Vienna, June 16. Tho opinion pre vailing here Is that the peaco nego tiatlons between Russia and Japan will eventually prove successful. This Is booed primarily on the belief that Japan will meet Russia more than half way, making unexpectedly rea sonable demands. Certain Intimations have been received here that Japan': terms are substantially as follows: "One The recognition of the Jap anese protectorate over Korea. "Two The return of Manchuria to China." "Three International control the Eastern Chinese railroad. "Four Regarding Port Arthur, the strategical value, of this fortress has been overestimated, and it Is said that Its ultimate disposal will not give rise to any controversy. "Fifth It is not thought that Ja pan will demand the demolition of the fortifications at Vladivostok. "Sixth The surrender of the Island of Sakhalin will not be demanded by Japan, principally because Japan has not yet carried the war Into Russian territory. "Seventh An understanding re garding an Indemnity Is not Impossi ble because It Is declared Japan wfll content herself with demanding the cost of the war." The Russlon auxiliary cruiser Kouban. formerly the Hnmburg-Amerlcan steamer Aug usta Victoria, has arrived off this port and asked coal sufficient to reach the nearest Russian port. The vessel did not participate In the naval battle of the Sea of Japan, having been de tached to reconnolter along the east- ern coast of Japan. Depressed In spirits, and empty of pock it, 20 farmers, hailing from the state of Washington, arrived this morning on the steamer Newport from Sallna Cruz, Panama. Over a year ago they Invested their savings in a society known as the Pan ama Ijoan and Investment Company, which promised them fortunes in Panama rubber plantations. Two strangers, supposed to be the men last seen with the man found man gled on the railroad track near Hil- gard Wednesday, were arrested here ut nigh:, on fuspt'en and are being held to await the arrival of the sher iff of Union county. Neither of the men In custody will give their names and the authorities rrested them upon general suspic ions, as they came from the direction La Grande and admitted knowing something of the finding of the re mains of the stranger on the moun- uin. Eighteen railroads today asked the federal court for an Injunction restraining the board of railway commisHioners from putting in effect the maximum freight rate law which goes Into force today. The railroads contend the law Is con flseatory. The reductions ordered an average of about 20 per cent. A tmporary injunction will probably be granted. A temporary injunction was grant ed. TWO MEX WERE AMHTSIIED. HERDER SWEIT AWAY. Man Cloudburst In Malheur Carries and SlHvp. Rolse, June 16. M. B. Gwlnn has returned from eastern Oregon, where he has been looking after his sheep Interests. He brings news of the tragic death of Frank Cofforra, a sheepherder, on the Malheur river, 85 miles from Ontario. The herder was swept- to death, together with 1000 of his sheep. The water came down up on him in a wall 10 feet high. The cloudburst occurred five days ago, but the body had not been recovered when Mr. Gwlnn left. The cloudburst occurred In an Is olated canyon and this Is the first news of the fatality. Cemetery Improvements. The Odd Fellows are making some valuable Improvements to their ceme tery. They have just completed grading the road from the county road to the cemetery also several streets In the cemetery and have let tho contract for 6000 feet of pipe which will give them a good supply of water. Their total expense will be nearly $800 by the time the work Is completed. La Grande Observer. One Shot Dead, the Other Was Dan gerously Wounded. Palouse, Wash., June 16. Isaac Fields, a farmer living on Cedar creek, between Palouse and Garfield, and his son Fred Fields, who lives at his homestead on Crane creek, were fired upon from ambush today. At the first shot the younger Fields dropped dead with a bullet through the head. The next shot struck the elder man In the arm, and as he turned, a second bullet struck him In the back. The wound In the back is serious, xne wounded man was taken to Freese postofflce, a few miles from the scene of the shoot ing. The dead man leaves a wife and children. The only motive that so far can be given for the crime is revenge. Fred Fields had a squatter's right near Freese and trouble is supposed to have grown out of a lsiid controversy. in THREE NEGROES EXECITED. Convicted of Murder and Assault Alalia ma. Decatur. Ala.. June 16. The train from Birmingham bearing Harvey Smith, John Collier and Will Jack son, three negro murderers sentenced to hang here today, was wrecked at Boyle, Just out of Birmingham. Otis Botts was hanged In the county Jail this ' morning for the" murder of ht wife In a hotel In this city January 6 last. The woman was choked to death with a piece of ribbon less than a foot In length. Botts was suspected of the murder of Birdie Hoffman, who was shot near this city five years ago. Gearing and Master lilectrlclan George Hanscom of the equipment department of Mare Island navy yard have returned from their trip to the south, where they went to Inspect sites for the establish ment of wireless telegraph stations under the control of the navy depart ment. A site at Point Loma anl om at Point Arguello, near Santa Bar bara, will be recommended. Tomorrow Lieutenant Commander Gearing and Hanscom will depart Bremerton, where they will se lect a site for onother station. It Is expected they will be absent three weeks and that during that time thev will select six sites for wireless tel.