Hut wo apprehend that dealing and playing and and carrying on a game ol Faro, all at tho same time, nnd ut one setting, and be tween tho snmo parties, would constitute but one ollcnsc, and such an Indictment may 1m supported by showing that the defondant had done one of these things. We think therefore, the Indictment Is not defective lu this respect. In support ol the second objection In tho demurrer, that the Indictment does not state bet sufficient. It Is claimed by the respondent that tho net of 1S7G, under which tills Indictment In found, is uncertain and told. The lan guage of the St. e on which this Indict ment Is framed in, "each and every per.-on who shall deal, play ot cirry on any game of Fnro, etc." It U contended that the word Faro is ot too general a meaning to describe n crime; that the Statute should have described how the gatno ol Faro was played. Wo think the designation ol the game sufficient. 1st RIsliop, Crim. I'roc., Sec. HS(i. It Is also contended that if tho Statute Is not sufficiently explicit, that the Indict ment should set out the fact which consti tute the game, that the Court may judge whether the fact constitute the game of Furo. Wc think the Indictment being ns explicit ,In describing the offense as the Statutes which creates It, it Is sufficient in case like this. In Common wealth vs. Wclkh. 5th Gray. :124, Judgo Mctcnirstates thejrule at follows:. '-A charge lu an in dictment may Is; made in the words of the Statute without a particular statement of tact and circumstance s." In this case the Statutes states what art shall commute the offense; and the state ment of those ucti In tho indictment, shows to tlw Court that the offciikc has been committed. The Indictment must state the act necessary to be proven. In this case a witness may be called in aud if be swear that respondent dealt, played and carried on a game of Faro, then the crime is proven us alleged, nnd these are all the acts ncces'ary to constitute the crime. There is another objection urged, and that Is, that the penalty provided for. In the act ol 1S7B. must be recovered by an action as provided lu Sec. 11 ol the said net. In construing nn act of the Legislature, it Is a rule to consider nil its premise-, aud to construe each section ns to give effect to the whole. If this can be done. It Is a rule aNo, that nn act shall be so construed ns to uccomplMi the object tor which it was enacted. A law should not be so construed ns to defeat Its intent.
