Eugene Men Two Plaintiffs In Mine Suit ANCHORAGE, Alaska MP) The name of Nick Bez, Pacilie Northwest fishing Ileet operator and close friend of President Tru man, figures mominently in the trial of a $90,000 mining suit in Third District Court. Bez was referred to several times by Al Schneider, member of an Oregon group suing P. J. Cut ting and Audrey Cutting of the Kougarok Dredging Corp., in an effort to break a mining agree ment. Among the plaintiffs are Earl and John McNutt, Eugene con tractors and builders. Earl Mc Nutt Is a former mayor of Eu gene and a member of the state legislature, Schneider, general manager of Oregon Motor Stages, Portland, testified in his fourth straight day on the stand that Bez was con sulted by a group of Oregon fin anciers before they advanced $70,000 to the Kougarok Dredging Corp., to be used in purchasing stock in adjacent placer property on the Kougarok River, known as Kougarok Consolidated Plac ers, Inc. The Oregonians were identified as E. Royce, Schneider,, Douglas Owens, Charles Stearns, and the McNutt brothers. They are suing to cancel a con tract they entered into with the Kougarok Dredging Corp., on the grounds that its president, P. J. Cutting, did not inform them as to the financial obligations of the firm. The Cuttings filed a counter claim, charging the Oregonians breached the contract by evicting them from gold mining premises and by other arbitrary actions. Schneider testified Bez told him that Kougarok Consolidated Plac er was a good investment. Wen dell Kay, attorney for the Oregon men, said that Bez was a large stockholder in the Nome area places firm. Royce is identified as president of Oregon Motor Stages and part owner in the Yellow Cab Co., in Seattle and Portland; and Stearns and Owens as partners in a heavy construction firm at Medford. Ore.
