March 21, 1962 Fit 3A Prisoner Mistreatment Law Aimed At Brutality WASHINGTON (UPI) Justice Department officials said Wednesday their latest civil rights proposal would make it easier to convict policemen guilty of brutality and third-degree methods of interrogation. Atty. Gen. Robert F. Kennedy asked Congress Tuesday to close loopholes in the present federal ban on beatings imposed on prisoners in the guise of law enforcement. In a message sent to congressional leaders, Kennedy also appealed for stiffer fines and jail sentences for anyone convicted of such offenses. Burke Marshall, assistant attorney general in charge of the 1 civil rights division, said only Ribicof f Asks Cabinet Rank For Education WASHINGTON W Abraham Hibicoff, secretary of health, ed ucation and welfare, wants all federal education activities con solidated in a new cabinet-level department. "In my opinion education is power," said Ribicoff. "I think in this respect the Soviet Union has recognized this a lot better than we have." Ribicoff, testifying recently before a House appropriations subcommittee, said a minimum of 60,000 boys or girls in the upper third of their high school graduating classes don't get to college because they can't af ford it. Another 60,000 students with good grades drop out of college every year because they don't have the money to con tinue, he added. "I don't think we can afford if," he told the committee. "I for one think we can do a better job." : He told the subcommittee he would press for creation of a Department of Education, Sci ence and Technology, headed by a secretary. . Ribicoff's department now su pervises the Office of Education, Which was criticized several years ago by Vice Adm. Hyman Rickover, who made a compari son of United States and Rus sian educational programs. Prison Bill Passes WASHINGTON (DPD The House has passed and sent to the Senate a bill that would al low federal prisoners to be freed on the preceding weekday if their release date falls on a weekend or holiday. Officials said they often had to call in prison workers on overtime rates to process prisoners being released on a weekend or holi day. three convictions for police brutality have been obtained during 12 prosecutions in the two years ending last June 30. Four cases are still pending in the courts. Yet the department received more than 1,000 complaints al leging police mistreatment or coerced confessions during this period, Marshall said. Approval of the new proposal would "ease the burden of proof" in such cases, he said. Law Said Too Vague Kennedy told Congress that the present federal law is too vague and the penalties are too inadequate for cases in which victims of brutality receive se vere injuries or die. Under Supreme Court rulings, he added, police accused of beatings or forcing confessions often are successful in pleading that they did not realize a pris oner's constitutional guarantees were being violated. Recommended in '61 Report The present maximum penal tics a $1,000 fine and one year in prison would be in creased to a $5,000 fine and a life sentence if the bill is ap proved. The U. S. Civil Rights Com mission recommended such leg islation in its 1961 report on the administration of justice. Al though most law enforcement officers do their job properly, the commission said, police bru tality is still a serious problem in many part of the country and Negroes suffer more than any other group. Johnny Weissmuller Sued for Divorce LOS ANGELES W) Johnny Weissmuller's fourth wife wants a divorce.. Allene Gates Weissmuller mar ried the onetime screen Tarzan in 1948. She said they parted last July. Weissmuller is now 57 and Mrs. Weissmuller 37. Her suit for divorce, filed Tuesday, charged cruelty. Unions Okay Departure Of 2 Vessels SAN FRANCISCO 0IPD The West Coast maritime strike moved into its sixth day Wed nesday with no indication of a settlement, although both sides in the dispute have agreed to concessions on some strike is sues. Three striking Maritime unions sailors, firemen and cooks and stewards agreed Tuesday to permit immediate sailing of two vessels with mili tary cargo, including 1.500 tons of nuclear test material for Christmas Island. The agreement between the unions and the Pacific Maritime Assn., representing the employ ers, also will allow passenger ships at Honolulu to return with their passengers to West Coast ports. However, there were no nego tiations scheduled between the PMA and the striking unions which would bring an end to the walkout. Mail Pouring In For John Qlenn LANGLEY FIELD, Va. Ul More than 30,000 fan letters and packages have been sent to John H. Glenn Jr. since he soared into history. They have contained everything from pennies to an offer to name an orchid entry in a spring flower show for him. This was reported Wednes day by officials at the head quarters of the Project Mer cury astronauts. The mail has piled in here, at Cape Canav eral, Fla., and Washington. Writers include a child who enclosed four pennies "to help pay the way for manned space flight." "Scores of offers have come in to name things for John," said one official. "They range from the orchid to bridges, and from schools to libra ries." Governors of various states want Glenn to pay a visit. He has offers of free cruises on steamships, an all-expenses-paid trip to Hawaii and gifts ranging from cakes and candy to an electric computer and an adding machine. All inciming gift packages are checked to determine whether they look like some attempt at commercialism. If they do, they are returned with thanks. All cash gifts are being turned over to a special fund which eventually will be do nated to charity. This includes a check for $100 from a phy sician who wrote Glenn: "You deserve a party go out and have a good time." The names and hometowns of the letter writers are not available right now. Officials at the Washington headquar ters of the National Aeronau tics and Space Administration said they were still sorting Glenn's mail and could not give any breakdowns.
