F. A. Gaiside, formerly cashier of

was captured at Minneapolis. He is
charged with grand larceny outright.
The wages of all underground men
at Butte have been Increased from

and Great Falls all men employed In
the smelters will receive an advance
of 23 cents per day who have been
receiving less than $3.
B. Beers of Independence, Is be
lieved to be the oldest living pioneer
of Oregon. He Is 71 years of age and
was brought to Oregon by his par
ents, around the Horn, in 1S36, when
1 year old. He has lived continuous

praise the value of imitation gems
which have of late been flooding this

Text of the Amendment.
That all persons who have hereto
fore purchased any of the lands of
the I'matilla Indian reservation and
have made full and final payment
thereof in conformity with the acts of
congress of March 3. 1 S S n . and of
July 1. 1!12. respecting the sale of
such lands, shall he entitled to receive
patent therefor upon submitting sat
isfactory proof to the register and re
ceiver nt La Grande, Ore., that the
untlmbered lands so purchased are not
susceptible of cultivation or residence
and are exclusively grazing lands, In
capable of any profitable use other
than for grazing purposes.
In the light of subsequent events.
and more especially in view of the
contemplated Investigation hy the gov
ernment nf some of the methods that
were employed to acquire title to
lands under the Fulton amendment
which afterwards became part of the
law the debate before the commit
tee Is of special Interest. The debate.
shown hy the record, follows:
Senator Fulton Now, that, as you
see. pertains to tne i.mamia reserva
tion, which is within the La Grande
land district. When provision was
made for the sale of these lands. It
was stipulated that the parties should
pay so much per acre In the first
plnce; then, that they should actually
reside on the lands purchased, and
should cultivate not less than 25
acres of each tract I think of each
ldO acres I am not sure about the
size of the tract of which they were
required to cultivate nt least 2i acres.
Now, a large portion of this land Is
absolutely unsuited for residence nnd
Inrapable of cultivation.
Senator Teller What Is the name

Senator Fulton There Is no town
on the summit. Maybe you are think.

that ought to he pretty good grazing

a large portion of the land consists of
crags and rocks and mountain sum
mits. Senator Teller That Is nil covered
with timber, la It not?
Senator Fulton No, sir; this ex
cludes the timber portion. You will
observe this provides, when they shall
make proof before the register and
receiver that the land Is Incapable of
cultivation nnd suitable only for
grazing, that they may get a patent
withoat proof of residence and culti
vation. They have to make proof
that It Is that character of land;
otherwise they would have tit llvo on
It. There Is some of It on which they
cannot live and which they cannot
cultlvnte. I took n team nnd went
over It and studlod It myself.
Senator Teller How much of It Is
there?
Senntor Fulton I defn't know. I
drove 30 miles through It. ns a rough
guess. I suppose there must be

Senntor McCumher Will you ex
plain to me what this Is? Th's pro
vides that nil persons who have not
heretofore purchased any of the lands
of the I'matilla Indian reservation,
and have made full nnd final pay
ment thereof In conformity with the
acts of congress of Mnrch 3, 1S85, re
specting the sale of such lands, shall
now be entitled to a patent. Why
are they not entitled to a patent any
way. If they have made full payment?
Senntor Fulton In addition to
making full payment, they have to
make proof nf one year's residence nnd
of cultivation to the extent of 25 acres.
Senator McCumher How did these
persons happen to purchase that land
under mi agreement that they were
to reside upon it for at least one year,
and now find that It was not of a char
acter that they can reside upon?
Senator Fulton Well, you know
that there Is n lot of that land. T;ie
land was divided Into classes and they
purchased a great deal of It without
seeing It nt all.
Senntor McCumher Intending It
for a home?
Senntor Fulton It was sold nt pub
lic auction. They supposed generally
that they could use It for a home, nnd
that portion which they could not use
some of It was purchnsed after
wards. But there was a decision by
the secretary of the Interior, or the
general land office I have forgotten
which to the effect that while they
could not get their patent until they
made proof of resilience and cultiva
tion, yet, having paid their money
they could hold the land and could
obtain their patent when thqy made
the necessary proof. Time was not
of the essence: they could hold the
land Indefinitely. A great many of
them were willing to do that for the
purpose of getting n few months'
pasturage for their sheep, and they
bought a great ileal of It with the un
derstanding that that would be the
policy of the department. But now
tlie department Is Insisting that they
must forfeit their title to whatever
they hove secure. 1 if they do not mako
proof of cultivation and settlement.

Senntor Fulton They are small. I
have not heard of any one having un
der control over a section. I can sec
no possible disadvantage to any per
son, nor any Injury to any one, as long
as they make proof, satisfactory to
the department, that the land Is In
capable of settlement.
Senator Clapp ft might possibly In
volve some perjury on the part of
these people. In the Interest of good
morals I believe that requirement
ought to be stricken out.
Senator MeCumber Are not some
of these purchasers speculators?
Senator Fulton No, sir; they are
not. I know nearly all of them.
They are residents there sheepmen
and cattlemen. I took the pains to
ride over this land myself. In order
that I might be thoroughly familiar
with the situation.
Senntor Teller What is the de
partment's position In this matter?
Senator Fulton The department Is
against us on these grounds. They
sny these people must have known
the character of the land when they
took it; that Is all.
Senator Teller I suppose If wo do
not put In the amendment they will
simply go up there and live there
nominally a yenr live there a few
months and assert that they have lived
there a year?
Senntor Fulton It Is almost com
pelling a man to do something In vio
lation of his conscience If you ask him
to try to make a home and scratch out
an alleged cultivation on such land
In order to get his title. It does not
seem to me, where It can be proven
that the land Is unfit for residence or
cultivation, that a man should be put
to such straits.
Senator McCumher As the depart
ment says, It seems they must have
known what they were buying. They
probably bought It Intending to use It
for grazing purposes, and bought It
cheaply.
Senator Fulton They bought It at
the established price.
Senator Teller How much was
that?
Senator Fulton $1.B0, I think; It Is
Indefinite in my mind this morning
whether It was $1.D0 or $2.
Senator MeCumber How many
acres are Involved?
Senator Fulton That is rather dlf-
flcult to tell, but I should Imagine
there would be, perhaps, 4000 acres.