- graph stations btween San Francisco and Capo Flattery. The stations are to be approximately 200 miles apai and will allow at all times communi cation with the ships of the Parlfk squadron as they cruise up and down the coast. Ho suggested that St. Paul will be a cool Bpot enough for the peace envoys. During the naval maneuvers off Newport, Midshipman L. L. Vertrees of the Annapolis academy, fell over board and was drowned. The body has not been found. GLENN BUSH EE DEPUTY I S. MARSHAL An automobile occupied by Mr. and Mrs. R. S. Sayer and their two sons was struck by an Erie train near Go shen, N. Y. The parents wero both Instantly killed and the sons cannot survive. It Is learned from gobd authority here that the oppolntment of Glenn Bushee as deputy United States mar shal for Eastern Oregon will In all probability be made within a short time. His headquarters will be In Pendleton. It Is presumed that the appointment Is to be made In order to have someone here to attend to the numerous eases which come up on the Umatilla reservation, and for which It has been necessary to secure a deputy from Portland during the past, thus taking considerable time and making needless expense to the government. When Deputy Marshal Griffith was here a short time ago to look Into the Joe Parr case, Mr. Bushee was engaged by him as a deputy, and he Is generally regarded as .being well qualified for the position, as he Is well acquainted with the Indians and their customs. "While the matter of road and street improvement Is being agitat ed here, and the city and county are buying road machinery. It is also im portant that the question of having a competent engineer to direct the work should also be considered, sam 1. M. Bates, of Walla Walla, who was In town last evening. Mr. Bates is tne representative of the Buffalo Pitts company, and sold the steam roller to the county. He has taken a strong Interest In such mat ters. In his opinion a large amount or money and costly experience will be saved the city and county by hav ing an experienced man to have charge of the road and street work to be done here. As an example of the value of such an experienced man, Mr. Bates told of an incident which happened at wana Walla during the recent meet ings there. While in that town one of the members of the national party was asked to look over the contract that Is about to be made for some blthullthlc paving there, and he Is said to have called their atten tion to a point in the agreement, and by doing so saved the city several thousand dollars. According to Mr. Bates rvracticnllv all of the important road work in the eastern states is now being done un der the direction of competent engi neers. France has asked Germany to explain what will be the exact bearing of the proposed confer ence upon the Moroccan question, for which Germany recently sent a note to the powers, before signifying what the answer of the French government will be. MURDERER UNKNOWN. Body of Suscctcd Grandson Fonnd In the Brush. Stockton, Cal., June 16. The. body of Chester Maker, the youth suspect ed of the murder of his grandmother, Mrs. Williams, at Lanca Plana, was) found this morning In the brush half a mile from the house In which he and Mrs. Williams had lived. His head was battered almost to a Jelly and It is believed he was first shot and then clubbed. Mrs. Williams' throat was cut last Monday and her body found In bed The mattress was slashed, the mur derer evidently looking for money. Her grandson was missing and waa suspected of the crime, but the dis covery of the body this morning proves beyond doubt the murder was committed by some unknown person. JURY FOUND TRUE RILL. The condition ot General Maximo Gomez Is growing worse and since midnight death has been expected nt ony moment. Government Crop Report. The government report for June is due this afternoon. It is expected to snow a condition of winter wheat be tween 89 and 90, compared with 92.5 in amy ana an estimated yield of 487.000,000 bushels. In June last year It was 77.7. A condition of 90 would mean a yield per acre of 15 bushels. and 449,000,000 bushels. The acre age of spring wheat will be given, also the condition. Tho acreage har vested last year was 17.209,000, and the crop 219.000,000 bushels. An la- crease In this year's area of 5 per cent Is anticipated, which is equal tot 860,- 000 acres. The condition Is expected to be close to 95, which would mean 270.000,000 bushels on the Increased acreage. Last year the condition was 93.4. The first report on oats will ba given today. A slight Increase In the acreage Is anticipated. The area har vested last yenr was 27.842.000. and the crop 895.000.000 bushels. The con dition a year ago was 8".2 and It drop ped 10 points from that up. to har vest. I Newspaper Man Dead. Liverpool, June 16. Sir John Archibald Wilcox, proprietor of the Liverpool Courier, and a large bncco manufacturer, died today. to- Rnildlng Laborers Struck. The laborers engaged In the con struction of the new Idaho Trust company's building at the corner of Fifth and Main streets, withdrew from tho work yesterday afternoon on account of a disagreement arising over t'..o scale of wages for the mortar and cement mixers. The matter was ta kn before the trades council during the afternoon and tho differences set tled. The men will return to worlt this afternoon. Lewiston Tribune. Strike Muy Spread. New York, June 16. Presi dent McArdle of the Interna tional Association of Foundry men, announces that if the em ployers of Xew York and New Jersey, where a strike Is now on, refuse to grant an Increase of 23 cents per day, they will extend the strike to the entire country.
