railroad, being part of the grant which was given the railroad years ago In every other section along Its proposed line. This Is not the first Instance where Northern Pacific lieu script has been transferred to lands In Southern Ida ho. In fact, Receiver Ralderson states that many filings have been made on this scrlut. The mammoth land grant given this railroad as well ay other transportation companies In the west have created their scandals, and at the present time the govern ment has started litigation against the Southern Pacific Railroad com pany, or the Harrlmnn line, which traverses the entire western section of Oregon north and south to force this road to sell Its valuable timber holdings Including every other sec tion of land along Its route to bona fido settlers. A settler or purchaser wanting lieu script from the Northern Pacific road pays as high as eight dollars an acre for the land and for this he Is given transferable script which entitles him to file on land In any state, in lieu of land holdings which the road has. When this I done the government cancels the lan which the road holds for the script Issued for other lands. In many In stances the script Is Issued by the railroads on lands along Us road which are absolutely worthless, and may be a mountain peak. Njverthe less, the holder of the script Is en titled to good land In another state. The filing made today was described as being In section 9, township south, range 6 east.' When the lieu script Is transferred by the railroad to the local land of fice It Is presented In three different forms In which Thomas Cooper, whose signature appears on the script and who Is land commissioner of the railroad land department re quests that the holder be given certain selection. The script Is for warded to the department at Wash Ington and approved. A number of years ago the local land office had to handle consider able so-called "Indian" or "half' breed srlpt. which was granted by the government to Indians and by them handed down from generation to generation In lieu of land which the red mm had ceded to the govern ment. Under the provisions of this act any person employed by the United States as an artisan or laborer In any of Its manufacturing plants, arsenals , or navy yards, or In the construction of river and harbor fortification work, in the reclamation of arid lands or the management and control of the same, or In hazardous employment under the Isthmian canal commission, shall be entitled to the same pay that he would be earning at work, In the event he Is hurt and has to cease la bors. It Is provided, however, that no compensation shall be paid under this act where the Injury Is due to the negligence or misconduct of the employe Injured, nor unless the in Jury shall continue for more than 15 days. All questions of negligence or misconduct shall be determined by the secretary of commerce and labor. Thla la the (tore that aellt all the principal remedlea ana deea not rahafltaU. 1 to Injuries received In the service of the government The bill says In section No. 2: "That If any artisan or laborer so em ployed shall die during the said year by reason of such Injury received in the course of such employment, leav ing a widow or a child or children under 16 years of age, or a depen dent parent, such widow and child, or children and dependent parent shull be entitled to receive, In such propor tions and under such regulations aa the secretary of commerce and labor may prescribe, the same amount, for the remainder of said year, that said artisan or laborer would bo entitled to receive as pay If such employe were alive and continued to bo em ployed. Provided. That, If the widow shall die at any time during said year her portion ef said amount shall be added to the amount to be paid to the remaining beneficlarleB under the provisions of this section, if there be any." The act goes on to set forth that the superior in charge of any navy yard, arsenal or any otlrcr government de partment, shall report promptly all accidents to the head of the bureau or Independent office, and the report shall pass through the regular chan nels to the department of commerce and labor, where It shall, In due qourse of time, reach the secretary, who Is vested with authority to make investigations and adjustment. In case of any navy yard accident which shall result In the death of the victim, the persons entitled to com pensation under this act shall file affidavits of their relationship with the secretary of the department of commerce and labor within ninety days after such death, together with certificate of the attending physi cian. In case of Incapacity for work last ing for more than fifteen days the Injured party desiring to take the benefit of this act, shall, within a rea sonable period after the expiration of such time, file with his official superior, to be forwarded through regular channels, an affidavit setting forth the grounds for his claim for compensation, to be accompanied by a certificate of the attending physi cian as to the cause and nature of the injury and probable duration of the period of Incapacity. It Is further stipulated that any injured person shall submit as often as is required by the secretary of commerce and labor, at least once In six months, to a medical examina tion to be provided and paid for un der the direction of the secretary of commerce and labor.
