Washington Supreme Court .Upholds Inheritance Tax Law. The Wulla Walla Bulletin says cf the supreme court decision upholding the inheritance tax law in that state: Taxation of Inheritances by will Is held to be legal in a decision rendered by the state supreme court yesterday in a case appealed from King county. The decision Bets at rest all constitu tional questions which have been rals ed against the act, and makes certain a large Income to the state by reason of the law of 1901, creating the state tax commission. Lawyers declare that no ground now rcmalnB on which an attack against the constitutionality of the statute can be successfully carried on. The case appealed concerned the estate of and heirs of the late Wil liam Wellington White, who died last fall in Oakland, Cal., leaving 160,000 In Seattle property. The state tax commission assessed the lawful tax against the estate under the act creating the commission. The executors of the estate fought the as sessment, attacking the constitution ality of the act. The claim was made thut the title of the act did not cover inheritances by will and therefore was Invalid. i The supreme court sustained the de cision of the supreme court rendering a decision against the executors of the estate. The amount involved In tne case was less than $1000, It Is stated but the principle of the act being up held will operate to bring a large rev enue to the state treasury rrom me state at large. In prior suits brought to defeat the state tax commission law the supreme court has decided In favor of the stat ute and lawyers state that nothing can now prevent the full operation of the law. Robert Glnn, a former resident of Umatilla county, but now residing at Moro, Sherman county, left last night for his home after a visit In the city, guest of his sister, Mrs. Thomas Thompson. Attorney Will R. King, of Ontario, passed through this morning to Walla Walla on professional business. He says a number of home seeker, are now stopping off at Ontario each week and the country is rapidly de veloping. Thomas Walsh, assistant superinten dent of the O. R. & N. at Starbuck, Is In the city today assisting Superinten dent D. W. Campbell in starting the transfer of freight In this city. Twenty Men Now at Work on Walla WmIIu'h Street Car System. About 20 men, under the charge of Superintendent Lawton, began work this morning on the construction of the electric street railway line of the Walla Walla Traction company, rays the Wulla Walla Bulletin. The first work was taken up at the Intersec tion of Palouse street and Boyer ave nue, where the first dirt for the roadbed was removed. The line was surveyed up Boyer avenue yesterday afternoon and this morning the men with picks and shovels followed the grade stakes up the street toward Whitman college. As soon as the grading is completed the rails will be laid and the roadbed ballasted. it Is the Intention II the weather does not prevent to have one and a half miles of the road completed and In operation by April 30. Deputy Assessor Named. E. 8. Wilbur, of Duncan, has been appointed by Assessor Strain to assess all that part of the county lying east of North Fork, Including Duncan, North Fork, Huron, Meacham, Kame- la and adjacent settlements. Mr. Wil bur took his supplies out today and will begin work next Monday morn ing. J. S. Cherry, of Pilot Rock, has been appointed deputy for that dis trict and will begin the work of as sessment within a few days. Judge Lowell to Portland. Judge Stephen A. Lowell, candi date for United State, senator, left for Portland this morning on a brief business trip. The reports from all parts of the state are highly favorable to the candidacy of Judge Lowell. Harney and Malheur county are work ing diligently for his election and prl- ate letters from Union and Baker county say that he Is the most popular candidate In those counties. DECLAMATORY PROGRAM. Pendleton Academy Will Hold Con test nt Cliupel of Academy on Fri day Evening. The annual declamatory contest of Pendleton academy will be held at the chapel of the academy building on Friday evening, March 23, at 8 o'clock. The next address will be on Wed- Sult for Divorce. Carrie Cooper today filed a suit for divorce from William F. Cooper. The couple were married In Los Angeles In August, 1902. Desertion is the cause of the action. No children have been horn to them. Peter West Is at torney for the plaintiff. City of Portland Acquires Lewis and Clark l'ulr Forestry Building. The city of Portland Is now in pos session of the forestry building, which was the pride of the recent Lewis and Clark exposition, and which was re cently received from the Oregon state commission by the city, says the Oregonlan. Yesterday afternoon Jefferson My ers, president of the state commis sion; Dr. Dav. Raffety, commissioner of forestry at the exposition, and. Deputy City Auditor C. F. Wiegand Journeyed through the mud and slush to the magnificent structure, and took an Inventory of all the contents of the building, which was later officially turned over to the aduitor at the city hall. The building will be placed under the supervision of the park commis sioners, who will have charge of care taking and installing of further ex hibits. . Several of the lumber companies having exhibits In the building have agreed to leave their property there, and also to add to their collections from time to time. The building was erected at a cost of $35,000, and the contractors are said to have lost $5900 In the con.--structlon. Ill accordance with an agreement made with Mayor Lane, James J. Hill, of the Great Northern, will be requested to place the con crete foundation as soon as possible, for the park commission desires to have the building thrown open to the public at the earliest possible date. The city has acquired title to two acres of ground on which the struc ture Is built, and the grounds will be fitted up as a park. Mnrrluirc License Issued. A marriage license was Issued to day to Alfred C. Hemphill and Mar guerite Ogllvy, both of this county.
