And he will take It, if the job is located in Portland. He is Sagie Nlshloka, 31, who was the subject of a meeting of the state board of control here Monday. Gov. Douglas McKay, a board member, said it was "stupid and a damned outrage" that the tax commission passed over Nishioka after he had taken a civil service (est and placed highest on the list, AFTER THE government's out burst, the tax commission re. versed itself and found that it had an opening for Nishioka after all. ! Ray Smith, state tax commis sioner, said Nishioka was turned down by Jason Lee, the commis sion's personnel dlrctor. But Lee said "I bitterly resent the state ment that I refused to hire Nishioka." However, W. E. Klmsey, lajjor commissioner and administrator of Oregon's fair employment prac. tices law, said earlier that Smith Had told him that he didn't hire Nishioka because the public would not approve the hiring of a Japan, ese. i NISHIOKA, a veteran of World War II who was wounded while fighting in Italy, at first said he would not contest the tax com mission's failure to hir him. Later, though, he changed his mind and said he would file a complaint with the labor commissioner. Monday's action made that un necessary. ' Statehouse reporters said the governor and tax commission re ceived a large number of letters protesting the refusal to give the job to Nishioka. c Nishioka, a college graduate who formerly lived In Hood River and Portland, now Is employed In Seattle at Fort Lawton. "NOW THAT President Truman has stepped aside, Mr. Barkley is the only man who can unite the various wings of the Democratic party this fall," Sen. Gillette (D-Ia) told a reporter. "He's the best vote-getter in the Ice Jam Starts Montana Flood HAVRE, Mont. (U.R) A flash flood caused by an ice jam in the Milk- River sent an esti mated 1500 northside residents fleeing from their homes in sub freezing weather Tuesday. Havre's two hospitals reported no loss of life. Water backed up by an ice gorge IS miles east of here spilled into lowland farms and brimmed over banks within this city of 8086 persons. The north section of the city was completely Inun dated, and a water-logged earthen dike between the residential dis. met and downtown Havre was crumbling and "threatening to give way," city officials reported "Water is still rising and evacu ation continues," Mayor Oval Hatler reported at 8 a.m. (MST). The entire population of the northside residential district has been evacuated. The dike is be ing reinforced by 100 flood wort ers, but may give way any mO' ment." Planes prepared to take off to dynamite the huge ice floe to re lieve upstream areas. Hatler said "I've been informed its impossible to dynamite the jam from the ground. "Several" farms between Loh- man and Havre were under water. The city of Havre itself was cut off from the north, east and west. A mile of U.S. Highway No. 2 between Havre and Shelby to the west was under three feet of water. The Great Northern railroad's tracks just south of the soggy Milk River dike in Havre separ ates flooded areas from the down town district. An additional 17 were injured, including four firemen overcome by smoke while combating the blaze. None died of burns. Fire Chief Edward P. Walsh said the victims were trapped In bed by flames which spread with "astonishing rapidity" after erupting through a light-well at the rear of the Casa Loma Hotel. Walsh had no idea how the fire started. An Investigation was un der way. Tenants, clad in nightclothes. scattered after climbing down fire escapes and ladders. Some 22 were cared for by the Red Cross which set up emergency headquarters in the auditorium of Sacred Heart Catholic Church, directly across the street. Others were housed by neighbors. The old frame building had ac commodations for 43 persons in its rooms and apartments. Tfie dead, emergency hospitals reported, were Lena Shift, 60; Melvih Sutherland, 8, and his mother, Mildred Sutherland, 48, Margaret iiambly, 65. Seven Cars Set on Fire PORTLAND (IP) Flames sprang up inside seven automo biles here Monday night in little less than an hour. All burning cars had been parked on the West Side, foiir of them within a few blocks of each other, in the North west district. Last week five cars were simi larly burned. Firemen said it appeared that someone lighted paper matches and dropped them in after first tossing in some inflammable li quid, possibly lighter fluid. 4 : Mm: i 2 WILLIE SUTTON Another Chance to Eacapt Sutton Found Guilty by Jury NEW YORK (IP) Master Criminal Willie (The Actor) Sut ton was convicted Thursday of staging a $64,000 bank holdup while he was the nation's most sought fugitive. An all-male jury returned gulltv verdicts after more than nine hours of deliberations against Sutton and his key henchman, Thomas '(Scup) Kling. Queens County Judge Peter T. Farrell remanded the pair to jail for sentencing. No date was set. The two defendants displayed no emotion as the jury foreman droned "guilty" four times for each defendant on counts of rob bery, burglary, assault, and grand larceny. Sutton, 51, and Kling, 45, were charged with holding up the Sun nyside branch of the Manufac turers Trust Company in Queens on March 9, 1950. Each of the defendants faces up to 30 years in prison. A federal mediator has been meeting with labor and manage ment in an effort to resolve the dispute over a new contract. Sunday a strike which threat ened to tie up the Portland Trac tion Co., was postponed for a week by AFL bus drivers. Death Cause Listed County Coroner Fred Buell said Tuesday that the Monday after noon death of Alja Davis, 60, of 1651 W. 14th Ave., Eugene, was caused by a cerebral hemorrhage. Mrs. Davis succumbed about 1:20 p.m. while mowing her lawn. She is survived by her husband, Ru dolph, and one child.
