The proposed constitution was passed 8-1 Tuesday morn ing and sent to the House floor for action, possibly as early as Monday. United Priu International SALEM The Oregon broad casting industry scored a major victory Tuesday with passage of a bill that would permit radio and television stations to broad cast legal notices. The Senate bill which deals with the formation of port dis tricts now goes to the House, The measure contains an amendment which makes it per missive to give public notice "on one or more radio or television stations serving the area." The broadcast notice would be in addition to regular pub lication in a newspaper of gen eral circulation. Sen. Glen Stadler, D Eugene, a radio station executive, said it was the first Oregon legislation to enable broadcasting of pub lic notices. He said he already has asked the Legislative Counsel Commit tee to make an interim study and prepare a bill for the 196S aession to add the "permissive" clause to all state laws where public notice Is required. Historically, such notices are published in newspapers. Karl .1. Nestvold, Eugene, manager of the Oregon Assn. cf Broadcasters, said "Washing ton state has used broadcast notices for several yeara, and haa a provision that the state can use newspapers, radio or television to publicize constitu tional amendments." Neither Nestvold nor Stadler knew of any other state which authorizes broadcasting of legal notices. Stadler aaid election and similar notices can "very bene ficially" be broadcast, and sug gested many people do not take the time to read "the small type" in newspaper legal ad vertisements. I He said "at first we want to makp broadcasting permissive, and after several years may at tempt to make it mandatory." Stadler said the idea was first auggested at an Oregon Assn. oi Broadcasters meeting last November. Senate Education Committee Winds Up Work on School Bill By ZA.V STARK Of tha Unlud Preel International SALEM The Senate Educa tion Committee Tuesday stripped special programs from the basic school support fund, changed the school census age and re jected a plan to place the basic school fund on a biennial ap propriation basis. Liability Bill Questioned SALEM (Special) A meas ure which would have relieved a tree farmer or other land owner from liability to persons using the land for recreation hit a legal snarl Tuesday. House Bill IBBfi would have meant that a timber company with an improved recreation area would be protected from lawsuits or other litigation brought by someone injured in the park. Rep. W. O. Kclsay, D-Rose-burg, told the House Tuesday the bill would "protect land owners and encourage them to offer their lands for recreation al uses." But Rep. Edward Branchfield, R-Medford, posed aeveral legal questions and was successful in sending the bill to the Judicial Committee so that lawyers could che.ck it out, Many firms such as Weyer haeuser, Georgia-Pacific and others have tree farm parks where the public is invited. The bill was forwarded to the Ways and Meana Committee with the recommendation that the amount of basic school sup port be increased. Ways and Means will deter mine the amount of any in crease. The Senate Education Com mittee made six policy decisions regarding the state's basic school support program: Maintain the present con tinuing appropriation. Maintain the present equal ization features. Change the census base from 4 to 20 years of age to S to 17 years. Springfield Man Given Jail Term Everett Richard Collins, 44, of 404 B St., Springfield, was sentenced Friday to a 10-month term in the city-county jai! fol lowing revocation in Lane County District Court of his probation term. Collins was placed on proba tion in December, 1961, for contributing to the dependency of his five children. It was de termined in a hearing Friday that Collins had failed tn make support payments and had been living with his family while his ex-wife was receiving welfare aid for the children, Collins admitted violating terms of the probation hy con tinuing to use intoxicants. Eliminate special programs and administrative accounts from the basic school fund. Continue to finance trans portation and growth programs from the basic school fund. Sens. Donald Husband, R Eu ene. and Glenn Huston, D-Leb- anon, voted against removing the special programs from the fund. Husband said the action would "jeopardize the programs" by making it necessary for the board of education to plead for money each session. Public Instruction Supt. Leon Minear said the Board of Edu cation wanted the program, re moved from basic school sup port, although the governor had asked that they remain a part of the fund. The committee also voted to send the teacher tenure bill to the Senate Judiciary Committee i without recommendation, tabled a bill which would have estab lished a minimum lunch period for teachers, and gave unani mous approval to a measure : which would enable district school boards to contract with other school districts for special education programs for handi capped children.
