Tuesday night at 11 o'clock shot and killed Otis .Claud, proprietor of the Proaawav cafe. Claud was attempting to kill one II. c. Stiles, whom he accused of be ing Intimate with his wife, when Dial and Officer Roff Interfered. Claud turned the pistol on the officers after Roff had shot over his bead as a warning, and was then shot in the stomach by Dial. Claud died almost Instantly. When the trouble began Mrs. Claud was in a hack, having made an ap pointment with Stiles Claud, who was suspicious and very jealous, had "caught on." and tried to intercept Stile oa the tatter's way to the hack, which was In waiting for Stiles with Mrs. Claud. Claud began filing at Stiles, who Jumped IMS the hack and ordered the driver to run. Before the vehicle could get under way Claud shot Stiles twice In the shoulder and ' In the right hip. Neither is a danger ous wound, and Stiles will soon re cover. Stiles ran away as soon as Claud fell from the effects of Dial's shot, and was found at the house of a friend in another part of town. Dial for many years was a con ductor on the O. R. ft N. between Pendleton and Huntington. After ward he invested in the drug business here, at the present site of the Koep pen drug store, the establishment be- banded. " ! A stranger appeared during the period - of waiting and informed the councllmen that he represented a ma chinery company that had a second hand road roller on its hands that could be purchased at a bargain. "1 understand that Pendleton Is desirous of purchasing a roller," he said. "We have no particular use for a roller." said Mr. Dickson, "we did discuss a rock crusher at one time." The funeral was held this afternoon at 2 o'clock from the family residence. Interment in the Olney cemetery. He had been sick but a few days. Lamont was tried on the first named charge this morning and the Jury required but five minutes to bring in a verdict of guilty. Lamont was employed by C. W. Ir vin. a local confectioner, for several months. la July he departed for Portland with 1400 of Irvin's money with the understanding that he was to use it to purchase machinery for the candy factory. He later Is said to have secured about $300 more from Irvln. He failed to return, or to send the machinery or money and he -was arrested. Lamont did not take the stand this morning in his own defense. The three witnesses called by the state were: Irvln and his wife, and Sher iff Taylor. It is not known whether the convicted man will be tried on the other two charges. If the case just disposed of is appealed he may be brought to trial on the other In dictments, but If not, they will per haps be dropped. Otto Koeppen has so far recovered from the operation upon his ankle as to be able to leave the hospital tomorrow. The last examination was thorough, and the abscess was not only thoroughly cleansed, but it was found that the bone was not in the slightest degree affected. Marriage License Record.
